day was one against Buster Givinp, a
country negro, charged with the kill
ing of another black brother, Ben

and will be tried this week for the

Session.
Camp Sumter 642 held its regular
monthly meeting yesterday morning.
There was a good attendance cf the
old soldier 0 , and matters of interest to
the camp were disousstd. Veterans
who attended the reoent reanion in
New Orleans had glowing aooounts to
relate to comrades who coaid not at
tend and mingle with tbe boys who

Progress is Being Made.
Jonas Hicks, who sbo Y . to death Mr.
Jarrett J. Davip, one of Sumter coun
ty’a best citizens in a fit of sadden pas
sion and then attempted to take the
life of his victim’s brother as well,faced
a jury yesterday in a trial for his own
life for his crime.
Not m years has a trial here oreated
more interest than this one.
The popularity of Mr. Dovi?,and the
needless taking of bis life by the ne
gro Hicks, created greatest indigna
tion, and is largely responsible for tbe
convening of court in spicial session.
Hicks was iudicttd for murder on
Monday, and yesterday morniDg the
trial for his life began.
The trial of Hicks w»s entered upon
at the convening ts court 5 esterday
and progressed rapidly. Solicitor. Gen
eral Hooper represented the state, while
Mosers. Lane & Maynard and Judge
J. A. Hixon. by appointment of the
oourt, represented the defendant,
Mr. John Davip, brother of the de
ceased, Dr. Smith who attended him,
and several negro farm hands who were
eye witnesses to the tragedy testified
at length regarding the brutal killing.
The evidence against Hicks was over
whelming and conclusive.
The witnesses told at length of the
trouble in tbe field when Mr. Jarrett
Davis attempted to stop a row between
Hicks and another nogro, demanding
Hicks’ pistol. Mr. Davis was totally
unarmed and did not dffeam that Hicks
would attack him.
Almost without warning the infuria
ted demon raised bis pistol and shot
down Jarrett Davis and then turned his
weapon on John Davis, who was mere
ly a spectator. After shooting Mr. Jar
rett D u viß Hicks came to town and
surrendered
Snob, in brief, was tbe story told of
tbe leatfal tragedy.
Tbe jury retired early in the after
noon bat seemed unable to reaoh a
verdict for several hoars. At 8 o’clock
last night they expreseed a desire to
bereoharged by the oourt.
The jury is made up of the following
well known citizens.

T. Morris, J. F. Williams, A. J. Har
ris, Ed Stallings. M, L. Hudson, T.
M. Furlow, J. W. Shiver, E, O. Hills
man, O. It, Dixon, W, L. Williams.
Immediately upon being recharged
by the court the jury retired and in a
few minntes rendered a verdict of
guilty of mnrder. This means death
for Jonas Hicks.

DEATH RESULT OF SUNSTROKE
Chaingang Convict Falls Dead From
the Heat,
Tom Talbot, a connty convict em
ployed with the ohamgang force, fell
from the extreme heat yesterday after*
noon and in fifteen minutes was a dead
negro. The gang, under direction of
Sapt. Paschal, was at work near the
plantation of Mr. N. A. Ray. Talbot
was swinging a pick, and was not being
pushed at all. When Supt. Paschal
spoke to him about his work Talbot
suddenly staggered and fell m the
road. Supt. Pasohal had him removed
to the shade and applied restoratives,
but the negro died is a few minntes
It was 5 o’clock in the afternoon when
Talbot thus collapsed, but very hot
even at that hoar. Talbot had been in
the gang before, and was sent np this
time for destroying pnblic property.
