hunted the suuDy side ot the street
and wondered why the weather dootor
had slipped his trolley. Fires burned

A case of interest in Americus is
just couoluded iu the United States
court in Columbus wherein the Sea
board Railway was defendant in a suit
for $20,000 instituted by relatives of
Engineer W. L Rhea of the Seaboard,
who resided in Americus aud met
death while on his engine at Richland
September sth, 1904.
The suit is instituted by Mrs. Mollie
Lasseter of North Carolina, mother of
the deceased, and being a non reel
dent of the state the snit was insti
tuted iu the Federal court.

The plaintiff was represented by A'-
iorneys Harper and Williams, of
Americus while Attorneys E. A. Haw
kinF, of Americus, tnd Goelchiue &
Chappell, of Columbus, division coun
sel for the Seaboard, represented the
defendant company.
A motion to non-suit the case was
made by the attorneys for the railway
company, but after being ably argued
at length was overruled by Jadge
Newman.
The takiDg of testimony was con
eluded and argument continued yes
terday, The opening argument was
made by Attorney W. M. Harper for
the plaintiff, who was followed by At
torney Hawkins for the defense. At
torney J. R. Williams closed for the
plaintiff yesterday and Attorney Gool
ohius followed for the defense.
It is claimed that the railway com
pany was negligent in that the ma
chine generating the electric light was
out of order.
On the other hand, it was contended
by the railway company that all
ordinary care and diligence was used;
that the machine installed on the
engine for that purpose was a standard
machine; that it was inspected once a
month, although it was really not
necassary to inspect it more than once
in six months.
The defense contended that when a
man undertook to tun a locomotive he
took a degree of oaaaoe; that while it
was the company’s duty to give him
good machinery, and to inspect and
keep it iu got d condition, the railway
company was not an insurer, and
oonld not warrant Ui*t a?o dents would
not happen.
The jury yesterday afternoon re
turned a verdict in favor of tha rail

WALTER HALE QUITS SEABOARD
Popular Official Leaves Service of
Company.
Mr. Walter Hale, formerly superin
tendent of the Fif.li division of the
Beaboard Air L'ne, with headquarters
in Savannah, and later superintendent
of the Fourth division, with headquar
t»rs in Jacksonville, will leave the ser
vice of the company today. Mr. Hale
refuses to discuss b s fu'.ure other than
to sav he was irr need of a rest and
would now have an oppor.unity to
take it. It is currently rumored that
Mr, Hale is to become general manager
of the Darbam and Southern of North
Carolina. Circulars have been issued
appointing H. \V. Stanley, trainmaster
of the Third divieion between Atlanta
and Hamlet, to succeed Mr. Hale.
Postmaster Robbed.
G. W. Fonts, Postmaster at Riverton,
la., nearly lost his life and was robbed
of all comfort, according to his letter,
which say 2: “For 29 years I had chronic

Broughton will be banged in Americas
next Friday 18 h inst. Their cases
were appealed to the Prison Commis
sion Wednesday and are now being
considered by that tribunal. The two
negroes have been respited until the
18:b, and it is not believed that there
will be any further delay now in car
rying out the sentence of the court.
It is quite possible that the condemned
criminals will know their fate today,
or very shortly at beat.

belt sent October futures to 10.75, or
very near the eleven cents figure. This
will result in the killing out of a good
ly portion of the growing crop and
prices stiffened accordingly. Americus
ootton men are not disposed to look to
any immediate decline, as everything
aeems to point to a steady market for
some time.
