Liability of the Stockholders Settled OPINION FROM SUPREME COURT Bank cf Americas Case Is Deter mined Before That Tribunal —Hold- ers of Stock at Time of Receiver ship Atore Liable for Debt. The Sat feme Coart of the State has just rendered a decision in the case of the defanct Bank of Amerious, holding that only those who held stock in the broken bank at the time of sait against the stockholders can now be held liable for its indebtedness This decision affirms that of Jadge Fpenoe, who presided here in a trial of this important case a year or two ago. His decision was affirmed in part and reversed in part. The part affirmed is that given ab.ve rela'ive to the liability if stockholders at time of $ ait. Spence decided, and his de cision is upheld by the Supreme Court, that stockholders who had sold and transferred their sto?k in the old bank prior to the receivership, could not be held liable for the debts of the defunct institution. And the Supreme Court, in affirming that dtcisioD.affjrds relief to hundreds of innocent people here. Upon the other hand the Supreme Court reversed Judge Spence upon the point that the receiver for the old bank could not bring suit upon the judg ment previously secured by creditors, holding that such judgment was prima faoie evidence cf indebtedness. This referred to the suit brought by 6aid creditors against the receiver of the old Bank of Americas. Under this decision, the hundreds of people who owned stock in the old bank daring the long years preceding its oollapse are not liable for its debts under the ‘‘liability clause” in the bank’s charter, though they gave no notice of sale of stock. The ultimate liability of stockhold ers, who at the time of the'tack’s fail are in 1893 held stock therein, is not yet fully determined. The case’is one of greatest interest to hnndrids of people in Americas and throughout the state. Under the “liability clause” in the charter if the old Bank of Americas all stockholders were made liable for its indebtedness, unless at the time of sale or transfer of stock public notice of snch sale was given by legal publi cation. Few knew of such requirement or provision, and no transfers, or few, were eyer published. After the bank failed, northern cred itors brought suit against all the stock holders for the enormous deb*s of the old bank. Among these were included stock holders who years and years before the bank failed bad sold their stock. These stockholders are scattered over Georgia and a dozen states, or dead. But all were made defenders to this great suit.. The decision of the Supreme Court will thus bffjrd relief of all who did nothold stock when the bank collapsed. Postmaster Robbed. G. W.
