PHILADELPHIA, Sept. 30. (Spec
ial i—Pending a final decision of the
sfc&fce supreme court on the constitu
tionality of the two cent fare act, it
Is believed that all the leading rail
roads of the state will establish a
3»t, two cent fare tomorrow, the date
set for the law to become effective.
While the roads are confidenLthat
the decision of the Philadelphia court
is the test case brought by the Penn
sylvania railroad will he sustained
by the higher courts, they do not in
aend to risk having to pay penalties
if the decision should be reversed.
With the handing down of the opin T

will then be in a position to restore j

them.
The Pennsylvania was the first
road to attack the law, bringing a

The contention Os the company
was that the law was unconstitution
al, and that the two cent fare was
fixed by the state legislature without
any investigation as to whether the
railroads could make a fair profit un
der the law, which the company as
serts it cannot do.
The decision of the court, which
will become of national importance
if sustained by the supreme court,
sustains the contention that a two
cents fare is unreasonable and grants
the injunction asked for.
Among the reasons stated by the
court as to why the law is objection
able on constitutional grounds are
the following:
‘‘As a regulation of the plaintiff's
intrastate passenger business in its
entirety, the act under existing cir
cumstances is unreasonable and con
fiscatory,, and by depriving the plain
tiff of its property without the pro
cess of law, violates amendment
XIV'. of the constitution of the United
States.
"Since the taking from the plain
tiff of the profitable use of its prop
erty invested in the intrastate pas
senger business may be regarded as
a taking of that property
for public purposes, and since no just
compensation is made therefore, the
act violates article I, section 10, of
the constitution of Pennsylvania.”
The state officials will make a de
termined fight In the supreme court
to have this decision reversed, and
are hopeful of success. A decision
in favor of the roads, it is believed
would do much to prevent the estab
lishment of two cent fares in other
and less populous states.

FARMERS TO ATTEND
RALLY ON SIXTEENTH
Sumter Will Be Represented At
The Meeting.
No doubt a number of the farmers
of Sumter will go to Atlanta on the
16th, inst. to attend the great rally of
the Farmers Union. The event will
be one of interest.
In addition to addresses by plant
ers and officers of the union, a ban
ner will be awarded the county hav
ing the largest number of delegates
at the rally.

tion both from the addresses of
speakers and through visits to the
various exhibits of farm products,
live stock and farm machinery.”
