12 AMENDMENTS
TO BE VOTED ON

Have Many Constitu
tional Proposals
ATLANTA, September 3 —Twelve
amendments to the state constitution
—three of them passed by the 1919
legislature and the others at the ses
sion just adjourned—are to be voted
upon at the general election in No
vember. Proclamation by Governor
Dor<ey of the passage of each of the
amendments by the legislature have
been prepared and will be published
in each of the congressional districts,
beginning next week, during the two
months before the election as requir
ed by law. •
As there is no opposition to any
of them which attracted statewide
attention it is probable all will be
adopted, and one of them which ap
portions membership in the state leg
islature among the counties is destin
ed to cause a legal tangle.
Numerically, amendments to the
paragraph 2, section 1, article 11,
are in the lead, for this is the para
graph naming the counties and the
recently deceased legislature acted
favorably on the creation of five new
counties. They are Lamar, created
from portions of Pike and Monroe
counties, county*” site Barnesville;
Brantley, from portions of Pierce
Charlton and Wayne, county site, Ho
boken; Lanier, from portions of
Clinch, Berrien and Lowndes, coun
ty 'site, Milltjown; Semincfle, from
portions of Decatur and Early, coun
ty site Donalsonville and Long to
be created by cutting a section out
of Liberty county with its county
site at Ludowici.
Strong Opposition.
Lamar county is the only one of
the proposed counties which received
strong Opposition. A bitter fight
against it was made in the legislature
and since adjournment it has been
hinted that illegitima|a methods
were used in putting it over although
no direct charges have been made.
Citizens of Pike county are continu
ing their fight against Lamar county,
but they have so far attempted to
form no statewide organization to
defeat the amendment.
The amendment which is destined
to cause complications increases the
number of members of the house
from 193 to 196 in the caption of
the bill and in the body makes an
ino reaS e from 193 to 206. It was
sb’nned over on the senate and house
on the final night of the session and
no one except those who staged the
conn knew anything about it until
several days after adjournment.

Isentatives, an attempt which failed
[when made openly. At present the
six largest counties have three rep
resentatives each, the next twenty
six have two each and the rest one
each. The constitutional amendment
to be voted on gives three members
to eight counties, two each to the
next thirty counties and one each
to the others, a total of 206, al-'
though the caption of the bill limits■
the number t 0196.
Early in the session Representative
John Knight of Berrien offered a
bill giving one representative to the 5
three new counties which had then|
been acted upon. Lanier, Seminole i
and Brantley, in case their creation ■
should be approved at the general]
election in November. In the cap-,
tion of the bill it provided that the ,
total, number of representatives !
should not exceed 196, an increase;,
of three.
Later when census figures were!
announced it appeared that Lloyd
county had been displaced from the
“big six” by the growth of DeKalb
county, and Messrs. Harper, Davis
and Copeland of Floyd made a des
perate tight to pass a bill preventing
that county from being crowded
back into the two-representative
class. It was defeated.
Knight's Bill.
The house passed Representative
Knight’s bill, but it did not reach
the senate until the final night of
the session. Then Senator Elders of
fered an amendment which innocent
ly appeared to have no other pur
pose than to give representation to
Lamar and Long counties, which had
been acted upon favorably by house
and senate subsequent to passage of
the Knight bill.
The senate, harrassed by the fight
over the appropriation bill, passed
the bill as amended, it was returned
to the house and the amendment was
perfunctorily concurred in, probab
ly not more than half a dozen know-
ing what its real purpose was. It
appeared harmless, but it was a Tro
jan horse carrying in its belly ten
additional representatixes.
As the legislature is the Judge
of the qualifications of its members,
it must decide whether the correct
number of representatives is 196 or
206 in case the amendments are
adopted. As the governor has no
right to vett an amendment to the
constitution he could do nothing
more than certify it to the people.
“Big Eight.”
The counties having three repre
sentatives under the provisions of
the amendment are Fulton, Chatham,
Bibb, Richmond, Muscogee, DeKalb,
Floyd, and Laurens, the latter two
being the benefiiciaries of the legis
lative coup. The counties added to
those having two each by the in
crease from 26 to 30 are Worth,
Scriven, Walker, Wilkes, Jefferson
and Dodge.
The constitutional amendment to
be voted on in November which is of I
especial interest to Atlanta authoriz-|
es “baby bonds” for street improve
ments. It permits municipalities
having population of 150,000 or more
to issue bonds in excess of the pres
ent constitutional limitation by a
two-thirds vote of the city council
without a referendum to the people,
provided that the bonds shall not be
for a term longer than ten years,
that the amount shall be limited to
the amount needed for each street

improvement, that they shall be used
only for grading, paving and repair
ing streets, and that they must not
be issued unless the improvements,
covered by tnem are desired by the
owners of more than 50 per cent of
the property abutting on the streets
; affected. “Baby bonds” are to bear
i six per cent interest.
School Tax.
An amendment of great value to
! the rural schools of the state requires
1 county authorities on recommenda
■ tion of the school board to levy a
local school tax of not less than one
| mill and not more than five mills.
At present there is not requirement
(that any school tax shall be levied.
. It also permits independent school
; systems and municipalities to levy an
; additional five mills.
Another school amendment per
mits the state government' to appro
i priate money for the maintenance
of high school. This has been done
for years and the amendment mere
ly gives it constitutional authority.”
Confederate veterans and their
widows who did not obtain pensions
under the act of 1918 are given an
other chance by an amendment au
thorizing pensions to all veterans of
their widows, who were residents of
this state on January 1, 1920. Wid
ows to receive pensions must have
been married before January 1, 1881.
The city of West Point is authoriz
ed to increase its bonded indebted
ness $750,000 above the present con
stitutional limitation in order to con
struct levees for protection against
floods in another amendment to the
constitution and the last on the list
increases the salaries of judges of
the supreme court and court of ap
peals from $5,000 to $7,000, and su
perior court judges from $4,000 to
$5,000. Counties are permitted to
add to the salaries of their superior
circuit judges if they desire.
