above referred to should fall due
without payment that the grantee or
his assigns may treat the entire
debt thereby secured as due for all
purposes whatever. The entire debt
due by virtue of said notes has been
declared due by the undersigned as
provided by the terms and condi
tions of said deed to secure debt and
there will be due on the total amount
of said notes, including principal and
interest as of the date of the sale,
the sum of Two Thousand Eight
and 60-100 ($2008.66) Dollars, bc
sdies expenses, costs and ten per cent
attorney’s fees in connection with an
incident so this sale, secured by said
deed to secure debt.
On the 2nd day of February, 1922,
the said H. R. Jphnson endorsed the
above described notes, also all his
rights, title, interest and equity, in
cluding the land, power of attorney
and rights under the same in and
to the deed to secure debt above de
scribed to the undersigned. The as
signment of said deed to secure debt,
together with the above described
lands, the power of attorney and
rights under the same, was recorded
in the of ice of the Clerk of the Su
perior Court of Sumter County, Ga.,
on Februrary 2. 1922 in deed book
XX, page 495. The above described
notes, deed to secure debt, together
with the legal title to the land there
in described and all the right, title,
interest and powers therein contain
ed, including power of sale in said
deed to secure debt have been assign
ed and delegated to and are now held
and owned by the undersigned. All
the terms and conditions of said pow

The said Dorcas West is now dead

Constitution of the State of Georgia,
that is to say, to exempt any per
son, natural or artificial, a resident
of this State, who may build, equip,
establish or enlarge a plant for man
ufacture or processing of “cotton
wool, linen, silk, rubber, clay, wood,
metal, metallic or non-metallic, min
eral or combination of the same,
creamery or cheese plant, or for the
production or development of elec
tricity, as to such buildings, enlarge
ment or equipment, from all city ad
valorem taxes for a period of five
years from the date of the beginning
of the building. enlargement or
equipment of such plants.
If a majority of the electors .ot
ing in said election shall vote in fa-i
vor of said proposed tax exemption
the same shall go into effect.

Whereas on March 1, 1924, Jesse
Bryant Griffin and Charlie Dempsey
Griffjp conveyed to the undersigned
the hereinafter described tract or
parcel of land to secure a loan of
$3,500.00 made to them by the un
dersigned, evidenced by a series of
twenty one notes,, the first for
$183.75 and due December 1. >924
and each of the others for $330.38
and due one each year on the first
day of December, beginning 1925
and ending 1944; and
Whereas, in said security deed
they contracted and agreed that in
the event they should fail to pay all
taxes on said land when due, or
should fail to pay when due any of
said notes evidencing said indebted
ness, that then, in either event, the
whole of said indebtedness secured
thereby would become due and pay
able at the option of the undersign
ed, without notice; and
Whereas, said security deed fur
ther provides that in the event of
such default the undersigned is au
thorized and empowered, and is
imade and conAitated the attorney
in fact of the makers, to sell, at pub
lic outcry, at the usual f>lace for con
ducting sheriff’s sale, to the highest
bidder, for cash, said tract or parcel
of lane, and after advertising in the
paper in which sheriff’s advertise
ments are printed, the time, place
and terms of sale, once a week for
four weeks preceding the time ap
pointed for such sale, at which sale
the undersigned may be the purchas
er, and to make the purchaser at
such sale a good and sufficient deed
in fee simple to the real estate so
cold, thereby diverting out of said
makers all right or equity of re
demption in and to said real estate;
said security deed being recorded in
the office of the Clerk of the Super
ior Court of Sumter County, Geor
gia, in deed book No. 2, page 323-25
to which reference is made and the
same is made apart hereof; and,
Whereas, said Jesse B. Griffin and
Charlie D. Griffin failed and neg
lected to pay the State and County
taxes on said land for the year 1924,
and the undersigned has been re
quired to pay the same in order to
prevent the levy upon and sale of
said land there fore,and also failed
neglected and refused to pay the
first of said series of notes for
$183.75 due December 1, 1924, and
by reason thereof the undersigned
elected to exercise said option and
declared the whole of the aforesaid
indebtedness due and payable and
said Jesse B. and Charlie D. Griffin
having failed and neglected to pay
the undersigned did publish in the
Americus Times-Recorder, of Amer
icus, Sumter County. Georgia, (be
ing the paper in which the Sheriff’s
advertisements in and for said coun
ty. are printed) on Friday Septem
ber 11th. 18th and 25th and Friday
October 2nd, 1925 an advertise
ment or notice reciting the facts and
defaults above stated, and that the
undersigned would sell at public out
cry, within the legal hours of sale,
on the first Tuesday in October,
1925, before the court house door
at Americus. Sumter County, Geor
gia, to the highest bidder for cash
the said tract or parcel of land, as
hereinafter described; and
Whereas, in conformity with the
terms of said advertisement and the
powers contained in said security
deed, the undersigned did, on the
first Tuesday in October, 1925 (Oc
tober 6th 1925), put up and expose
said tract or parcel of land to sale,
at public outcry, within the legal
hours of sale, before the court house
door in Americus, Sumter County,
Georgia, to the highest bidder for
cash, when and where R. L. Griffin,
of Sumter County, Georgia, was the
highest and best bidder, and for sum
of $4,500.00, and said tract or par
cel of land was then and there sold
and knocked off to said R. L. Grif
fin at and for said sum of $4,500.00;
and.
Whereas, although the undersign
ed was ready, able and willing to
make to said R. L. Griffin a good
and sufficient deed in fee simple to
said tract or parcel of land, in con

bid by him, the said K. L. Griffin,
when requested so to do, failed and.
refused, and does now fail and re
fuse to comply with the terms of
said sale by the payment of said
