This to allow of their passage at this session. TWITTY BILL RECONSIDERED. In the Senate the much-talked-of Twltty bill was reconsidered. The vote on the motion to recon sider was 20 and 20. President Mitchell broke the tie by voting for reconsideration. That probably carries the meas ure over to the next session, and is generally regarded as a triumph for the opponents of the bill. JUDGE FORT'S APPOINTMENT. The appointment of Judge Allen Fort was confirmed to-day, unani mously. The appointment is one' of tt^e most popular made by the governor, and gives universal satisfaction. THE BRANCH COLLEGES. Then the branch college fight was taken up in the Senate. The matter was referred last night, it will be remembered, back to the finance committee. They reported this morning in favor of the “old five” only, outting off all the new proposed branch colleges. Dablonega, *3,000; Mllledgeville, *2,000; Thomasville, *2,000; Cuth- bert, *2,000; Hamilton, *2,000. This amendment, by President Mltehell, was adopted: Provided, That none of said branch colleges under any pretext whatever, whether as tuition, ma triculation fee, incidental expenses or otherwise, shall chaTge exceed ing the sum of ten dollars (*10) pec year or five dollars per term for eaoh pupil; provided further, that any of said branch colleges charg ing an amount in excess of amount above provided for shall forfeit the whole amount of the appropriation for the year in whloh said excess of charges shall be made, and the Governor shall withhold his war rant '*upon the treasury for the same. THE “TECH" SOLID. Then came a fight on the Tech nological sohool appropriation of *22,500, led by Senator Irvine, of the 42nd. He wanted it reduced to *18,000, figuring It out upon the cost per capita of patients'ac the in- sane asylum, and the academies for the blind and for the deaf and dumb. benator Terrell, Senator Beck and others, spoke for the larger ap propriation. Irvine’s amendment wae lost, and the section as it stands was then adopted, appropriating *22,- 500. FINISHED IT UP. The appropriation bill was then finished without amendment as It came from the committee—practl cally, Just as It eame from the house, except the branch college feature—and the bill was passed, 38 to 0. It was then immediately transmitted to the house. THE STATE ROAD. Western and Atlantic Com mlttee has been hard at work all day, and have reached a conclusion which they think will meet the ap proval of the House. While there were many different views when the committee first discussed the question they got together to-day and there is only one dissenting vote to the committee finding, that Mr. Berner. The report of the committee in creases the numbers of the com mission to eight; requires six to de cide any of the discussed questions, and In their report are required to Btate the law upon which they vase tbelr decisions. The Governor has to approve the findings of the commissioners be fore they become final. He has power to call upon the Supreme court for decisions on questions of law for bis own aid, or for the com' mlssioners. TWO GET BAIL. AND THE BOND IS FIXED AT $15,000. Robert Howard Will Btay in Jall-But Bichard Howard and Jsmes Bicker- staff Will Be Let Out On Bond—Judge Fort’* Beclaion In Full. In Re Richard Howard, James Bickerstaff, Robert Howard, Judge Fort rendered his decision yesterday, In the Howards—Biokerstaff case. Where tbs attorneys of these men bad applied for bail. The habeas corpus proceedings occupied the cou: L i ■ ** first days of this week, full procecUiurs being published in The Recorder. The testimony In the case was voluminous, and three excellent speeches were made on each side. The case was concluded Wednes day, but Judge Fort reserved his decision. He has had a difficult job, studying tbecase, taking every point in the testimony and weigh ing it carefully. Besides having the testimony redd aloud in the courtroom, he has read it entirely through again twice, and as there are several hundred pages, it may be seen how tedious this was. Yesterday, he wrote out his de cision and sent it to Columbus. A bond of *15,000 eachwill be allowed Richard Howard and James Blck erstaff. / Robert Howard is not al lowed bail. Petition for Habeas Cor J )ub to be al owed ball un der commit ment for mur der from Mus cogee county, After considering the evidence submitted and the able arguments of learned counsel for the pAtiti- tloners and Btate, I am of the opin' Ion that in the ease of Robert How ard, ball should not be allowed. -In the ease of James Bickeritafi ball should be allowed In the sum of (*15,000) fifteen thousand dollars, In the case of Richard Howard bail should .’be allowed In the sum of (*15,000) fifteen thousand dollars It Is thereupon ordered that Robt. Howard be remanded to Muscogee Jail, there to be safely kept without bail or mainprize until his first trial under the charge as set forth in the petition: That James Blck erstaff and -Richard Howard be re manded to Muscogee Jail, there to be safely kept until final trial under said charge of njurder In default of good and sufficient bonds for each In the sum of (*16,000) fifteen thousand dollars each. Said bonds are to be in the usual form of ap pearance bonds, and' are to be ap proved by the Sheriff of Muscogee county. The manifest impropriety of en terlng into a full discussion of the facts and reasons for this decision in advance of a trial before the jury prevents a more extended opinion. This conclusion reached from the evidence submit ted on this hearing. What other evidence may be adduced on the final trial is not anticipated and cannot be here considered. Columbus, Ga., Deo. 20.—U isder Judge Fort’s decision Richard Howard and James Biokerstaff were released on bond of fifteen thousand dollars each.
