Roth of these bills were tiled yesterday afternoon. And they pray that John Ryan, John F. Ryan, H. R. Clatlin A Co., Walter R. Brown and A. II. Cox be made parties defendant to the petitions. One petition is filed by Hathaway, Toule S’ Herrington, of Boston, and the claims are sworn to by an agent of the firm. The petition avers that Stephen A. Ryan is indebted to them in the sum of $7,000. That for some time oast lie had been buying large consignments of goods and selling them below cost; that his cash collections amounted to six and eight thousand dollars a day; that ho sold silks worth $4.50 per yard for 50 cents, shoes worth $7.50 for $2.50, hats worth $2 for 50 cents, and clothes worth $50 a suit for $7.50. His collections were immense, it is claimed, and notwithstanding this there are unsecured’Labilities of his amount ing to more than $500,003. The petition further avers that Ryan eceived good* up to the very day he failed, and that the Central railroad of ficials state that they were compelled to deliver his goods first to keep from crowding their warehouses. The petition asks that the deed made to John F. Ryan by Stephen A. Ryan of a half interest in the store building on Whitehall street be set aside. It states that the building is worth $250,000, and a half interest worth $125,- 030: that Stephen A. Ryan was said to have bought out the part of John F Ryan in the business, but that John and John F. Ryan held the same relations toward it now as before. It further avers that all the time that these goods were being sold below cost, John and John F. Ryan were cognizant of the facts and were aiding Stephen A. Ryan in getting credit by indorsements and otherwise from the creditors. That said acts were a fraud upon the petition ers and other creditors. That John and John F. Ryan held a mortgage of $117,003 on the stock and were aiding Stephen A. Ryan to sell be low cost. The petition avers that Ryan has been solvent for some time, and that the ra re the purchase of goods by him was aud, and that the title to them has never passed. That he had no Intention of paying for the said goods at the time of purchase and that John and John F. Ryan were aware of this fact. Ryan has stated that the I CO MPAXY, Americus, Ga. business would be opened in a few days. 1 That the money collected has not gone to creditors, and that there is no Insur ance upon the large stock of goods, which should be cared for ami properly kept. A temporary receiver is therefore prayed for. Judge Marshall J. Clarke will hear the petitions for a receiver Saturday morning. Other petitions, asking for a receiver, have been filed during the day. One filed this afternoon was so long that Judge Clarke adjourned court in order to have time to complete the read ing of it. The preferred creditors will fight the appointment of a receiver. In Johnson county the people don’t know whether Mrs. Albert Evans, a popular young woman, who was found dead in a ravine, was murdered or com mitted suicide. Dks Moines, May 20.—The American Express robbery at Carroll on Saturday night lias taken a decidedly sensational turn. Clerk Matthews, wlio was found tied and gagged, lias confessed to com plicity in the crime. He says the robbery was planned by himself, Craig, Xiswonger, and Ansou Seliarnwebcr, two young men of Carroll. He went with Superintendent Garner, of Omaha, to an old vacant house, west of town, and hauled out from concealment $3,400, which lacked only $6.09 of the amount stolen.
