An Indefinite Postponement Did the Work «nd the Hill Which Called for Railroad Legislation In Behalf of the People Failed to Become a Law. Atlanta, October 9.—This morning long before the senate was called to order, the young army of railroad lobby ists were actively engaged button-1 BU p er j or cour t, convicted and sentenced holoingsenators and flitting from ono, the pon |t e ntiary for life. The Hum .t Hen. I Atlanta, October 10.—In the trial of 'James Wigginglun and others now pending in llic United Sl-ites court for conspiracy, known as the "Honest man's protector trial," it i&likely that all will be convicted except one. Of the nlno on trial two plead guilty, and it is almost certain that six will be convicted, and Mr Fields go free, 1,0- cause the evidence is not strong enough to involve him in the conspiracy. Besides the nine now on trial, seven were tried for arson in Pickens county part of the capital to the other. The occasion of all this buzzing and whispering was that at 10 o’clock the senate was to decide the fate of the Ber ner bill, or rather the substitute for that bill, reported by the committee on railroads. The substitute is a somewhat milder bill than the Berner bill, but not such a measure as the railroads desire. When the senate was called to order that body went right to business, and after a little skirmishing for position the substitute was read, as well aB the mi nority report. Mr. Callaway from the 17th district led off in argument in favor of the pass age of the Smith substitute, followed by Senators Terrell and Ellington. The yeas and nays were called, result ing in a vote of 20 yeas and 15 nays to indclinitcly postpone, which, of course, defeats the hill. Thoso who voted against the bill are Mossrs. Beard, Cabaniss, Candler, Flint, Gill, Glenn, Golden, Harlan, Harp, Hodges, Culpepper, Johnston, Lamb, Mullis, Patton, Smith, E. It., Vincent, Walker, Williams, Zackoy—Total 20. Thoso who voted for tho bill arc Messrs. Beck, ltoyd, Calloway, Culver, Eason, Ellington, Hill, Irvino, Johnson, McKae, Nunnally, Terrell, Todd, Warren and Witcher—Total 15. Thoso not voting aro Messrs. Bennett, Brown, Tatum, Strickland, Smith, J. D., and Lamar—Total 7, The house was, on motion, notified of the action of the senato at once. AN ATTACK Is Made on tho Now Constitution of Kentucky. Locisviixb, Oct. 10.—A special from Frankfort states that a suit was filed there which is aimed at the existence of tlie new constitution whicli lias just been completed. The suit is brought by Walter Evans, ex-commissioner of internal revenue, and who is supposed to represent the Louisville and Nash ville railroad, which was bitterly op posed to the new constitution. The point attempted to be made is tlmt af ter tlie conelitntion was ratified by the people last August, tlie convention made more than 100 changes in the in strument, and tlmt therelore the pres ent constitution lias never lieen ratified, and is mill and void. An injunction is asked restraining the public pri iter from printing this constitution and the secretary of state from promulgating it. as the organic law of the state; and it is prayed that the document which pur ports to be the new constitution, be brought into court and destroyed. Le gal opinion is very much divided, but a majority believe that the new constitu tion will stand. Narrow Escape From Heath Guekncabtlk, Ind., Oct. 10.—Three ladiee crossing the Big Four railway, west of the city, had a narrow escape from instant death. The crossing is a dangerous one, the view being obstruct ed by a deep cut, and the ladies on reaching it encountered a freight train bound west, with four cool cars in front of the engine. Their buggy was struck by the coal cars and all three of the in mates more or less injared. Miss Wil lie Wood sustained Bevere injuries, but no hones were broken; Miss Jennie Van Buskirk was cut in the side of her head and badly bruised otherwise; Mrs. Eliz abeth Welch, of York, Neb., sustained a broken ankle and other severe bruises, her Injuries being the most serious. The horse was killed after being carried by tho train a distance of over 500 feet. Hnrdalcy Makes Good Doses. He lives in tho hoiie of a pardon through political influence after a few years' Confinement. III. 100th Birthday. Fitzwilliam, N. IL, Oct. 10.—The Hon. A. A. Purker has celebrated bis }00th birthday. He graduated from the University of Vermont in 1815, and is said to be the oldest living college graduate in America. He practiced law for years, was intimate with Dan iel Webster, and has served iu the leg islature more terms than any other member. As a colonel in the governor's staff iu 1820 he ucted as escort to Gen eral LaFayetto. Mr. Parker still retains possession of his faculties. She Won •22,000. Mt. Stebuno, Ky., Oct. 10.—The now celebrated case of Mrs. Sarah Ham ilton against George Hamilton, in which she seeks to recover t22.000.0G0 dna her from ths old Hamilton estate, was decided in common pleas court bare, Judgment being rendered her for toe amount. Hon. Carter Tate, an ex-member of the house of representatives and one of the most popular men in Georgia, prose cuted these men in the Pickens county superior court, being the leading coun sel, and is also the leading counsel in tho case now pending before the United United states. H:s success in convicting such a large body of law-breakers after a great deal of opposition by able lawers, is verv gratifying to his frienns and proves Colonel Tate Just what tlioy have always known him to he, an able lawyer as well as a popular and accomplished gentle man. The case of tlie honest man's friends was given to the jury this afternoon, —id a verdict will probably he returned be- foro night. Meeting of the Commissioners. Office county commissioners of Sumter county, October 5, 1S91. The commissioners of roads and revenue of Sumter county have this day levied a tax of forty-nine and two tenths cents upon one hundred dollars of tax able property of the county for the cur rent year. The same being one hundred and sixty-one and one-third per cent, upon the state assessment. Sixty-one and one-third per cent being for building a new jail, and one hundred per cent being for current expenses of the countv, apportioned as follows: Fund So. i, general Indebtedness 3 0 Fund No. 2, court house.
