premo court has tiled a decision cover
ing an important question. It is whether
if a person loses his or her life through
the negligence of any person or corpora
tion, and that person is a non producer,

Eastern Capitalists to Put In Plant

Birmingham, Ala., April 21.—A deal
has been closed* with eastern parties
whose names have not been disclosed,
for the erection of a $100,000 plow fac
tory here. The promoters are practical
plow manufacturers and are said to bo
backed by ample capital. The factory
will use steel from the new mill at Eas
ley.
The new $2,<X)0,00I) wire rod and nail
mill of the Alabama Wire and Steel
company at Ensley made its first ship
ment of steel wire nails yesterday. The
shipment consisted of 52 kegs and was
consigned to a Birmingham hardware
house which is acting as the mill’s dis
tributer. The company has orders on
hand to keep it running many months
MAN HUNT WAS CALLED OFF

Richmond, April 21.—Tho man hunt
arranged by the members of tho Deep
Run Hunt club, which has attracted so
much attention throughout tho country,
has been called off. This was done by
Dr. Joseph A. White, president of tho
hunt club, because of the general mis
conception as to the Character of tho
proposed hunt.
Many letters and telegrams from prom
inent people, especially in tho north,
were received protesting against blood
hounds being allowed to chase a man.
The hounds, it is stated, are not danger
ous, and even had they taken Davis, ho
would have becu in no danger.

Dublin, Ga., April 21.—Dim Pullen,
the 13-year-old son of Mrs. Annie Pul
len of this city, has mysteriously disap
peared and no trace of him can bo ob
tained. He left home Monday morning
to go to school. He did not return homo
in the afternoon, and his mother grow
ing alarmed, instituted search for him.
It was learmal that the boy, instead of
going to school, had been seen walking
m the direction of tho Oconee river with
a gun on his shoulder.
It is thought that he went into the
river swamp and accidentally shot him
self, or that he has only run away from
home and is trying to conceal his where
abouts from his family.
Sensational Scene In Court.
Charleston, April 21.—There was a
highly sensational scene in tho eonrt of
common pleas between Mr. J. W. Barn
well and Mr. George S. T^egare, and an
exchange of blows was looked for. Tho
difference between Mr. l»garo and Mr.
Barnwell grew’ out of u motion for a
new trial in the case of Mrs. Mary K.
Appleby versus the South Carolina and
Georgia road. The case was heard be
fore a jury a few days since and a ver
dict for #10,000 damage's was awurded
her.
Keee!ver Applied For.
Chicago, April 21.—John C. Gibbs,
D. L. Staples and E. 1*. Ferguson of
Chicago, William Whalen of Eureku,
Nev., George William Lightou, Walter
Jewett and others of Grand Kapids,
Mich., have tiled suit in the circuit court
asking that a receiver bo apiM tinted for
the Whalen Consolidate Copper Min
ing company. Tin* company's capital
stock is $2,500,000. Plaintiffs allege con
spiracy to discredit the company and de
press the value of its stock.
Admits Identity; Denies Guilt.
Kansas City, April 21.—“Jim” Red
mond, alias Miko Seville, arrested iu
Manila two months ago on a charge of
having murdered Emma Schumacher
here, in 1897, and who was brought here
last night from San Francisco, admits
his identity but denies tho murder. Rod-
mond has been chas«*d all over the coun
try. He served through the Cuban war
with the rough riders and was a mem
ber of the Sixth artillery iu the Philip
pines when arrested.
Swimming Record Broken.
San Francisco, April 21. —Sidney
Cavil has lowered tho American swim
ming record of 1:07:2-5 for 100 yards,
held by Renoar in Chicago, Ly covering'
the same distance in l.*02£f. Percy
Cavil, a brother of Sidney, made a quar
ter of a mile in 5:57:l-5, over a half min
ute better than tho American record.
Gainesville's New Mill Assured.
Gainesville, Ga., April 21.—It ap
pears certain that the Woodsido cotton
mill will bo erected in Gainesville.
Already $180,000 of tho necessary $200,-
1000 has been subscribed, and it is be
lieved that the remaining £.*0,000 will
be secured. Committees are now at
ork to get tip the remainder.

trouble between the United Staten and
the Turkish government attracts pass
ing comment in England, though the
average newspaper reader is much more
interested in tho Croton dam riot.
In connection with the former subject
the Birmingham Post is responsible for
the statement that Turkey has placed
several important commissions with tho
Krnpps, to be completed before the end
of the year, which include better ma
chine guns than are at present used by
any European power and 100,000 Mau
sers, which, immediately upon their re
ceipt, will bo delivered to tho Turkish
First army corps.
BUBONIC PLAGUE IN MANILA.
Recent Cases Are Traced to the Mur-
ket—Deaths to Date.
Manila, April 21.—'Die sudden deaths
of Filipinos and Chinamen in Quiapo
market havo led to an investigation
showing that 15 cases of the plague, 14
of wdich were fatal, have occurred
within a week. Tho maket is located
in'the center of the city. In black, rot
ten, wooden buildings the keepers of tho
stalls live with their families huddled
together iu great filth. Some of tho
victims were stricken and died within
an hour.
There have been several deaths in
other sections of the city recently, which
havo been traced to the infection from
the market.

PROGRESS OF COLSON TRIAL eases.
Parker Gives Damaging Testimony
Against Accused. j
Frankfort, Ky., April 20.—Joseph C..
Parker of Mercer county was the first J
witness introduced today in the trial of
Colson. He related the conversation
that occurred between Scott aud Golden
a short while before the shooting. Wil
liam Smoot of Franklin overheard Scotl
and Golden in front of the Capitol hotel
just a few minutes before the tragedy.
He heard Scott say to Golden:
This trouble has been brewing long
enough and has got to end now,*’ to
which Golden replied, “Whatever you
do, don’t let him get the drop on you.”
After this Smoot saw them enter the
Capitol hotel.
Kit Chinn, son of Colonel Jack Chiuu
and a well kuown horseman and starter,
said when Golden and Scott were stand
ing by the cigar case Golden, after look*
iug around the lobby, whispered to
Staff#, wlio in turn whispered to Golden.
Max Hasberry of Twiggs county and
Max Rodin of Midway both testified
that Scott fired the first shot.

raonwealth's Attorney Franklin in *h«
circuit court this morning asked that
Henry E. Youtzey, one of the men in
dicted as principal iu the assassination
of Governor Goebel, be arraigned im
mediately. The court ordered Youtzey
brought into the courtroom. The in
dictment was read to Youtzey, who
pleaded not guilty. Tho hearing wai
set for Monday, April 30.

Frankfort, Ky.,' April 20.—When the
orders of the court were read this morn
ing »ll names announced ns having been
indicted yesterday the name of Governor
W. 8. Taylor was not mentioned.

them asking tho secretary of war

were receiving salaries for the perform
ance of civil duties in uddition to their
regular pay, aud the other inquiring
alxmt the expenditure for rent of offices,
the equipments and all similar expenses.
Mr. Bacon said the first resolution ww
introduced in response to a challenge
made hv Mr. Chandler. He hail no spe
cific information on the subject, and
indeed, bail received assurance that no
such extra salaries were paid.

Nashville, April 20.—When the Re
publican state convention re-assembled
today, the committee oil credentials an
nounced that its report had not been
completed. The convention took »
recess for a short time, to await the re-
ported protest against the exclusion
from the convention hull of delegates
whose seats were contested was made by
the Evans side. The Evans men in the
Republican state convention bolted, and
will hold a convention in another hall.
There is nothing a man does so un
willingly as to acknowledge himself
in the wrong.
