Urged Wiyiess Not to Go oil Stand.
Georgetown, Ky., July 17.—The
Powers case was started off with a long
legal debate before the court on the
question of the admissability of matters
transpiring between the date of the
shooting of Senator Goebel and his
death. The point was raised by a ques
tion put by the prosecutioq to Witness
Culton regarding a conversation be
tween him and Youtzey before Goebel
died. The court ruled that this evidence
must be excluded.
Oultou resumed the stand. In regard
to the preparations for bringing the big
crowd of mountaineers to Frankfort,
witness said Powers told those in tho
conference that in the event of any
trouble growing out of the importation
of the men the leaders would be in
dicted for conspiracy and asked if they
were willing to take the risk. In the
discussion of the question of transporta
tion witness said Henry Painter, a Mid-
dlesboro railroad lawyer, suggested that
trains be captured on several roads.
After the assassination Powers came
to witness and told him to write to tho
parties who were in conference and tell
them they had better be very careful
and do no talking, as they were liable to
be connected with the murder. Wit
ness told him it would be dangerous to
write, nnrl Powers said he would do it
himself. The prosecution produced a
box of cartridges for witness to inspet
He said the cartridges were like those
Youtzey showed him when talking
about killing Goebel.
Pegged to Keep OITthe Stand.
Powers gave witness badges for the
mountain men who remained at Frank
fort. They were issued so that in case
of trouble they could distinguish their
own men from others. The badges con
tained a picture of Governor Taylor.
Witness said tha: while in jail with
Powers at Frankfort Powers begged
him not to go on the witness stand in
the hearing of his (Cultou’s) motion of
People Think Supervisor Plans' Esti
mate of 52,000 Is Too Low.
Savannah, July 20.—There are many
persons in Savannah who believe that
the estimate of Census Supervisor Henry
Blun,^r., that the population of this
city will not go beyond 52,000, accord
ing to the census of 1900, is fur too low.
The residents, for tho most part, had
been building their hopes on from 60,000
to 05,000.
Mayor Meyers believed that the city
would make a much better showing.
He looked for something over 60,000,
and a party of Savannahiaus who hap
pened to bo in the mayor’s office a few
weeks uto guossed at tho census aud
placed the figures in a sealed envelope,
and when tho envelope was opened it
did not contain a guess of less thau 65,*
000.
Alderman James M. Dixon says it is
all rot to say that Savannah has no more
than 52,000 people.

There was question about the legality of
some claims allowed in my depart

Mr. Owens asked a number of ques
tions to show that the testimony given
by Cultou was at variance on some
points with that given in his application
for bail at Frankfort.

Augusta, Ga., July 20.—Augusta’s
population is less thau 40,000. This is a
disappointment to mauy, as it was gen-
erally believed it would be about DO,000.
It is stated upon good authority that the
total population of the five wards com-
posing tho city is between 80,000 und
87,000. This is about io per cent in
crease, tho figures of 1890 showing 83,-
800. Ten per ceut increase will make
the total 30,330, which is approximately
correct. Captain Srnytho states that
while Augusta’s increase has been
small, that of the suburbs has been phe
nomenal, Summerville showing au in
crease of 400 per cent. ✓

They Fought Desperately and Were
First to Enter the Native City.

Che Foo, July 19, via Shanghai, July
21.—The attack on the uativo city of
Tien Tain on July 13 resulted In the nar
rowest escape from what seemed up to
midnight would be a terrible disaster for
the allies. The Russians swung north
and tho other allies south. At daybreak
the Russians were to take tho forts near
the native city wall and the other allies
tbe city itself.
General Fukusliina, the Japanese
commander, promised that tho Japanese
engineers, after three hours’ shell fire
from all guns, would cross tbe bridge
over the moat before the wall, and,
blowing up the great south gate, make
a breach for the infantry to enter.
Upon this depended everything. Gen
eral Fukusliiun had uot scouted-the
bridge and in 24 hours had not scoated
the pound over which tho charge on
the bridge had to be made.
The Chinese destroyed the bridge and
flooded tho lund around it. Tho allies’
shell fire in no wise subdued the Chinese
rifle fire from tho loop-holed wall, which
was TO feet high and almost 20 feet in
depth around it. An outer wall of mud
made It Impossible for the infantry and
marines ooining on the field to reply to
tbe Chinese fire. They lost 50 mon in
ten minutes, then rushed lack from the
mud wall, which they bad reached.
General Dorward, tho British com
mander, hastened forward with a frag
mentary instead of an Integral skirmish
line.
Tho American marines and the Welsh
fusiliers, together under* command of
Waller, were on the extreme left. Then
the British marines and the French ad
vanced with tho Japanese along the road
toward the gate in the mud wall.
Dorward Blames Llscum.
Doward’s plan for the Americans to
support the Japanese was not made clear
to Colonel Llscum of tho Ninth United
States infantry.
Dorward lays the blame for the blun
der and sacrifice of lifo on Llscum, but
Dorword's chief of stuff was heard to
say whon Llscum moved:
“Get in down the rood anywhere,
quickly.”
Colouel Lisoum hurriedly led his inen

At 1 o'clock General Fokushina re
ported In writing to Dorward that tho
Japanese were in the city. The loop-

face of this fire from 2 o'clock until 5.
Though acting conjointly, neither Dor
ward nor Funkushina knew eaoh others’
whereabouts.
Under cover of the darkness the men
of the Ninth crept book from their dan
gerous positions, bearing their wounded.
They executed
this movement with a
loss of one man killed.
The casualties were 91 meu and, 5
officers out of 426.
The marines lost 80, including Captain
Davis, who was shot through the heart,
while talking to Colonel Meade on tho
talking
night of July 13.
