A caae now celebrated in story if not
in *ong, the Americus police commis
sion muddle, which his passed through
the legislature, the ballot box, the su
perior court and been the theme of a
thousand animated disenasions, is to
bo passed upon todsy-fioally-by the
highest tribunal in the state.
Today the supreme court will look
into the merits of this cause celebrae
and determine wbioh of the police
boards ahall prevail.
And the people of Americas will re
joice that the end ia reached.
Yesterday, local ooonsel repreientiog
the two polioe boards, the old and the
new, were notified that the caae would
be reached this morning. Messrs W.
A. Dodson and J antes Taylor, for the
new board, and Messrs W. T. Lane
and L.^J, Blalock for the present com
mission, left at ones for Atlanta.
These able attorneys will argoe the
merits of the case from their teepee-
five standpoint*, and the result, sev
eral days heuer, will be awaited here
with muob interest.
Many, fine legal points are involved in
the police commission esse.
After the Legislature amended the
oily charter of Americas, making the
polioe commissioners eleotive by the
bualifled voters, an election was held
for four member i. Three of those con
stituting the new board woro elected,
while for fourth plaoe a tie resalted.
The new board organized, aftor some
time, with Mayor Hawktna a member
by virtue of his oflloe.
Bat the old board declined to yield,
alleging various irregularities and the
farther fact tbat they conld not bo tbna
deposed daring the term for which
they had been eleoted.
Qno warranto proceedings were in
stituted in the superior court, and upon
the decision of Jndgo Littlejohn the
now board aopeaied the case to, the
snpremo coart. There it has since
rested, pending argument today. The
fight has been a long one, and it ii
hoped that the end Is near at hand.
No matter what the decision of the
supremo court, even, the polioe com
mission case is more than likely to bob
npegainat the Jaao session of the
Legislature.
