WHERe LAW IS MADE PLAIN.
AMERICUS. GA., DEC. 21, 1906
The President has aright to be
nervous and restless,with ail those
messages in his system.
No difference if 43,300 pension
era of the Civil war died last year
"fill npthe ranks” is the cry,
The vist of old Boreas has been
delayed, bat the Indications are
that he is going to makeup time.
The most serious mistake Joe
Bailey made after borrowing that
money was in ever paying it back.
Americas is ready with a smile
for Santa, and will then get bnsy
npon the new year with every con
Aden coin her future.
The fact that Atlanta has put
her military npon a riot basis is
not dne to tbe expected visit of
Aunt Carrie Nation next week.
Ben Tillman is said to earn more
hard money every year than any
platform lecturer. His receipts
this year are said to exceed $25,-
006.
The emancipation of the dealer
in holiday goods is at hand. Only
fonr more days of Christmas shop
ping.
In a general way a belief pre
vails in this state that a debt dne
brokers on deals in cotton or grain
futures or in stocks purchased,
margins cannot be collected be
cause they are gambling transac
tions. Judge Speer delivered
charge to a jury in Valdosta tbe
other day that made tbe law clear.
The plaintiff was a cotton broke
rage firm of New York, holding
seat in the Cotton Bxchange of
that city, and the defendants were
citizens of Tifton, in this state,
The amonnt sued for was more
than $10,000 for services, commis
sionsand money paid oat.
It seems that where there is an
understanding by both parties that
there is to be no delivery of tbe
thing purchased the transaction is
simple gambling, and there can be
no recovery of a debt growing out
of the transaction by either party,
It devolves on the defendant, how'
ever, to show that there was soch
an understanding by both parties
If there is an understanding by
CENTRAL OF GEORGIA
one of tbe parties that there is to
be a delivery of tbe thing pur
chased, and not by tbe other, tbe
transaction is taken out of the field
of gambling and a suit can be
maintained. In every case, how
ever it devolves, npon the defen
dant to show there was to be no
delivery if the defense is that the
contract was nnlawfnl because of
Its gambling character. It is
apparent that that la a pretty
bard thing to do, because it seldom
happens that either party takes
the trouble to discover the inten
tion of tbe other in margin trans
actions.
In the case against the Tifton
defendants tbe plaintiff recovered
j ndgment—Savannah News.
If the Storers have not yet com'
pleted their list of good resolutions
for the new year there are- lots of
people who would be willing to
make a few timely recommenda
tions concerning diplomacy and
the buzz saw.

Atlanta "views with alarm” the
coming of Annt Carrie Nation. If
there is not trouble enough over in
Biotbnrg already she will very
soon hatchet.
Americus will get tbe Govern'
meat building, of coarse, despite
the prediction of the grouches,
prosperity haters and habitual
town knockers. %
"What tbe Prisidint is doin’
these days,” to quote Mr. Dooley’s
simplified spelling, is a-plenty.
Hardly a day passes without a
blast from hia bugle horn.
A New York .gas company that
went into court to prove the new
80-cent state law confiscatory has
ran up against expert testimony
showing the cost of making gas to
be 28 cents per 1000 feet.
