Quite recently a well known citizen of Americus resented the whipping of a little child by its negro nurse and administered a thrashing to the wo man, which so aroused her ire that a court case against the gentlemen was Instituted. Judge Crisp and a jury will pass upon the merits of the case tomorrow. This trial will be of especial Interest to citizens of Ameri cus generally, and the hearing will be largely attended by friends of the defendant, who have warmly applaud ed his action In the premises. A large number of ladles, residents of the locality in which the whipping was administered, and who witnessed the affair, have been summoned to the courthouse as witnesses, and their appearance will add interest to the proceedings, unusual ns it Is already. Inasmuch as these ladies are compell ed to attend court as witnesses Judge Crisp has assigned this "cause cele- brie" for trial on Monday afternoon. It will be the case of absorbing In terest of the entire week, and the courtroom will doubtless be thronged with Interested spectators tomorrow afternoon. Mr. Benjamin Grantham, residing several miles west of Americus, met with a very serious and severe acci dent yesterday while driving home from the gin with a bale of cotton. The wagon was upset and Mr. Gran tham thrown out, (he cotton bale falling upon him and breaking both legs. Mr. Grantham was conveyed to his home where a physician at tended him. Both fractures are very serious and, on account of Mr. Grant ham's age, being near seventy, his condition Is quite serious. CASE IS SETTLED BY PAYMENT OF $6,000 Compromise is Reached in Law Suit. It is understood that a satisfactory basis of compromise was reached yesterday In the Blrd-Broadhurstcase by the payment of $G,000 by Mr. R. 8. Broadhurst, defendant, In pro ceedings Instituted some time since by Miss Carrie P. Bird. The plain tiff sought to recover from Mr. Broad hurst, who was custodian of the property of her Bister, Mrs. Emma Bird Doughtie, the sum of $8,000 al leged to be due the estate of the de ceased. The case was tried at the May term of Sumter superior court and judgment awarded the plaintiff for tho amount sued for, with Inter est. Mr. Broadhurst appealed the case to the supreme court, but, pend ing an early hearing before that tri bunal, a settlement was effected yes terday, as stated. LOOSE LEAF LEDGERS. Oct 19.— (Special)—West Virginia has filed Supremo court an answer to the bill of complaint filed against It by Vir ginia, In which the latter seeks have West Virginia to assume a share of the debt previous to the forming of the State of West Virginia. John G. Carlisle former secretary of treasury, is of counsel for the defen dant. In the suit Is Involved an import ant question of the relations of two sovereign states, as well as some $15,090,000. In the demurrer the State of West Virginia denied that the jurisdiction of the United States Supreme Court could be extended to the case Insti tuted by Virginia, because, It was claimed, the Supreme Court could not enforce a judgment for money against one of the sorerign States of the Union In any way or manner, was also contended that Virginia had no suable Interest In the demands for money made. These and other grounds upon which the demurrer was made were answered by the Vir ginia attorneys, and the court Issued an order requiring West Virginia answer the bill of complaint origin ally filed by Virginia. Virginia Misused Money. In her answer West Virginia ad mits that the money appropriated and the payment of the annually ac cruing interest on the debt prior to 1861 and the formation of the sinking fund for the ultimate redemption of the debt was derived from taxes Im posed upon property subject to tax ation throughout the entire State, but avers that the large amount thus de rived, to which the present Stnto of West Virginia, then a part of Vir ginia, contributed her full share, was not kept Intact by Virginia after her ordinance of secession, but was used by ber "In the administration of the so-called State government at Rich mond and for many other purposes while she claimed to be a part of the Confederate States of America and that part of the sinking fund so ex pended should be accounted for” to West Virginia and constitute a credit to her In the settlement of her equi table proportion of the debt.
