FIRST
That we desire to form a corpora
tion for the purpose of carrying
file business of banking.
SECOND
The name and style of the proposed
.orporation shall be the Commercial
Cite Bank.
THIRD
The location and principal place of
business shall be in the City of Amer
icas, Sumter County, Ga.
FOURTH
The amount of capital stock Is

Five hundred shares of one hundred
dollars each.
FIFTH.
The purposes and nature of the
business of the proposed corporation
Shall be that of a bank, with continu
ous succession for the term of thirty
vears, with the right of renewal for

To have and use a common seal, and
: t pleasure to alter the same. To
appoint such officers and agents as
the business of the corporation re
quires, prescribe their duties, fix
their compensation, and remove them
at pleasure. To make such by-laws
a s may be necessary or proper for the
management of its property and regu
lation of its affairs. To hold, pur
chase, dispose of and convey such
real and personal property'as may J>e
necessary for its uses and business.
To discount bills, notes or other evi
dences of debt; to receive and pay
out deposits, with or without inter
est; to receive on special deposit mon
ey or bullion or foreign coins, or
stocks or bonds or other securities;
to buy or sell foreign or domestic
exchange, or other negotiable paper
to lend money upon personal security,
or upon pledges of bonds, slocks
negotiable securities; to take and
receive as security by mortgage, or
otherwise, on property, real or per
sonal; and generally to do and per
form all such other matters and
things not hereinbefore enumerated
as are or may be incident to the bus!
ness of banking.
We herewith enclose the charter
fee of Fifty Dollars, and pray to be
incorporated under the laws of this
State.

Twenty-seventh, District of Sumter
County, Georgia, except Five acres
In the Southeast corner thereof,
which composed the plantation upon
which the said A. S. Perry resided at
the date of his death, as well as at
the date of the execution of his said
Will.
THIRD—That all the debts of the
said deceased have been paid and his
said estate administered as directed
in said Will, that petitioner as Guar
dian for said Virginia and Mary Liz
zie and the said Mrs. Mattie Perry
are in possession of £aid described
property by virtue of the assent of the
Executors of said Will, the said Mrs,
Mattie Perry being the mother and
step-mother of said Virginia and
Mary Lizzie, wards of petitioner.
FOURTH—That petitioner
Guardian and the said Mrs. Mattie
Perry In her own right has been of
fered a fair price for said property
and the said Mrs. Mattie Perry pur
poses to sell at said price her un
divided one-third interest in said
lands, that said lands are not now
yielding to petitioner, as Guardian,
anything like a fair and reasonable
income on the price that has been
offered for the tivo-thirds Interest in
said lands owned by said minors, that
the same is incapable of division in
kind and to partition said land by
reason of its location, etc., would
make each parcel much less valuable
than Its portion of the purchase price
of the whole would amount to.
FIFTH—Petitioner desires' and
prays leave to sell the said two-
thirds interest in said real estate
so belonging to each of said wards
at private sale and to re-invest the
proceeds of said sale in Bank Stock
of the Bank of Southwestern Georgia
at par, or otherwise as may be sug
gested or directed by this Honorable
Court; and that notice of tills, his
intention to make application, has
been published once a week for Four
weeks in the Americus Weekly Times-
Recordcr, a newspaper, being the
newspaper in which the County ad
vertisements for said County are
now published as required by law.

Before me personally appeared the
undersigned petitioners, who on oath
depose and says that fifteen thousand
dollars of the capital subscribed
the Commercial City Bank for which
bank deponents are now seeking in
corporation by the Secretary of
State has actually been paid In by

October, 1879, for a period of 20
years, with the privilege of renewal,
and was immediately thereafter or

principal office In Americus, Georgia,
and has ever since existed as such,
exercising all the rights, privileges
and powers of a Library corporation.
3. Petitioners show that they de
sire that said corporation be revived
for the same purpose as originally
chartered, with- all the rights, privl
leges and powers of the former char
ter, as provided by law.
Petitioners further show that
Mr. Andrew Carnegie, of the City of
New York, has agreed to give to skid
Association, upon certain conditions,
the sum df ($20,000,) Twenty Thou'
sand Dollars, and In recognition ot
his beneficence Petitioners desire to
change the name of said Association
from “Americus Library Association"
to "Carnegie Library Association."
WHEREFORE Petitioners pray:
(a) That the former charter of the
Americus Library Association be re
vived, and
(b) That the name of the “Ameri
cus Library Association” be changed
to "Carnegie Library Association,”
and that said association, under the
name ot “Carnegie Library Associa
tion" do have and enjoy all the rights,
privileges, powers and Immunities of
Its charter heretofore granted by this
honorable Court.

tract from the Minutes of Sumter
Superior Court and the Charter Rec
ord of Sumter County.
Given under my hand and seal this,
"Georgia had the only real dele
gntion from the South.” said Mr,
Wheatley yesterday. “The others were
tagged. We were against Bryan. As
soon as our position was known,
delegates from Maine to California
came to see us and begged us to try
to hold back Bryan from winning on
the first ballot. They declared that
they would come over on the second
ballot, after they had carried out their
instructions by giving Bryan their
votes on the first. But the thing was
too heavily loaded.
"When the mob broke loose at the
Bryan demonstration New York and
Georgia sat together, and refused to
join. When they saw we could not
be moved, they tried to climb over
us. We got up to prevent being walk
ed over. They then tried to take the
standard, hut about a dozen of
surrounded It and held them at bay
hv force.
Insult for Georgia
“Then it was that Georgia received
the insult of the band striking
“.Marching Through Georgia.” That
was the most gratuitous Indignity that
could have been heaped upon the Em
plre State of the South.
"Some of the delegations were sur
prised Hint Hoke Smith had not sent
a Bryan delegation, but were Informed
that Mr. Smith did not name the Geor
gia delegation this time.

“The Bryan vote was not unani
mous, the negative vote never being
called for. H. H. Elders of Tatnall
when he saw that he would not get
a chance to vote In the usual way,
mounted a chair and clamored to be
allowed to have his vote recorded in
the negative. Our vote was 20 for
Gray, two for Johnson, and 4 for
Bryan. The unit rule was adopted at
first, but was later rescinded In or
der to allow the Bryan men a chance
to record their vote.
"In regard to the nomination of the
Vice-President, Clark Howell's name
was not withdrawn. Col. Meldrlm was
urged to do so, and finally he made a
speech In which his voice trembled
with emotion. He declared that he
was much moved when he saw the
standard of Texas pass In the Bryan
train, when he remembered that
Georgians had fought and died
free that state. .When he saw the
banner of South Carolina pass by he
recalled how Georgia had followed
that state In seceding, but when
Sherman marched to the sea Sopth
Carolina was nowhere to be seen.
Only One Consolation
"The only consolation for the great
majority of the Georgia delegation
was that If Bryan is defeated this
time, It will be the end of his domi
nation. The convention was run by
long distance telephone from Nebras
ka, It might be remarked In passing.
“The lesson Impressed upon me
by the convention was that it Is time
tor the South to get together. Caucus
before going to a convention and
agree on a candidate, not necessarily
from the South. Then the South
would have some weight. As It Is
now, some upstart state like Oklahoma
will easily lead the Southern States
around by the. nose.”
Though Mr. Wheatley was made a
member of the notification committee
to let the Presidential nominee know
of his success, he resigned and Col.
Lindsay Johnson of Rome, was named
in his place.
From Denver Mr. Wheatley went to
St. Paul to attend the Shrlners’ gath
ering. He reports a big time, with
the most lavish hospitality he ever
enjoyed. Gov. Johnson gave a recep
tion at the state capitol. Mr. Wheat-
ley said that many Republicans told
him they always voted for Gov. John-
sou. and would have voted for him
for President.
