Thursday handed down a decision to
the Philo S. Bennett will case, in which

sible beneficiary to the extent of $

left by Mr. Bennett, and finds no error
The de ision upholds 'the superior
court which rendered judgment to the
effect that the clause in Mr. Bennett’s
v-il. containing the paragraph In re¬
gard to the $50,000 to be left to Mr.
Bryant Is inoperative, and that the
said fund is a part of the residuary
estate.
Mr. Bryan appealed from this decis¬
ion. Clause 12 of the will leaves $50,*
000 to Mrs. Bennett in trust with no
purpose, while the sealed letter says
that the money is left, to William J.
Bryan The supreme court holds that
the superior court is right in deciding
that the clause is inoperative.
The decision ends one of the most

was a close friend of Mr. Bennett,

ernorship and retaining Adams in the
chair was announced Wednesday by

vote directly to scat Adams. According
to the claims of the Adams people,
they have .secured the signatures of
twenty-two republican members of the
legislature to an agreement to vote
down all three reports from the con¬
test committee. With the thirty-one
democrats, who it is said, will act with
the republicans above mentioned, the
result will be a majority of four. By
defeating all three reports the effect

. The revolt of the nurses at Grady
hospital in Atlanta against their SU¬
perintendent came to a climax Wednes¬
day morning when the resignation of
Miss McGroarty, the superintendent of
nurses, was accepted, and the twelve
nurses who had sent in their resig¬
nation* were dismissed from the ser¬
vice.
An additional sensat rial feature of
the affair is given in a public state¬
ment signed with the name of F. Lew
is Eskridge, the hospital druggist, but
which, on the admission of Eskridge,
v*as written by other parties. The
statement, in part, is as follows:
"To the Public: This morning mark¬
ed an episode in the annals of the
Grady hospital which will never be
forgotten as long as the institution
survives. Twelve young ladies of the
best families of this and other south¬
ern cities were curtly dismissed from
the training school of the institution
without so much as a hearing by the
president of the board of trustees,
whose duties, according to the rules
of the institution, in no way pertain
to the training school for nurses.
"These southern, Christian girls
have been bulldozed and browbeaten
for the past eighteen months by a
Isdy from New York, unfortunately
procured by this institution as the
superintendent of nurses. These nurses
were subjected to such indignity by
the lady from New York that their
lives were no longer bearable.
“Since the organization of the train¬
ing school, it has been the custom of
the nurses to meet each and
invoke the aid of the Almighty GoJ
to guide their lives and work through
the following day. This custom the sm
perintendent abolished immediately.
“These same young ladies, when,
forsooth, their work did not please
the lady from New York, were sub¬
jected to haranguing, and words used
which would have done credit to a
guard of a convict camp, and at times
before tile very negroes whom they
wore nursing. Negroes who stood in
with the superintendent were given
every consideration, while the nurses
who displeased her in any way were
punished slowly, but surely, in ways
that made life miserable.
“It is within tlie province of the
medical board to regulate all matters
pertaining to the training school of
this institution, but they seem to have
been a minus entity. The backbone
of the board seems to have undergone
gelatinous degeneratitoi, and t-litu rear
of the president of the board of trus¬
tees is something pathetic. It is hard¬
ly conceivable how southern men could
stand by and see southern girls sub¬
jected to such indignities by the pres¬
ident of the board .of trustees, whose
interest seems to have been more cen¬
tered in the lady from New York
than in the training school and the
nurses therein.
"Mr. Hirseh’s interests in the pres¬
ent superintendent is very unusual, and
i: is pitiable that lie should have
the wool so pulled over his eyes by
a woman from beyond the Mason and
Dixon line as to forget himself so far
and put out on the world twelve girls
who had chosen the calling of nursing
ns a life work, and many of whom had
spent months of hard wtork in their

gress which called on President Roose
velt Wednesday to consider with him
plans for the betterment of the con
dition cf the negro race in this coue
try. In an address delivered to the
president, Bishop Grant said that they

constituency of negroes of different
churches and other organizations to
thank him for the “splendid position”

men, regardless of color, creed, section

Informally, the delegation suggested
to the president the subject of the re¬
duction of the representation in con¬
gress from those states which discrim¬
inate politically against negroes, but
the members of the delegation declin¬
ed to discuss the feature of the call.
President Roosevelt did not indicate
to the committee what action he
might take regarding its request for
the appointment of a commission,
promising simply to give the subject
consideration.

in court at Cleveland Wednesday and

came to see them about it, all they
had to do was to say that they had

ENORMOUS FEES FOR LAWYERS.
Three Attorneys for Indians Awarded Sum
of $750,000 Through Act of Congress.
The secretary of the treasury has
issued a warrant for $750,000 in favor
of Mansfield, McMurray and Cornish,
lawyers residing in the Indian Terri
tory, as fees for services rendered by
them to the Choctaw and Chickasaw
Indians. The secretary of the inte¬
rior declined to approve the claim on
the ground that it is excessive. Con
gress. however, directed the payment
on the showing that it was regular and
in accordance with the contract with
the Indians.
