At McDonough before Justices Per¬
ry and Daniel, Bob Cockran, Clove
Sutton and Holing Hall were bound
over to the state court on the charge i
of murder, l.orena Hinton was bound !
over on a misdemeanor charge ana ;
was committed to jail. Barney Cald
well and Will Sue will be tried imme¬
diately. Pink Simmons was given :

Cannot Change Itinerary.
Mavord Woodward of Atlanta has
received a letter from William Loeb,
Jr., secretary to President Roosevelt,
in reply to his letter of the 24th, in
which Mr. Loeb thanks Mayor Wood¬
ward, on behalf of the president
his courteous interest in
Roosevelt's visit, but. states that it
will be impracticable for the presiden:
to change his itinerary so as to make
a longer stay in Atlanta on his trip
south next fall.
Mayor Woodward wrote to inquire
if it could not be arranged for the
president to spend two days or at
least one whole day in Atlanta, giving
the people a better chance to meed
him, but as the itinerary had already
been arranged, Secretary Lfaeb wrote
that it would he impossible for the
president to remain longer in the city
than at first contemplated.
Lively Contest Over New Counties.
The tight for new counties is or
in deadly earnest. Xo less than a doz
en delegations have already establish¬
ed their headquarters in Atlanta,and
are already busy pouring their ar¬
guments in favor of their proposed
new counties into the ears of listen
j ing members of the legislature.
There is every indication that the
new county situation is going to con
j sume a large part of the time and
j attention of the general assembly.
The people who want new counties
j and those who do not want them
are not going to let the legislature
rest until something is done.
There is considerable talk among
the members of making only three
or four new counties at this session,
where they are most needed, but let¬
ting the other places remain vacant
t»til further growth and development
shall demonstrate where they ought
10 be established. The new county
delegations are pulling all sorts of po¬
litical wires.
Packing House Ta x Sustained.
Clerk Arnold Broyles, of the Ful¬
ton superior court, at Atlanta, has
received from the state supreme
court official notification that the
United States supreme court had de¬
cided the case of F. E. fuehrer against
A. P. Stewart, tax collector of Fulton
county, in favor of the tax collector.
This case was decided several month.*
ago and the taxes -it*’ . hut
' *jfiFi been iec:vek.
i’hls was the famous packing house
case. The state levied a tax of $200
upon every packing house doing busi¬
ness in g orgia, this tax to be paid in
every county in which Ihe packing
houses did business. The packing
houses having offices in Atlanta paid
the tax under protest and appealed
the case to the supreme court, where
it was decided in favor of the state.
It then went to the supreme court,
and (he opinion of the United States
supreme court, and the opinion of the
Georgia supreme court was sustained,
