Failed to Have Plea in Abatement
Sustained and Must Pight Case
in the Court.
At Chicago > Friday, Federal Judge
Otis J. Humphrey sustained the de¬
murrer filed by Unite! States District
Attorney Morrison to the plea in
abatement made by packers to have
indictments for alleged restraint de¬
clared void. Judge Humphrey said he
made his decision on broad grounds
without taking into consideration
technicalities which the government
advanced against the plea la abate¬
ment.
It is likely that the jury for the
trial will lie drawn about the middle
of October.
After the decision had been given
the defending attorneys tried to
amend the fourth plea by the inser¬
tion of the word "for." This met
with resistance from the district at¬
torney, hut the court promised that
if the law was clear on the point he
would allow it. The government is
said to fear a trick in the insertion
of the one word. The district attor¬
ney moved that the defendants plead
to the indictment.
One of the points in the pleading
■which attracted considerable atten¬
tion and which the court declared had
given him some difficulty was in re¬
gard to the right of Judge It. if.
Bethea to teceivo the return of the
Indictment. It was argued by the de¬
fense that he was sitting in the east
ern division of the northern district
of Illinois and received an indictment
voted in tiie northern division of the
northern district of i/ilnols.
The district attorney declared that

return of the indictment. The court

In State of Georgia Fixed by Board of
Arbitration.
Two hoards of arbitration made
their report® Friday to the comptrol¬
ler general of Georgia, fixing the val¬
uations upon which the Southern rail¬
way and the Seaboard Air Line will
hare to pay taxes on their property
In the state for 1908.
As a result of tlies* arbitrations tluj
Southern railway will pay taxes on
$1,454,843 more than in 1904, while
the increase in the Seaboard’s valua¬
tion over 1904, including tho Geor¬
gia portion of its new lino to Bir¬
mingham, is only $470,151.
While tho Southern has secured a
reduction in its assessment of $1,038,
O 00 and the Seaboard wae put down
$1,792,000, the Atlantic Coast Line,
which was the first arbitrated, had the
comptroller general’s assessment sus¬
tained and must pay taxes on over
$2,000,000 more than in 1904.
Tho board of arbitrators in tho case
of the Seaboard Air Line fixed tho
value of that company’s tangible
property in Georgia at $7,956,500 and
franchise at $1,500,000, a total of $9,-
456,560.
From this finding Railroad Commis¬
sioner Warner Hill, representing the
•state, dissents most emphatically and
is preparing a dissenting opinion in
which he states his views. He will
bring out tho fact that a representative
of the railroad company swore in the
United States court last November
that the Seaboard’s property In Geor¬
gia was worth $30,108,000. Mr. HU1
says he cannot see how a property
can be worth such an amount ns this
for the punxwe of ‘paying interest and \
dividends, when it Is worth only a
little more than seven millions for the
purpose of taxation.

the Victims of Dastardly Murder Laid to
Rest Toqethcr.
The bodies of Mrs. A. J. Condit. her
13-year-old daughter and her sons,
aged 6 , 8 and 10 , respectively, who
were murdered near Edna, Texas, by
a negro, were interred in a siugle
grave.
The discovery of a bloody adz with
which the crime was committed and
a bundle of discarded clothing found
by bloodhounds a short distance from
the scene of the tragedy are the only
clues left oy the murderer. However,
