Washington, D- C, Dee. 26th—
Th railway legislation is ex¬
po* ,ed to come up in congress
soon after the holidays. Several
bills have been introduced in
the House and in the Sonate and
there will be hundreds of amend¬
ments.
Much comment has been caused
by the fact that tho Inter-State
Commerce Commission has had
one bill introduced and Pres¬
ident Roosevelt had another.The
two bills are very different and it
is clear that the President and
the Commission are not pulling
quite together. The President’s
measure is the more conserva¬
tive of the two
The great struggle will come
over two pintH in the President’s
bill, which was introduced by
Senator Dolliver of Iowa.
First: A fight will be made
on giving the Commission power
to fix rates and
Second: The plan to have the
rates named by the commission
go into effect before they are re¬
viewed by the courts, will be
stoutly opposed.
Many people believe that tho
roads would accept a bill allow¬
ing them to be triod before being
sentenced. They will insist On
having the trial come before the
hanging and as this prineipile is
reognized in alt other cases,
criminal and civil, they stand
some chance of carrying this
point. They alac want the law
to provide that the questious of
both law and fact shail bo sub¬
ject to review by the courts.
They claim this as an alienable
right, declaring further that as
the commission has lost nine
of every ten cases carried
into tho courts, the board is lia
mistakes of judg
ment.
The Commissioner does not
want any eourt to review ques¬
tions of fact involved after if
decidosa case.
