Project Description
The work consists of furnishing all plant,
labor, equipment and materials and
performing all work in strict accordance with
the specifications located within the 1993
Edition of the State of Georgia Standard
Specifications, Sections 400, 412 and 413 and
all supplemental specifications thereto for:
0.436 miles of 2” of 12.5 mm asphalt
paving on a primed surface on CR 224
(Monument Rd.) beginning at SR 136
extending to existing Monument Road.
Important Notice to Bidders
Totals read at the opening of bids are not
guaranteed to be correct and no final award of
contract will be made until the bid and any
extensions have been verified.
A 100% performance bond will be required
of the contractor at time of contract execution.
The bonding company must have a Georgia
Resident Agent.
The contractor awarded the contract
agrees to complete all work under the contract
on or before June 15, 2004, and agrees to
complete all work within THIRTY calendar
days from the issuance of the notice to
proceed, excluding rain days. A beginning
date of work will be mandatory from the
contractor and rain days will apply only on
days of actual rain. Liquidated damages for
the delay in completion will be $200 per day.
Payment for the project will be made within
thirty (30) days of the completion of all work

F. Guymon and Charlie Sue Guymon to MIT
Lending, dated April 13, 2001, recorded in
Deed Book 401, Page 383, Pickens County,
Georgia Records, conveying the after-
described property to secure a Note in the
original principal amount of Eighty-Nine
Thousand Three Hundred and 0/100 Dollars
($89,300.00), with interest thereon as set forth
therein, there will be sold at public outcry to

contained in the Deed to Secure Debt from J.
Charles Edwards and Deborah Edwards to
Jasper Banking Company dated January 21,
1999 and recorded in Deed Book 321, Page
540, in the offices of the Clerk of the Superior
Court of Pickens County, Georgia (the
"Security Deed"); and pursuant to that certain
Order Dismissing Case with Prejudice enter
March 2, 2004 in that certain Chapter 13 Case
No. 03-22751-REB, filed in the United States
Bankruptcy Court Northern District of Georgia,
Gainesville Division; the undersigned will sell
at public outcry to the highest and best bidder
for cash before the door of the Courthouse of
Pickens County, Georgia, during the legal
hours of sale, on the first Tuesday in May

other indebtedness.
Default has occurred and continues under
the terms of the Note and Security Deed by
reason of, among other possible events of
default, the nonpayment when due of the
indebtedness evidenced by the Note and
secured by the Security Deed and the failure
to comply with the terms and conditions of the
Note and Security Deed. By reason of this
default, the Security Deed has been declared
foreclosable according to its terms.
The above-described real property will be
sold to the highest and best bidder for cash as
the property of J. Charles Edwards and
Deborah Edwards, the proceeds to be applied
to the payment of said indebtedness,
attorneys' fees, and the lawful expenses of
said sale, all as provided in the Note and
