The Ten Commandments
and American Law
By Bob Self
Pastor, Living Word Church
Part 2 of 4
The fourth commandment calls
for us to remember the Sabbath day
and to keep it holy. America’s his
tory with the fourth commandment
includes:
The fourth commandment was
adopted by most of the colonies as
law including Virginia in 1610,
New Haven in 1653, New Hamp
shire in 1680, Pennsylvania in
1682, South Carolina in 1712 and
Connecticut in 1751. In 1775 and
through the Revolutionary War,
Commander-in-chief George Wash
ington issued orders that the Sab
bath be observed.
During the Federal era of the
1700’s there is a long list of state
enactments of laws to uphold the
Sabbath. Some of these are quite
explicit in their requirements. Our
Constitution even recognizes the
Christian Sabbath, Article 1, Sec
tion 7, Paragraph 2: “If any bill
shall not be returned by the Presi
dent within ten days (Sundays
excepted) after it shall have been
presented to him....’’
The Supreme Court, in 1961,
ruled Sunday closing laws were
constitutional and said these laws
originate from the fourth com
mandment stating: “This divine
pronouncement became part of the
Common Law inherited by the thir
teen American colonies and by the
sovereign State of the American
union.”
The fifth commandment
requires us to honor our fathers
and mothers. Many people may be
surprised to find American history
so filled with the fifth command
ment.
A 1642 Connecticut law cited
the fifth commandment as the basis
for their law: “If any child or chil
dren above the age of sixteen years
old, and of sufficient understand
ing shall curse or smite their nor
mal father or mother, he or she
shall be put to death.” The
Louisiana Court of Appeals
referred to the Ten Commandments
and made reference to the fifth
commandment, “...is as much a
command of the municipal law as
it is a part of the Decalogue...”
There are numerous colonial
codes and later court cases making
reference to the fifth command
ment. There are a great number of
documents by our founders which
refer to the appropriateness of the
fifth commandment.
The sixth commandment directs
us not to kill. You would be hard
pressed to find someone that does
not believe this has been a part of
American Law from the beginning
of this nation. To cite the times this
commandment has been incorpo
rated into civil law from colonial
days through to the present would
be somewhat exhaustive.
The seventh commandment is
the one that forbids the committing
of adultery. There are several defi
nitions trying to specify exactly
what is adultery and what is not.
However, the majority of the views
do at least accept adultery as sexual
relations between a married person
and someone other than their
spouse. American history with
regards to the seventh command
ment is almost as exhaustive as it is
with the sixth.
Most of the colonial laws for
bidding sex between a married per
son and someone other than their
spouse called for the death penalty.
Most of the state constitutions have
an article against adultery with a
range of specified punishments;
some of which including the dis
qualification from voting by a con
victed adulterer.
