National Day of Prayer to be observed on courthouse lawn Thursday
Thursday, May 6, 2004 will be
the 53rd Annual National Day of
Prayer. This years theme is Let
Freedom Ring. The theme scripture
for 2004 is Leviticus 25:10, “...pro
claim liberty throughout this land
and to all its inhabitants.’’
The National Day of Prayer has
been an annual event, a time for our
nation to stop and pray for God’s
help in guiding our nation through
its path. There will be services
throughout the nation on this day,
including a prayer luncheon in
Washington attended by members of
Congress and the President. All 50
state governors have signed procla
mations honoring the National Day
of Prayer as well as most local offi
cials. It is a time when peoples of
various faiths come together and
draw on our common faith for our
nation and her needs.
The Pickens County Ministerial
Association will be sponsoring a
prayer service May 6 at noon on the
front steps of the Pickens County
Courthouse. Participants from sev
eral local churches will be taking
part in the service. They will take
turns praying for our national gov
ernment and leaders, state and local
governments and leaders, our
troops, our schools and our families.
The public is encouraged to meet at
the courthouse and take part in this
service

Imagine that tomor
row you suddenly
become severely ill or
incapacitated. Who
would take care of
your finances? How
would they do it? If
you don’t have a
durable power of
attorney, others—even
your spouse—may not
be able to conduct all
your financial needs on your behalf.
A power of attorney is a legal
document authorizing another per
son (an agent) or financial institu
tion to step in on your behalf to
execute certain financial transac
tions should you be unable to do so.
The transactions might be as basic
as paying bills and handling insur
ance claims or as complex as sell
ing real estate and filing a tax
return. Without a power of attorney,
your spouse, children or friends will
probably have to petition the court
to step in on your behalf—a cum
bersome, time-consuming and
potentially expensive process at a
time of immediate need and emo
tional stress.
Just about any adult, young or
old, single or married, should have
a power of attorney. Yes, even mar
ried. While your spouse can proba
bly take care of the basic bill pay
ing, many financial transactions
such as the sale of an investment or
home require both spouses’ signa
tures. You may have some assets in
your name only, so that your spouse
has no access to those assets should
they be needed—such as to pay the
medical expenses due to the disabil
ity that’s preventing you from han
dling your own finances.
Some types of powers of attor
ney are convenience documents
used for a specific transaction or to
manage finances for a limited time
while one is away. There’s also a
durable power of attorney for med
ical care, which appoints someone
to make medical decisions on your
behalf should you be incapacitated.
This should be a separate docu
ment.
The financial power of attorney
most financial planners recommend
is a durable power of attorney. This
goes into effect upon signing and
remains in effect through any inca
pacity and until your death, unless
your revoke it. This power of attor
ney typically allows the agent to
perform a broad range of financial
transactions on behalf of the person.
Because a durable power of
attorney allows the agent (or a suc
cessor agent, if needed) to step in
immediately, some people try to
limit the power by not allowing the
document to “spring” into effect
until they are actually incapacitated.
Many estate planning experts dis
like this approach, however, argu
ing that its implementation could be
delayed unnecessarily because
determining incapacity is often an
inexact science. If you don’t trust
the person in the first place, they
argue, you should find another
agent.
Have an attorney draft the power
of attorney. It costs more than buy
ing a standardized version, but to be
fully effective it needs to meet state
laws, which vary from state to state.
The document also will likely
require specific language not found
in off-the-shelf documents.
Experts commonly recommend
that the document grant powers as
broad as possible so the agent has
maximum flexibility. It’s difficult to
anticipate what might need to be
done financially on your behalf.
Beyond granting broad powers,
the document will need to be spe
cific about certain rights granted to
the agent. For example, the IRS has
ruled that the grantor must explicit
ly give an agent the right to make
gifts on behalf of the grantor in
order for those gifts to qualify as
gifts for estate tax purposes. You
must specify the right for your
agent to complete and sign your tax
returns, exercise stock options or
sue a third party.
At the same time, you
may want to incorporate
certain restrictions in the
document, such as how
your retirement plan
accounts are drawn down
or under what conditions
an asset might be bought
or sold. Perhaps you want
to require a second signa
ture on checks above a
certain amount.
As with all estate plan
ning documents, a power
of attorney should be
reviewed and updated
periodically so that it reflects your
needs and desires. You’ll likely
need to revoke and draft a new
power of attorney should you
divorce or your financial circum
stances change significantly.

Jasper residents Melinda Lee and
Sandy Carol Bell are very enthusias
tic about their new “positions” as
volunteers at the Swan Center. Here,
at this serene country sanctuary for
abused and neglected horses, they
get to be a part of helping with the
multitude of every day chores.
Mucking (cleaning the stables), fill
ing the horses’ water buckets,
sweeping the barn area and feeding
the goats and sheep are some of the
“activities” they are involved in at
the Center.
“Most enjoyable,” however, says
Melinda and Sandy, “is brushing and
massaging the horses. One can sense
the gratitude of the horses as they
feel the gentle brushing soothing
their bodies.”
The Swan Center is a beautiful
150-acre expanse of nature where 40
horses and ponies, dogs and cats,
pigs, goats, sheep and ferrets (did
we leave anyone out?) can live with
out any further harm ever being
inflicted on them.
Horseback riding, as well as les
sons and camps, are available under
the caring supervision of trained and
experienced individuals.
The Center is in need of volun
teers in a number of aspects. Dona
tions are also needed and gratefully
appreciated. Sponsoring animals is
another way to help with the costs of
feeding and caring for the animals.
