NOTICE OF SALE UNDER POWER
Under and by virtue of the Power of Sale
contained in that certain Residential Deed to
Secure Debt and Security Agreement dated
June 19, 2002, executed by W. Allen Owens
(hereinafter referred to as "Grantor") in favor
of Jimmy H. Clackum (hereinafter referred to
as “Grantee"), being recorded August 9, 2002
at Deed Book 469, Page 209, Pickens
County, Georgia Records (hereinafter referred
to as the “Security Deed”), Grantee attorney-
in-fact for Grantor will sell at public outcry to
the highest bidder for cash, between the legal
hours of sale before the door of the
Courthouse at Pickens County, Georgia, on
the first Tuesday in June 2004, to-wit:
All that tract or parcel of land lying and
being in Land Lot 138 of the 13th District, 2nd
Section, Pickens County, Georgia, being Lot
26-D of Mt. Sequoyah Subdivision, as per plat
recorded in Plat Book Q, Page 198, Pickens
County, Georgia Records, which plat is
incorporated herein and made a part of hereof
by reference.
TOGETHER WITH THE FOLLOWING
WITH RESPECT TO THE ABOVE
DESCRIBED PROPERTY:
(a) All improvements now or hereinafter
erected on the property.
(b) All easements, rights, appurtenances,
rents, royalties, mineral, oil and gas rights and
profits, water, water rights and water stock,
now or hereafter appertaining to the property.
(c) All fixtures now or hereinafter attached
to the property, including all replacements and
additions thereto.
To the best knowledge and belief of the
undersigned, the foregoing described property
is presently in possession of the Grantor or
tenants holding under Grantor.
Said Security Deed secures a Note dated
June 19, 2002, in the original amount of
Twenty-Eight Thousand and no/100 Dollars
($28,000.00) executed by Grantor in favor of
Grantee (hereinafter referred to as the “Note.”)
On account of default under the terms
contained in the Note, the entire principal
amount, plus all accrued interest, has been
and is hereby declared due and payable and
by reason of said default, the said Security
Deed is hereby declared foreclosable
according to its terms, and the above
described property will be therefore sold at
public outcry pursuant to the terms of the
Power of Sale provided in the Security Deed,
for the purpose of satisfying the amount due
upon said Note secured by said Security Deed
as aforesaid.
The proceeds of said sale are to be applied
first to the expenses of such sale and of all
proceedings in connection therewith, including
attorneys’ fees as provided in the Deed to
Secure Debt; then to insurance premiums,
liens, assessments, taxes and charges,
including utility charges, advanced by
Grantee; then to accrued interest, then to
payment of the outstanding principal balance
of the indebtedness secured, as provided in
the Deed to Secure Debt; and any excess to
the person or persons legally entitled thereto.
The above described property shall be sold as
the property of Grantor, subject to:
a. all restrictions and easements of record,
and
b. any unpaid taxes or assessments
relating to said property.

Rights has been filed as to the minor child
born on March 1, 2003, filed by the Georgia
Department of Human Resources, acting
through the Pickens County Department of
Family and Children Services, on April 12,
2004, said petition seeking to terminate all of
your parental rights with respect to said child
and all rights and obligations of the said child
to you, including rights of inheritance. You
would not after said order be entitled to notice
of proceedings for the adoption of the child by
another person, nor have any right to object to
the adoption or otherwise participate in the
proceedings.
You are therefore given notice of said suit
and are directed to file any response within 60
days of the order for publication which was on
the 16th day of March 2004. You have a right

Superior Court, Pickens County, upon

County Department of Family and Children
Services.

hearing on the petition for termination of

a.m. at the Pickens County Courthouse.
You are entitled to counsel in these
proceedings and the Court will appoint
counsel if you are unable without financial
hardship to employ counsel.
Be advised that the biological father who is
not the legal father of these children shall lose
all rights to the children and shall not be
entitled to the termination of his rights to the
children unless within 30 days of receipt of
this notice he files (1) a petition to legitimate
the children pursuant to OCGA 19-7-22 and
(2) notice of the filing of the petition to
legitimate with the Pickens County Juvenile
Court.

contained in a Security Deed given by Grace
T. Troup and Joseph E. Troup to New Century
Mortgage Corporation, dated December 28,
2001, recorded in Deed Book 439, Page 363,
Pickens County, Georgia Records, as last
transferred to U.S. Bank N.A., as Trustee for
New Century Home Equity Loan Trust, Series
2002-A Asset Backed Pass-Through
Certificates Series 2002-A by assignment to
be recorded in the Office of the Clerk of
Superior Court of Pickens County, Georgia
Records, conveying the after-described
property to secure a Note in the original
principal amount of One Hundred Twenty-Five
Thousand Five Hundred and 0/100 Dollars
($125,500.00), with interest thereon as set
forth therein, there will be sold at public outcry
