Sale in a certain Deed to Secure Debt

Debt having been given to secure a
Promissory Note dated December 5,
2012, in the principal amount of

sale contained in the Security Deed dated
January 25, 2007 from TIM RAYNES AKA
TIM J. RAYNES and MINNIE RAYNES,
(Collectively "Grantor”), to JASPER
BANKING COMPANY, (“Grantee”)
recorded February 2, 2007 in Deed Book
756, Pages 285-292, Pickens County,
Georgia Superior Court Records;
Modification of Deed to Secure Debt
dated April 20, 2010 and recorded May 4,
2010 in Deed Book 893, Pages 278-279,
Pickens County, Georgia Superior Court
records and any and all extensions or
modifications thereof, (Collectively “Deed
to Secure Debt”) said Deed to Secure
Debt having been last assigned and con
veyed to Stearns Bank, N.A., as succes
sor in interest to Jasper Banking
Company, and pursuant to that certain
Purchase and Assumption Agreement
between the Federal Deposit Insurance
Corporation as Receiver of Jasper
Banking Company and Stearns Bank,
N.A., recorded on April 15, 2013 in Deed
Book 997 Pages 841-843, Pickens
County, Georgia Superior Court Records
said Deed to Secure Debt being given to
secure a Note, as may be modified and/or
amended from time to time, in the original
principal amount of Forty Two Thousand
and 00/100 Dollars ($42,000.00). There

Said Property commonly will be sold
together with any and all fixtures and per
sonal property, conveyed by said Deed to
Secure Debt.
The entire debt secured by said Deed
to Secure Debt has been and is hereby
declared due and payable because,
among other possible events of default, of
the Grantor's failure to pay monthly pay
ments when due. The debt remaining in
default, this sale will be made for the pur
pose of paying the same and all expenses
of this sale, including attorney's fees, as
provided in the Deed to Secure Debt, and
the balance, if any, will be distributed as
provided by law.
To the best of the undersigned's
knowledge and belief, the party in posses
sion of said Property is Grantor or tenants
claiming by, through or under Grantor.
Pursuant to O.C.G.A. §44-14-162.2,

of the individual or entity who shall have
the full authority to negotiate, amend or
modify all terms of the above described

nothing in O.C.G.A. §44-14-162.2 shall be
construed to require Stearns Bank, N.A. to
negotiate, amend or modify the terms of
the Deed to Secure Debt described here

The Property will be sold on an “as is,
where is” basis without recourse against
Lender and without representation or war
ranty of any kind or nature whatsoever by
Lender with respect thereto. Said
Property will be subject to any matters
which might be disclosed by an accurate
survey and inspection of the Property.
Said Property will be sold subject to any
outstanding ad valorem taxes and/or
assessments (including taxes which are a
lien but are not yet due and payable), pos
sible redemptive rights, and all liens,
encumbrances, zoning ordinances, ease
ments, restrictions, covenants and other
matters of record to which the Deed to
Secure Debt is junior and inferior in terms
of priority including senior encumbrances
that will not be extinguished by the fore
closure sale contemplated by this Notice.
The sale will be conducted subject (1)
to confirmation that the sale is not prohib
ited under the U.S. Bankruptcy Code and
(2) to final confirmation and audit of the
status of the loan with the holder of the
Deed to Secure Debt.
Pursuant to O.C.G.A. Section 9-13-
172.1, which allows for certain procedures
regarding the rescission of judicial and
nonjudicial sales in the state of Georgia,
the Deed Under Power and other foreclo
sure documents may not be provided until
final confirmation and audit of status of the
loan as provided in the preceding para
graph.
