Man arrested for stealing auto parts
tied to crimes in other counties

On Wednesday, April 14
at approximately 11:30 a.m.,
Pickens Sheriff’s Office
deputies responded to a sus
pected theft call at a local
business near Highway 53.
After arriving at A&T
Towing, deputies gathered
that while actively stealing
vehicle parts, the subject was
confronted by the business
owner and immediately fled
to the woods. The sheriff’s
office canine was deployed
and deputies began a search
of the area. Out of an abun
dance of caution, Pickens
High School was made aware
of the incident and placed on
a lock out at approximately
11:50 a.m., where students
continued about their day
normally within the school
but entry to the school was
restricted.
The initial search contin
ued for approximately two
hours without locating the
subject.
Around 7 p.m., deputies
located an individual match
ing the description of the sus
pect walking westbound on
Highway 108. The subject
was initially taken into cus
tody for outstanding warrants
in surrounding counties.
After being taken into cus
tody, he was positively iden
tified by the business owner
as being involved with the at
tempted thefts earlier that
day.
John Davison Rakestraw,
41, of Dallas, Ga. was
charged with Felony Entering
an Auto, Felony Possession
of Tools to Commit a Crime,
Felony Criminal Damage to
Property, Criminal Trespass,
and Misdemeanor Theft by
Taking.
The investigation deter
mined that Rakestraw does
not have any known ties to
Pickens County.

During this past week, the Pickens Sheriff's Office responded to or
initiated 1,208 calls for service. These numbers are taken from the
report provided directly from the 911 Center where all calls are
logged as they are performed. Below is a breakdown of all dispatched
calls by the call type for each incident.

dition to these, other calls include search warrants, civil service, 911
hang-up calls, assaults, disorderly persons, missing persons, assis
tance with medical calls, natural death investigations, demented per
sons, funeral escorts, harassment, trespassing, and many more.
New lights at Old Jail on Main Street
Members of the Pickens Historical Society tried out new
decorative lights at the Old Jail on Main Street last week,
showcasing the different color options. Plans call for them
being left a natural white most of the time with green for
home sporting events to support the Dragons. There was
some disagreement on whether they would go red for big
Bulldog games as at least one officer is a Georgia Tech fan.
The lights were funded in part by the regular ghost tours
at the jail. The tour operator Southern Ghost Girls will re
turn May 14th and 15th. See Old Jail in Jasper Facebook

Car dealer did not refund money
the car “on the spot.” How-
Dear Consumer Ed:
I put down money on a
leased vehicle. The bank did
not approve the loan request,
so I had to return the vehicle
to the dealership. But the
dealer is refusing to return
my money. Can they do that?
Consumer Ed says:
You likely entered into a
conditional sales agreement
known as a "spot delivery" or
“yo-yo” transaction, a com
mon industry practice. These
transactions can lead con
sumers to believe that a vehi
cle’s installment sale or lease
is final when the dealer gives
the consumer possession of
ever, with spot delivery, al
though you took possession
of the car, a lender had not
yet agreed to give you a loan.
You instead promised to
lease the car if a lender would
finance the deal according to
terms you negotiated with the
dealership. Ultimately, the
car belongs to the dealership
until a lender finances the
deal. Since the dealership
was not able to find a lender
to finance your deal, the
dealer will ask, as it appears
has already occurred here, for
you to return the vehicle.
Whether you get back
your money likely depends
on the terms described in the
paperwork you signed when
you took delivery of the car.
You probably signed a "Bail
ment Agreement," which al
lowed you to use the car and
which should have contained
an explanation of what hap
pens if the dealer is unable to
secure financing with a bank
or finance company. The
money you put down, such as
a down payment or deposit,
may be refundable, but the
language in the agreement
will provide better insight on
whether or not your money
will be returned and under
what conditions. For in
stance, some bailment agree
ments provide for rental rates
and usage charges to be de
ducted from any money you
put down.
However, even if the
money down is non-refund-
able, the dealer could still be
in violation of Georgia law if
it otherwise engaged in unfair
or deceptive conduct, such as
misrepresenting to you that
the deal was approved or
final when it was not. If you
believe that the dealership
engaged in unlawful prac
tices, you may file a com
plaint with the Georgia
Department of Law’s Con
sumer Protection Division at
consumer.ga.gov or by call
ing (404) 651-8600.
