Said Security Instruments
secure performance of the

$25,000.00; and (c) Note 13, in

Default(s) have occurred
under the terms and provisions
of the Security Deed and in the
payment of the debt evidenced
by the Note and secured under
the Security Instruments. As a
result of such default(s), the
total balance of said debt as evi
denced by the Note has been
and is hereby declared due and
the Security Deed foreclosable
according to its terms and appli
cable law. The debt remaining in
default, the Real Property will be
sold to the highest bidder for
cash as the property of Grantor,
the proceeds to be applied to
the payment of said indebted
ness, attorneys’ fees (notice of
intention to collect attorneys'
fees having been given), and
the lawful expenses of said sale,
all as provided in the Note and
the Security Deed and all other
related documents evidencing
indebtedness owed to Lender.
Said sale to be subject to any
and all unpaid taxes and as
sessments (including taxes
which are a lien, but not yet due
and payable), any matters which
would be disclosed by an accu
rate survey or by an inspection
of the Real Property, any zoning
ordinances, all outstanding bills
for public utilities which consti
tute liens upon the Real Prop
erty, any governmental rights of
redemption, and all restrictions,
easements, liens, security
deeds, security interests,
claims, and encumbrances of
record, if any, that are prior to
the Security Instruments and to
which the Security Instruments
are subject.
Further, the sale of the Per
sonal Property will be conducted
in accordance with O.C.G.A. §§
11-9-604(a)(2) and (b)(2) and
applicable law. The sale, if
made, will be to the highest and
best bidder. All persons attend
ing the sale will be given an op
portunity to bid on a competitive
basis. Lender may offer the Per
sonal Properly for sale, and may
sell the Personal Property, as a
unit or in parcels and by way of
one or more contracts. Lender
may adjourn and recommence
the sale of the Personal Prop
erty in its discretion within the
legal hours for a public sale
under the Uniform Commercial
Code of Georgia. The purchase
price for the Personal Property
will be paid in cash or at closing,
which will be at the conclusion
of all bidding, unless otherwise
agreed by Lender at the time of
sale. Lender reserves the right,
in its discretion, to reject any
and all bids and to submit a
credit bid or bids for any or all of
the Personal Property. After re
ceipt of bids for the Personal
Property in its entirety or a por
