A RESOLUTION by the City of
Nelson, Georgia, to dispose of
certain public utility property.
WHEREAS, the City of Nelson
(’’the City”) is a duly incorpo
rated municipality located in
Cherokee County, Georgia and
Pickens County, Georgia;
WHEREAS, pursuant to Sec
tion 6.32 of the Charter of the
City of Nelson, the City is au
thorized to convey real property
owned by the City as allowed
by law;
WHEREAS, pursuant to
O.C.G.A. § 36-37-7, the City is
authorized by law to dispose of
any City owned public utility
plants or properties on such
terms or conditions as the City
deems proper; and
WHEREAS, the City owns such
property that it wishes to dis
pose of, being a water tower
and surrounding property
shown as the portion of prop
erty located in Pickens County
on the plat attached hereto as
Exhibit “A”, also known as Pick
ens County tax parcel NE02
145 (’’the water tower prop
erty”);
NOW, THEREFORE, BE IT
RESOLVED as follows: (1) In
exchange for the grant of Per
manent Drainage Easements
from Rio Land & Investment
Co., Inc. necessary for the
City’s Kennesaw Avenue
Drainage Project, and in recog
nition of the Right of Way previ
ously granted by Evan Howell
for the City’s Kennesaw Avenue
Improvement Project, the City
