the front passenger com partment area the following: a black bag containing three pistols, $500.00 cash, and a bottle containing three different types of pills. The three pistols are described as follows: a Keltec model P-11 pistol (serial number A5364); a Smith & Wesson model SW9VE pistol (serial number DWM1715); and a Smith & Wesson model SW380 pistol (serial number RAE5103). The trunk was also searched and an other bag was found that contained a set of scales, clear plastic baggies, and jars containing suspected marijuana. The scales and baggies are paraphernalia typically used in drug trans actions. A search of Mr. Allen’s person produced an other plastic baggie contain ing several white pills inside of his sock and an addition al $587.00 in cash ($257.00 from his right pants pocket and $330.00 from his left pants pocket). The pills found in the vehicle and on Mr. Allen’s person are suspected to be oxycodone weighing more than 1 gram. The marijuana found in the vehicle weighs more than 23 grams. The firearms and cash were ultimately seized by Officer McWhorter in Lamar County on March 10, 20201. The Defendant was charged with the follow ing offenses: Possession of Marijuana with Intent to Dis tribute; Possession of Mari juana (less than one ounce); Possession of Drug Related Objects; and Possession of a Controlled Substance. The Defendant has a criminal history involving previous narcotics charges. Claimants who may have an interest in said property are ROBERT JATAE ALLEN. Conduct giving such rise to said seizure was as follows: On January 5, 2021, Lamar County deputies were conducting surveil lance on 1321 McCollum Road, Barnesville, Geor gia, and 257 Abbott Road, Barnesville, Georgia, due to anonymous complaints of drugs being sold at both locations. Sgt. Keith Kendrick witnesses a drug transaction take place between Tony Akins and a white male (purchaser). The transaction was allowed to end and thereafter, deputies stopped the vehicle being driven by the purchaser, who told the deputies that he had just purchased mari juana from Mr. Akins. The purchaser agreed to assist the deputies in a further investigation of Mr. Akins. The following day (Janu ary 6, 2021), a controlled drug transaction took place between Mr. Akins and a confidential informant (C/I) at 257 Abbott Raod, where Mr. Akins sold a quantity of marijuana to the C/I. On January 21, 2021, another controlled drug transac tion took place between Mr. Akins and a C/I also at 257 Abbott Road. Finally, on February 1, 2021, a third controlled drug transac tion took place between the C/I and Mr. Akins once again at 257 Abbott Road. On February 4, 2021, Sgt. Kendrick obtained a search warrant for the residence of Mr. Akins at 1321 McCollum Road. Suspected marijuana weighing more than one (1) pound was found in eleven (11) separate bags, which was contained in a duffle bag found in an outbuilding on the property. Some of the money used in the drug transactions was found on Mr. Akins’ person when he Heralti <Sa?ette Tuesday, April 13,2021 5B was arrested, along with $622.00 in cash. At the La mar County Detention Facil ity, Mr. Akins told the nurse that once he had bonded out of jail, he was “going to sell dope.” Previously, a C/1 told Sgt. Kendrick that Mr. Akins has a male friend who was given instructions that upon Akins’ arrest, the friend was to go and get Akins’ money that Akins kept buried in a secret location. On February 16, 2021, Sgt. Kendrick arrested on a probation violation and $410.00 in cash was found on his person. The total amount seized from Mr. Akins was $1,032.00 Mr. Akins has been convicted of the sale of cocaine in Lamar County, Georgia, in 2016.
