The Defendants in this lawsuit. Golden Peanut, Birdsong, and Olam, are peanut shellers. Plaintiffs in this lawsuit are farmers who sell Runner Peanuts to the Defendants. Plaintiffs allege that Defendants conspired to suppress competition and to pay depressed prices to farmers in the United States for Runner Peanuts between January 1, 2014 and December 31, 2019, in violation of federal antitrust laws. Plaintiffs further allege that because of the conspiracy, they and other farmers were injured because they were paid less for their Runner Peanuts than they would have been paid in the absence of the illegal conduct. The Defendants have denied and continue to deny Plaintiffs’ claims. On April 5, 2021, the Court approved settlements with Defendants Olam and Birdsong totaling $57,750,000. More recently, the Court preliminarily approved a $45,000,000 settlement with Golden Peanut (“Settlement”). Collectively, the settlements with Olam, Birdsong, and Golden Peanut total $102,750,000 (“Settlement Fund”). If the Settlement is approved the Action will be concluded as to all Defendants. WHO IS IN THE CLASS? You may be a member of the Class if you are a person or entity in the United States who sold Runner Peanuts to any of the Defendants, their subsidiaries or joint-ventures, from January 1, 2014 through December 31, 2019. Specifically excluded from this Class are the Defendants; the officers, directors or employees of any Defendant; any entity in which any Defendant has a controlling interest; and any affiliate, legal representative, heir or assign of any Defendant.
