PERSONAL PROPERTY
Pursuant to O.C.G.A. §
9-16-1 et. seq., any party
claiming an interest in the
following property is hereby
notified that the following
property was seized by
the undersigned agency in
Lamar County, Georgia: A
2009 FORD FUSION (VIN #
3FAHP08179R217642).
Conduct giving such
rise to said seizure was as
follows: On September 17,
2021, Sgt. Keith Kendrick of
the Lamar County Sheriff’s
Office began a narcotics
investigation of the possible
sale of methamphetamine
from Apartment # 2 at 316
Forsyth Street in Barnesville
Georgia, the residence of
Shawn C. Herzich-Smith.
Sgt. Kendrick determined
that Mr. Smith was currently
on probation in Coweta
County for a drug offense.
On September 21, 2021, Sgt.
Kendrick began surveillance
of Mr. Smith’s residence and
approached Mr. Smith, who
was sitting in his 2009 Ford
Fusion vehicle, identifying
himself as a member of law
enforcement. In plain view,
Sgt. Kendrick could see a
digital scale in the pocket of
the driver’s side door. Mr.
Smith grabbed the scale,
an item commonly used to
weigh narcotics, and tossed
it across the car. During this
interaction, Sgt. Kendrick
also saw a glass smoking de
vice next to Mr. Smith’s leg.
Mr. Smith was placed into
handcuffs and patted down.
Inside of his pants pocket
was found a bag containing
suspected methamphet-
amine. Mr. Smith told Sgt.
Kendrick that he uses meth
amphetamine. Sgt. Kendrick
found more suspected
methamphetamine inside of
the vehicle that was pack
aged in five (5) individual
plastic bags. Mr. Smith also
told Sgt. Kendrick that he
sells methamphetamine to
support himself. The total
amount of methamphet
amine exceeded one ounce,
so Mr. Smith was charged
with Trafficking Metham
phetamine. Because the ve
hicle was used to transport
the methamphetamine, Sgt.
Kendrick seized the vehicle
in Lamar County on Septem
ber 21, 2021. The Defendant
has an extensive criminal
history involving charges
for Possession of Metham
phetamine, Possession of
Marijuana with Intent to
Distribute and Possession
of a Controlled Substance.
These convictions were
obtained in Coweta County,
Georgia, in 2018.
Claimants who may have
an interest in said property
are SHAWN C. HERZICH-
SMITH. Said property was
used in violation of O.C.G.A.
§ 9-16-1 et. seq., and 16-13-49
et. seq. in that the item(s)
was/were used to facilitate
the possession, sale, and
distribution of controlled
substances and/or mari
juana and/or are proceeds
derived or realized there
from and that said item was
used directly or indirectly
used or intended for use in
any manner to facilitate a
violation of O.C.G.A. Title
16, or of the laws of the
United States or of any
State relating to marijuana/
controlled substance which
is punishable by imprison
ment of more than one year,
and or said property was
found in close proximity to
controlled substances and/
or marijuana.
You are further notified
that you may file a claim
within thirty (30) days of
the second publication of
this notice of seizure by
