NOTICE!
IMPORTANT CHANGES
IN YOUR
GEORGIA AUTO
INSURANCE LAWS
Effective March 15,1964
/
WHY WAS THE LAW CHANGED?
The law was changed to protect everyone in
Georgia against financial irresponsible drivers
who are unable to pay for damages they cause to
innocent persons. The law also promotes safety
by helping the state remove from the road motor
ists who frequently cause or violate the
laws.
WHOM DOES IT AFFECT?
The new laiw -affects all motorists involved
in an accident resulting in death, injury, or pro
perty damage over SIOO. The law also affects
drivers who are convicted of violating a traffic
law sudh as drunken driving, leaving the scene
of an accident, failing to yield the right of way,,
failing to stop for a red light, and other major
and minor offenses.
HOW DO YOU REPORT ACCIDENTS?
The police must be called to the scene of
every traffic accident. Then, the driver of every
vehicle involved in the accident must file a writ
ten report with the Department of Public Safety
if the accident involved death, injury, or proper
ty damage over SIOO. Failure to report the acci
dent is punishable by the suspension of your
driver’s license.
WHAT HAPPENS TO YOU?
Wiithin 30 days of receipt of the accident re
port, the Director of Public Safety will deter
mine if all drivers involved in the accident are
financially responsible and able to pay for the
damages. Auto liability insurance may be con
sidered as proof of the driver’s financial respon
sibility.
A driver without insurance may be required
to post a cash bond -to satisfy all pending court
judgments for damages. This bond may be up to
$25,000. The owner and operator of every vehicle
involved in the accident must also give and main
tain proof of financial responsibility for future
accidents.
No matter who caused the accident, the
operator or owner of a vehicle involved in an
accident not covered by auto liability insurance
may have his license and all registration plates
suspended. The suspension will continue until:
(1) such a person has deposited security and
established proof of financial responsibility, (2)
there is a final court judgment or a written
agreement to pay for the damages, or (3) the
license has 'been suspended for three years. A

suspension of a driver’s license for a major of
fense must be for at least 30 days.
WHAT HAPPENS TO VIOLATORS?
If a person is convicted of a moving traffic
violation such as improper turning, running a
red light or stop sign, and if he did not have
auto liability at the time of the violation, the
driver’s license and registration plates will be
revoked unless he files a statment showing he
has purchased insurance or qualifies as a self
insurer. Upon a second conviction of a moving
violation within one year, the motorist must file
proof of having insurance, which must be main
tained for at least one year.
HOW CAN YOU KEEP YOUR LICENSE?
If the motorist or the vehicle had in effect at
the time of the accident a liability insurance
policy or bond on the vehicle or driver, the driver
is not in danger of losing his license due to the
lack of financial responsibility. However, on
some major driving offenses, a license may be
suspended even if the driver has insurance. With
out insurance, a motorist is in danger of having
his license revoked, whether or not he is the
cause of an accident.
Motor vehicle liability insurance is design
ed to pay for the damages or injuries you may
cause to other people as a result of your negli
gence. The insurance .policy must be issued by an
insurance company or surety company authorized
to write the insurance in Georgia. The policy
must provide the following minimum coverage:
SIO,OOO for injury or death in one person
$20,000 for injury or death to more than one
person in the same accident, and
$5,000 for property damage.
In order to avoid placing security with the
state, you must file with the Department of
Public Safety satisfactory evidence that you
carried adequate insurance at the time of the
accident or following a moving traffic violation.
Official report forms, which require the neces
sary evidence of proof of financial responsibility,
may be obtained from the Department of Public
Safety or your insurance agent.
The law imposes a $lO reinstatement fee
when an operator’s license or registrations were
suspended and the filing of proof of financial re
sponsibility was reported. This reinstatement fee
will be used to assist in financing the enforce
ment of this law.
