The Criminal Docket Receiving the
Attention of .Itulge Hartlett.
>
The mills of justice have been kept
steadily grinding for near two weeks
past, and it is thought by some that
the business m hand will keep the hon
orable body in session until tomorrow
afternoon.
As stated Judge Hunt exchanged
benches with his honor, Judge Charles
Bartlett, of Bibb, this week, there
being a number of cases in which Judge
Hunt was disqualified to preside
Judge Bartlett has won the highest es
teem from our people both as au offi
cial and socially during his short stay
in our midst. Many of our citizens
express as their opinion that for des
patch in the affairs,of the court he will
compare favorably with Judge John I.
Hall. Suffice it to say he pushes busi
ness forward and at the same time sus
tains the dignity of the court iu such a
manner as to have won encomiums of
praise from all who have been present
the past week.
The criminal docket was taken up
last Friday instead of Monday follow
ing, as was excepted.
The first case on the criminal docket
that came up for trial by jury was that
of Ed llopkius, the negro tramp ac
cased of attempting to wrtek au E. T.
V. &G. passenger train. The only
evidence against this negro was purely
circumstantial, hut the chain of circum
stances was so perfect as to preclude
anv other hyp thesis than that of his
guilt, therefore m accordance with the
testimony the jury returned a verdict
of guilty, with a recommendation to
the court for mercy. Without this
recemmendation the penalty would
have been imprisonment for life, hut
in the case of a recommendation the
penalty is from five to ten years, at
the discretion of the court. This crime
was such a heinous one that Judge
Hunt sentenced him to the limit.
The case aroti.M which more interest
has clustered than any other, however,
was that of Jim Schaefer, colored,
charged with the murder of Capt. A.
C. Sloan. This case was taken up
tlic first thing Monday morning and
consumed three days in the trial. Solic
i or Beck and lion. E. J. Reagan ap
peered for the state, and Cols. Bryan
and Dickeu for the defense. The
prisoner’s defense endeavored to set up
an alibi, but the state succeeded iu
making out such a strong case until
there seems to be but little doubt in
the public mind that the jury will ren
der any thing else than a verdict of not
lilty. At this writing the jury has
been out all night and up to the pres
eut time, iate Thursday afternoon, and
have noi as vet returned a verdict. It
is the general opinion that they are all
agreed as to the prisoners guilt, but as
the proof against Schaefer is mostly
circumstantial, that some are holding
back favoring a recommendation for
mercy. • Ben Bivins, his accomplice,
who was tried and found guilty at the
last term of the was brought
back from the penitentiary as a witness,
and reiterated his confession made
when fi: st ai rested and accused, but
which he strongly dented as being the
truth in his own trial, claiming then
that it was extorted from him by prom
ises and threats. Bivins’ confession
is now generally thought to be the
truth of the matter. No matter how
this case may lie decided the counsel
on both sides are to he complimented
for the able manner in which they went
through this laborious trial The ar
guments on both sides were the most
thorough and at some points eloquent
that have resounded within the walls
of our old court house in many a day.
A jury has also retired to make a
verdict in in tiie case of the negro
Press Murphy, charged with man
slaughter.
The case now under trial is that of
young negro, Floyd, who killed another
of like color near Payne’s chapel last
fall.
Below we gi»e the remainder of the
cases disposed of since our last issue :
Jennie Harris vs. J. W. Derrick.—
Judgement for plaintiff.
T. D. StewaK & Co. vs R. T.
Crawley,’G. W. Dryan and W. T.
j Dicken endorsers. Judgement for
; plaintiff.
j Allison Speir vs. G. V. Barnett.
Judgement for plaintiff.
'1 he State vs. Ed Sloan. Plea of
guilty ; $40.00 and cost.
The State vs. Davis Henson. Plea
of guilty ; $40.00 and cost.
On going to pre3S we learn that the
jury in the case of Press Murphey
lias returned a verdict of not guilty.
\Ve also learn that the jury iu the
Sloan murder case has returntd a ver
diet of guilty with recommendatio
for mercy, thus saving Schaefer’s neck
from the hangman’s noose.
The lovely things in new spring mil
linery, shown by Miss Betty Berry at
