The Newton County Jaycees are supporting the recommendation of past GRAND JURIES composed of our leading citizens to legalize the
sale of PACKAGED beer. There is no question that beer is presently being sold in Newton County outside the law and without controls. We
believe that bootlegging can be virtually eliminated if licenses are granted to reputable outlets who must observe strict law enforcement controls.
Why do we have bootlegging of beer in Newton County? In the State of Georgia there is no law which restricts the amount of beer a person can possess. The state
law permits the local government, be it city or county, the power to regulate the sale of malt beverages (Beer). In order for the law enforcement agency to arrest boot
leggers and the court to convict them, it is necessary that they have sufficient evidence. This sounds very simple and easy, but this evidence must be conclusive, that is, the
law must catch the buyer and the bootlegger in the transaction of taking the beer and passing the money. Even if the law is able to make a case on these grounds, the boot
legger can ONLY BE CHARGED WITH SELLING BEER WITHOUT A LICENSE! As the state law now stands there is no deterrent to bootlegging. We feel that the only way
bootlegging can be eliminated is to have beer sold legally subject to control and regulation by the county.
Through the illegal sale of beer, Newton County is presently losing @ CONSERVATIVELY ESTIMATED $50,000 PER YEAR IN TAXES.
This estimate is based on the following FACTS:
