PROPOSED RESOLUTION OF
NEWTON COUNTY, GEORGIA
FOR REGULATION OF THE
SALE OF MALT BEVERAGES
WHEREAS, The Commissioner
and Advisory Board of Newton
County, Georgia are aware that
a considerable amount of malt
beverages Is being sold illegally
and consumed within the limits
of said County; and
WHEREAS, this body wishes to
control the sale and consumption
of such beverages within the
limits of said County; and
WHEREAS, this body wishes
to find additional sources of re
venue in order to forestall any
tax increase on the people of
this County; and
WHEREAS, this body, in the
exercise of its sound judgment
and discretion, after giving
thorough consideration to all the
Implications involved, and keep
ing always in mind the public
interest and the welfare of the
citizens of Newton County, deem
it advisable to legalize the sale
of malt beverages within the
limits of said County, subject at
all times to the regulations and
controls to be established by this
body:
NOW THEREFORE, BE IT RE
SOLVED, that from and after the
First day of September, 1965,
NEWTON COUNTY, GEORGIA
will issue retail licenses for the
sale of malt beverages within
said County, and wholesale lic
enses for the distribution of malt
beverages within said County,
subject to the following provis
ions: ■
SECTION I — TYPE OF
SALE. Malt beverages sold in
the County of Newton will be for
Packages Sales with off premise
consumption only, except as may
be authorized and approved by
the Commissioner of Newton
County.
SECTION II — RETAIL LIC
ENSEE QUALIFICATIONS. The
retail licensee must be a person
of good moral character, a citi
zen of the United States, and a
resident of the County of Newton
for a period of ONE YEAR next
preceding the date of filing
application.
(1) The licensee shall not have
been convicted within one
year of the date of his ap
plication of felony, or any
violation of the laws of this
state, relating to the sale
of Malt Beverages or Al
coholic Liquor.
(2) The licensee shall be the
owner of the Premise for
which the license is held or
the holder of any lease
thereon.
(3) The licensee shall be ac
tive in, and solely re
sponsible for, the manage
ment and operation of the
business for which the lic
ense is granted.
(4) The applicant shall make a
sworn statement of his
qualifications according to
the above and shall place
on file with the County
Commissioner before any
license is issued.
(5) If the application covers a
partnership, all members
of the partnership must be
qualified to obtain a lic
ense and must make a
sworn statements of these
qualifications.
(6) No person shall be granted
a license to engage in the
sale of Malt Beverages at
retail unless it shall ap
pear to the Satisfaction of
the County Commissioner
that such person, or the
officers and directors of
any corporation, shall be
of good moral character.
(7) Any misstatement or con
cealment of fact in the
application shall be
grounds for revocation of
the license issued and
shall make the applicant
liable to prosecution for
perjury under the law of
the State of Georgia.
SECTION IH —- WHOLESALE
PERMITS. Wholesale licenses
shall be issued only to those
parties who are licensed by the
State of Georgia to sell and dis
tribute malt beverages at whole
sale. Application shall be made
with the County; and the appli
cant shall present evidence to
show that all laws and regulations
pertaining to such activities in
this County and State are under
stood by the applicant.
SECTION IV — REGULA
TIONS. No holder of a license
authorizing the sale of malt bev-

erages at retain in the County of
Newton nor any agent or employee
of the licensee, shall do any of
the following upon the licensed
premises:
(1) Knowingly sell beer to a
minor.
(2) Knowingly sell beer to any
person while such person
is in an intoxicated condi
tion.
(3) Sell beer upon the licensed
premises on any day or at
time when such sale is pro
hibited by law.
(4) Permit on the licensed
premises any disorderly
■conduct, breach of peace,
or any lewd, immoral, or
improper entertainment,
conduct or practices.
In addition:
(1) It shall be unlawful for any
person to manufacture,
sell, or possess for the
purpose of sale, any malt
beverages Where such
person does not have a
license from Newton Coun
ty to sell or possess for
sale such beverages.
(2) Malt beverages shall be
received at or delivered to
the premise of the retail
licensee by no other means
than by a conveyance owned
and operated by a whole
sale dealer with a permit
from the Commissioner of
Newton County, Georgia to
make deliveries in said
County.
(3) Transportation of malt
beverages by any other
means shall be grounds for
revocation or retail lic
ense or wholesale permit.
(4) Dealers in malt beverages
shall not engage in the sale
of such beverages except
between the hours of 7:00
A. M. and 12:00 P. M. on
weekdays, and shall not
permit their places of
business to be opened for
the sale of such beverages
on Sunday or any other days
prohibited by state law.
(5) A license shall be a mere
grant or privilege to carry
on business during term
of the license, subject to
all terms and conditions
imposed by this Resolu
tion, or any future Resolu
tion, and subject to revo
cation with or without
cause, and with or without
notice or hearing. In case
of revocation, the licensee
shall not be entitled to a
return of the unearned lic
ense fee. All such licenses
shall have printed on the
front these words:
“This license is a mere
privilege subject to be
revoked and annulled by
the Commissioner of
Newton County, Georg
ia, with or without
cause, and with or with
out notice or hearing.”
(6) Any violation of the pro
visions of this Resolution
shall be grounds for im
mediate revocation of a
license by the Commis
sioner of Newton County.
SECTION V — JOINT RE
SPONSIBILITY. Sales to Minors:
Possession by Minors:
(1) Minor defined The
term “Minor” as used in
this resolution shall mean
any person under the age of
twenty-one (21) years.
(2) It shall be unlawful for a
minor to attempt to pur
chase, to purchase, or for
any other person to pur
chase malt beverages for a
minor.
(3) It shall be unlawful for a
minor to exhibit faked,
forged or borrowed cre
dentials in an effort to ob
tain goods and services
(malt beverages) to which
he is not legally entitled.
(4) It shall be illegal for a
minor to loiter in an es
tablishment selling malt
beverages at retail.
(5) It shall be unlawful for any
minor to have malt bev
erages in his or her pos
session.
(6) No person engaged in the
business regulated here
under shall make or permit
to be made any sales to
minors.
(7) Any violations of the pro
visions of this section of
this Resolution shall con
stitute .a mis demeanor
and the offender shall be
punished by a fine of not
more than $1,000,00 and
imprisonment for not more
than 12 months in the dis
cretion of a court of com
petent jurisdiction.
SECTION VI — LICENSE
FEES, ETC. The applicant for a
wholesale license shall pay to
Newton County at the time of his
license being issued the sum of
One Hundred Dollars as an an
nual license fee for operation for
one (1) year beginning on the
Ist., day of January each year
or one-half of this amount if the
license is issued during the last
six months of the license year.
The applicant for a retail lic
ense shall pay to Newton County
at the time his license is received
the sum of One Hundred Dollars
as an annual license fee for oper
ation for one (1) year beginning
on the Ist day of January each
year or one-half of this amount
if the license is issued during
the last six months of the license
year.
In additon to the above retail
license fee, there is hereby as
sessed a pro-rated license fee,
based on sales, in the following
amounts:

The prorated license fee on
each container shall be repre
sented by a stamp of the proper
donamination applied to the un
opened container. The Com
missioner of Newton County,
Georgia shall keep on hand a sup
ply of such stamps, and the
wholesaler or his agent shall pur
chase from the Commissioner,
at face value, a sufficient quan
tity of these stamps, and shall
affix stamps of the proper de
nomination to all unopened con
tainers before making deliveries
to the retail dealers.
In the event that a wholesale
dealer wishes for any reason to
stop making deliveries of malt
beverages in the County of New
ton and has unused stamps in
his possession, he may return
these stamps to the Commiss
ioner of Newton County and shall
have restored to him the face
value of the unused stamps pro
vided, however that if the whole
sale dealer has been guilty of
evasion, or conspiracy with a
retail dealer to evade any pro
vision of this resolution, no re
storation shall be made to him
for unused stamps.
No retail license of the County
of Newton Shall accept delivery
of malt beverages from any
wholesale dealer unless the pro
per stamps are affixed to all
cases as herein provided.
All licensed retailers shall
store all malt beverages in their
posession on the premises for
which the license was issued,
and at no other place or places
except upon written permission
from the Commissioner of New
ton County, Georgia upon written
application therefor.
SECTION vn
There is hereby assessed a
pro-rated license fee on all malt
beverages in possession of any
one on September 1, 1965, who
holds a permit from the State
Revenue Commission, at the
same rates as set out in Section
VI above.
They are required to make
affidavit to the Commissioner of
Newton County, stating quantities
of malt beverages on hand as of
September 1, 1965.
SECTION Vin — HOURS OF
OPERATION.
The hours of operation of
wholesale licensees for the dis
tribution of malt beverages within
this County shall be between the
hours of 7:00 A. M. and 6:00
P. M. The hours of operation
of retail licensees for the sale
of malt beverages shall be be
tween the hours of 7;00 A. M.
and 12:00 P.M. There shall be

SECTION IX — AUTHORITY
TO ISSUE LICENSES.
All applications for such lic
enses shall be presented to the
Commissioner of Newton County
for approval, and if approved,
the licenses shall be issued by
the Commissioner upon the pay
ment of the required fee.
SECTION X — RULES AND
REGULATIONS.
All the provisions of this Reso
lution are and shall be subject to
the regulations hereinafter pre
scribed by resolution of the com
missioner, as the same may be
from time to time amended, set
ting forth the rules, terms and
conditions upon which such lic
enses may be issued; the annual
license fees; the pro-rated lic
ense fees; based on sales; the
qualifications of licensses; the
restrictions on the business lo
cations of licensees; the hours
of operation of such licensees;
the control of customers doing
business with licensees; and any
and all other matters which the
commissioner may deem it ad
visable to set forth for the pro
per control and regulation of
the sale and consumption of malt
beverages in this County; and all
such licenses as may be here
after issued shall be expressly
subject to the provisions of such
rules and regulations as may be
then or thereafter in force; and
all such licenses shall be non
transferable, and shall convey
to the licensee no property right,
but only a privilege, which may
be revoked by this body at any
time, without cause, and without
notice.
