PIKE COUNTY BOARD OF APPEALS
MONTHLY MEETING
6:00 p.m. January 21, 2021
The Pike County Board of Appeals will conduct its
scheduled monthly meeting on January 21, 2021 at 6:00 p.m.
on the second floor of the Pike County Courthouse located
at 16001 Barnesville Street, Zebulon, Georgia. The Board
will conduct PUBLIC HEARINGS on the following item:
(1) VAR-20-15. ATC Sequoia LLC, owner, and AT&T,
applicant, are requesting a variance to increase the height
of an existing telecommunications tower located at 256 Flat
Shoals Rd. Concord, GA 30206. The subject property is
further identified as Parcel ID: 031-003J and is located in
the 182nd Landlot of the 9th Land District of Pike County.
Current code states that telecommunications towers can be
a maximum of 250 feet in height. The request for variance is
seeking permission to increase the total height of the tower
to 260 feet in total height. The public is invited to attend to
speak in favor or in opposition of the request. The public

A CLASS ACTION AGAINST THE
DEFENDANTS
The United States District Court for the
Eastern District of Virginia (the “Court”)
has determined an action captioned//'
Re Peanut Farmers Antitrust litigation,
No. 2:19-cv-00463 (ED. Va.) (the
“Action’) may proceed as a class action
on behalf of persons or entities in the
United States who sold raw, harvested
runner peanuts (“Runner Peanuts’)
to Defendants, their subsidiaries or
joint-ventures, from January 1,2014
through December 31,2019 (the
“Class Period”).
The Defendants are: Golden Peanut
Company LLC (“Golden Peanut’),
Birdsong Corporation (“Birdsong ),
and 01am Peanut Shelling Company
(“Olam’).
WHAT IS THIS CASE ABOUT?
The Defendants in this lawsuit. Golden
Peanut, Birdsong, and Olam, are peanut
sheilas. Plaintiffs in this lawsuit are
fanners who sell Runner Peanuts to
the Defendants. Plaintiffs allege that
Defendants conspired to suppress
competition and to pay depressed puces
to faunas in the United States for
Runner Peanuts during the Class Period,
iu violation of federal antitrust laws.
Plaintiffs further allege that because of
the conspiracy, they and other farmers
wae injured because they were paid
less for their Runner Peanuts than they
would have been paid in the absence
of tile illegal conduct. The Defendants
have denied and continue to deny
Plaintiffs’ claims.
Plaintiffs have reached settlements
(‘Settlements’) with Defendants
Olam and Birdsong (the “Settling
Defendants’) totaling $57,750,000
('Settlement Funds’). The Settling
Defendants do not admit any liability,
but chose to settle to avoid fortha
expenses, burdens, and risks that are
inherent in any Litigation. Under the
terms of the proposed settlements,
Olam will pay $7.75 million and
Birdsong will pay $50 million. The
settlements have been preliminarily
approved by the Court, which has
certified an Olam Settlement Class
and a Birdsong Settlement Class. The
Settlements will he presented to the
Court for final approval at a hearing
on March 25,2021. The Action will
continue against Golden Peanut (the
“Non-Settling Defendant’) and each of
the Settling Defendants has agreed to
provide cooperation to assist Plaintiffs
as they pursue their claims against

WHO IS IN THE CLASS?
Yon may be a member of the Class
and Olam and Birdsong Settlement

in the United States who sold Runner
Peanuts to any of the Defendants, their

31,2019. Specifically excluded from
this Class are the Defendants; the
officers, directors or employees of any
Defendant; any entity in which any
Defendant has a controlling interest; and
any affiliate, legal representative, heir or
assign of any Defendant

YOUR RIGHTS MAY BE
AFFECTED
If you are a member of the Class you
will automatically remain in the Class
unless you elect to be excluded. If
you remain in the Class, you will be
bound by any judgments, decisions, or
settlements in the Action, and, assuming
the Court finally approves the proposed
settlements, will be able to share in the
proceeds from the Settlement Funds,
which will be allocated pursuant to a
distribution plan approved by the Court.
If you opt out of the Class, you will not
have any rights as a member of die Class
and will not he able to participate in the
setdements with the Settling Defendants
or any future settlement or recovery
against the Non-Settling Defendant.
If you opt out you will not be bound
by any further orders or judgments in
this case; and you will keep the right
to sue, if any, on the claims alleged iu
own lawsuit at your own expense. If
you remain in the Class, but opt out of
either or both of the Settlement Gasses,
you will not be hound by any orders or
judgments relating to the Setdement
Class of which you opted out and will
not be able to share in the proceeds
from the Settlement relating to that
Setdement Class.
