At Four In tl»e Morning They Were on Hand <111 <1 Were LUtenhig to Mr. Allen Who Had Spoken for Twelve hong Xlourn, Washington, Oct. 13.—As had boon announced, the continuous sitting of the senate was inaugurated Wednesday even ing, and all night long that body held their seats and listened to the Nebraska senator, who took the floor at the close of Senator Cockrell's speech. At 5:15 o'clock Mr. Cockrell completed his long speech. His voice was nearly gone, and he could only shake his head in response to the inquiry of the vice- president as to whether he had com pleted his remarks. After some routine business Mr. Al len, Populist, of Nebraska, took the floor to continue his speech. Mr. Allen was still speaking when, at 6.05 o’clock, Mr. Dubois, Republican, of Idaho, rose, and Mr. Allen yielded the floor to him. He observed that it was 0 o’clock, the hour * when the senate usually adjourned. He asked the senator from Indiana, Mr. Voorhees, whether he was going to make that motion this evening. *'I feel it my highest duty,” said Mr. Vorhees, not to make that motion this evening, but on the contrary to ' ask the senate to stay together in continuous ses sion until the pending measure is dis posed of.” Mr. Dubois said the statement of the senator from Indiana meant Aliat the senate was to Ire held in continuous ses sion until the pending bill was brought to a vote or until it was demonstrated that it could not be brought to a vote. He said there had been no attempt at fil ibustering on the part of the opponents of repeal. Mr. Vioorliees replied at great length. He suggested to Mr. Dubois the wisdom of saying 4 -let not linn that girdeth on his armor boast himself as he that put- teth it off." -We will see who fails in . this transaction before we are done,” 'said Mr. Voorhees. “I feel that my feet dre.on a rock, and there I shall stand and vindicate a great and mighty prin ciple. But before I say a word on that subject I will ask the senator from Idaho whether he will fix a date to take a vote.” Mr. Dubois said there were distin guished senators who had not talked on the subject, and he could not, nor could any one say when the debate would probably close. Mr. Voorhees started to press the question further, but apparently changed bis mind and said: •• Without pressiug the senator from Idaho, I understand the situation perfectly well. There will be no day named; If there could be a day named by the opponents of this bill, we could come to an understanding di rectly. It is because obstruction is re sorted to, pure and simple, against legist lation that we are in the attitude we are now. We regret exceedingly to have to resort to the methods now before us.” Mr. Hoar observed that continuous sessions were not an innovation, recall ing the fact that the Bland-Allison bill was passed about 5 o’clock in the morn ing. Mr. Voorhees said this episode in the' history of the senate would result in re forming the rules of the body. At the proper time—not in connection with'a heated discussion—he would vote for some measure by which a determination . of a question could be reached. Other wise the body would lose its proper in fluence and standing before the Ameri can people and liefore the world, said Mr. Voorhees, **I ltelieve this lxnly should have rules by which to conclude discussion and reach a vote, higher, more reasonable, more sensible and more decent than the role on which we are entering now, which is the only one. The opponents of this bill will not name any day for a vote. They will resort to dila tory measures to prevent action being taken at all. Who is to quit? Sir, 1 would rather be carried from this desk feet foremost and put to sleep at my home in Terre Hante forever, than to yield the principle that the majority has a right to govern. Mr. Voorhees moved to lay the Peffer amendment on the table. Mr. Wolcott suggested that no quo rum was present; but 46 senators were found to be in the hall. The vote resulted—yeas. 29; nays 12. ^ cal^ was ordered, and 45 answered During the caii of the roll Mr. Dubois refused to vote. His excuse was ren dered, and was rejected by the senate, still he refused to vote when his name was called again and again. ^ Tta* Vole. The amendment prescribed the pro portion® and weig?it of gold and silver coins to be coined herealter and the na ture of the alloy, and provided the nec essary machinery for the execution of its purpose, namely, the free coinage of both gold and silver. The vote having l)eea announced, Mr. Voorhees remarked that the only other amendment pending to the house bill was the amendment reported from, the finance committee. _ “What has become of all the other amendments that have been offered?” Mr. Butler inquired. “There have been none others offered,” 3Ir. Voorhees replied. “There have been notices of amendments given.” Mr. Martin, of Kansas, then addressed the senate in favor of free coinage. In the House. Washington, Oct. 13.—In the course of the morning business in the house, there was a small controversy over the number of copies of the ways and means tariff hearings to be printed, but the printing committee's recommendation (2,000 copies) was finally accepted. The Flynn resolution, fixing the qual ification of Cherokee strip citizens, was adopted, and the house took up the bill to protect forest reservations. Mr. Thomas Batte, editor of the Graphic, Texarkana, Arkansas, lias found what he believes to be the best remedy in existence for the' flux. His experience is well worth remembering. Will Move to V.'aOiington. Washington, Oct. 13.—Mr. Henry T. Thurber, private secretary to the presi dent, left Washington Monday after noon for Detroit, whence he will move his family to this city. Counsel for Colonel Ainsworth and others filed with the District court of ap peals an appeal from the derision over ruling the demurrer to the indictment charging the defendents with responsi bility for the Fot»1 theater disaster. " The papers in the ease of Paymaster John Clyde Sullivan, U. S. N., convict ed by courtmartial of embezzlement, have been sent to the president. The court recommended dismissal, and it is understood that Secretary Herbert has 'approved the sentence. Consul Mvtrs reports from Victoria, B. C., that sealskins are selling at $15. About 22,000 skins bad gone into tbe market up to tlie date of the report. Wheeler quashing the indictments against per sons in this city for selling liqnor, be cause the act creating the dispensary system is unconstitutional, * null and void on the ground that the legislature of the state has no right to transfer from a citizen of the state to the government thereof the exclusive right to traffic in mtoxicating liquors as a beverage; that it is not a legitimate exercise of police power, nor does it rest upon the plea that usually supports laws. It is not a legitimate exercise of police power, nor is it, in the proper sense of the word, a prohibition law, but it is a mere assump tion by the government of the exclusive right to traffic in intoxicating liquors. This being the main provision of the act, all limitations, restrictions and pro hibitions therein contained being merely auxiliary to this main purpose, must fall with the whole act, and the act in its entirety is pronounced unconstitu tional, null and void.
