The abo^c stated cause having been this day heard by the court under the original petition and subsequent inter ventions, pleadings and amendments by creditors and others made parties thereto, and it appearing to the Court that the firms of J. M. Spence & Co., at Wares- 1 boro, and J. W. Davidson & Co., at Waltertown are insolvent, the liabilities of said firms exceeding their assets, and it further appearing that it will be for the best interest of all parties concerned, for the court to take charge of the busi ness and assets of said firms and wind up and administrater the same, it is thereupon considered, ordered and ad judged by the court that J. M. Spence & Co., and J. W. Davidson & Co., and the members, agents, servants and ployes are each and all enjoined from the further management and control oi the business and assets of said firms or front in any manner interfering therewith until the further order of the court in the premises, and each and all of them are hereby required to surrender and deliver up to the receiver herein after named, all property, money and effects of every kind which may be in ^their hands or under theirlcontrol, nnderjlpenalty of being attached Jan d punished^ as * for^a contempt of court. Ordinary CL C. is ordered that the*receiveE{advertise in the Waycross Herald for thirty days for a purchaser or purchasers of the business at both Waresboro and Waltertown in bnlk, togother or saparately, giving all proper facilities to parties desiring to purchase to examine the same, and that said receiver report to the court any and all bids or offers made therefor for ap proval or rejection. And it appearing to the court that J. M. Spence Sr., of the firm of J. M. Spence & Co., and of J. W. Davidson & Co., by reason of his physical condition is incapacitated from engaging in any active business or work so as thereby to earn a competency for the support of himself and family and the education of his children, and that he proposed to surrender and deliver up to the receiver of the court and for the benefit of credi tors the property as set out and described in his petition belonging to himself in dividually and that the other property set oat and describbed in his said peti tion be-allowed to remain in his posses sion, custody and control and set apart and vested in him freed from th<v debts and liabilities of said firms and for the use of himself and family as aforesaid, the premises considered it is ordered and adjudged by the court that the receiver take chaige of all that property propos ed to be turned over as aforesaid to be administered as directed, and that the other property of the said J. M. Spence Sr., set oat and described in his peti tion referred to above remain in - the possession, custody and control of him the said J. M. Spence Sr n freed from the debts and liabilities of said firms and /or the use and benefit of himself and family as aforesaid. And it further apperringtothe court by the petition of J. W. Davidson of the said firm J. W. Davidson & Co., and J. M. Spence & Co.,that lie proposes to surrender and turn over to the receiver of the court all and singular his individual property of every kind and sort for the benefit of the creditors of said firms except hia household goods and personal effect and to eutcr upon whatever business or un dertaking seems best and as soon as practicable for the proper maintenance of himself and family, and for the pres ent that he be allowed to use the prop erty so to be surrendered and given up and that a temporary allowance be au thorized to be made him by the receiver, it is considered and ordered by the court until further direction that said J. W. Davidson be and he is hereby author ized tq retain the possession and use' of the property to be surrendered and given up by him as aforesaid not to be dis posed of aleniated or in any manner en cumbered by him nnder pain of attach ment and punishment as for a contempt of court, and that the receiver do pay to him out of any funds coming into his hands or ingoods out of the business cither at Waresbero or Waltvrtown as he the said J. W. Davidson may prefer for the benefit of himself and family the sum or amount of fifty dollars per month for January, February and March, unless the court by order shall sooner direct the discontinuance of the-same. It is further ordered that the receiver be and he is hereby au thorized and empowered to employ and pay such trustworthy, and competent help and assistance as may be actually necessary for the proper and economical conduct of the business at Waresboro and Waltertown; that the inventory heretofore made by the receiver be kept on file; that an accurate, correct and full account be kept of all sales, collections and purchases, and of all the acts and doings of the reciver and those employed by him, in and about the premises; that the property and effects of the busi ness at Waresboro and at Waltertown be kept insured at a reasonable and fair valuation, the premiums therefor to be paid by the receiver; that of the . prop erty now to be turned over by J. M.. Spence Sr., ways and means be taken by the receiver to secure, protect and pre serve the same until disposed of under the further order and direction of the court, said property in the meantime to be made to yield a profit if possible for its use, rent or hire thereof, and the same directions to be applied to the in dividual property* of J. W. Davidson, when surrendered and given up by him; that said receiver make mouthly reports to the court of the general status and condition of the business ' and property under his'control and of results reached, and that he do make weekly deposits of all the cash'coming into his hands in the South Georgia Bank of Waycross, It is further ordered by the court that the compensation! of said D. H. Bennett, receiver be and is hereby fixed at the sum of one hundred dollars per month, dating from his first appointment as •temporary receiver. It is further order ed that L. A. Wilson, Esq., be and he is hereby appointed counsel for the receiv er to advise, counsel and direct him in his recivership and to represent him in all legal proceedings which may arise or become necessary in the discharge of his duty, his compensation to be hereaf ter fixed by the court And it is further ordered that upon the said D. H.
