Judge jGriggs Issues a Warrant for McAl
lister’s Arrest, But He Still Enjoys

If Sheriff McAllister, who killed Jud_
son Hyatt, the popular drummer, in Ft,
Gaines, a week ago, has not been airest—
ed since yesterday morning he is still a
free man.
The relatives of the dead man have
been trying to have McAllister arrested
ever since the tragedy, but owing te his
standing in Fort Gaines and his large
family jconnections they have been baf
fled in every effort.
The day after the killing a coroner’s
jury went through the form of an inves
tigation and rendered a verdict of justi
fiable homicide. Governor Atkinson was
appealed to by the friends and relatives
of Hyatt and he wired the coroner to
arrest McAliister, but the instructions
were ignored and theslayer of the drum
mer continued to walk the streets ~ free
man. Mr. Frank Houser, of Fort Vailey, i
a brother-in-law of McAllister’s victim,
then went to Fort Gaines and applied to
Judge Scott, of the Clay county court,
for a warrant, and that official refused to
issue it on the ground that the coroner’s
jury haa aiready disposed of the matter,
which he said was sufficient investigatio: -

He arrived here Saturday aiternoon on
the Central train, and in a short while
Judge Griggs had attached his sivnature
to a warrant for the arrest of McAllister [
on the charge of murder. i
This warrant was directed to the coro- |
ner ot Clay county, and ig pmbublyi\
reached him by mail Moaday night, It {
could not have gotien there earlicr, as)
there is no Sunday train to Fort Gaines. |
If, when arrested, McAilister does not
waive a preliminary trial, he wiil be
brought to Dawson and given a hearing !
before Judge Griggs.

Yesterday, before going to press, THE
NeEws wired to Fort Gaines to learn if
McAllister had been arrested under the
warrant issued by Judge Criggs. The
