'5 HORSLEY & KILLENS,
A SPICY DECISION. |
In Which Justice Blanford Reverses the
Hon. R. G Higgins, J. P.
Justice Blandford, of the sup
reme court,' renderd the following
decision in a case tried before a
Jnstice of the peace,in Pike county,
The justice of the peace had charg
ed the jury in favor of the defends
ant, when the evidence was over
wheimingly in favor of the plaintiff.
This is Justice Blandtord’s deci
sion. -
The case was tried in'a justicecourt
on appeal before a jury, the Hon. |
R. G. Higgins, justice of the peace,
presiding. His honor charged the
jury as follows: *‘Gentlemen this
is a case which has been tried by
me be fore, and Idecided in favor of
the defendant. I further charge
‘you, gentlemen, that if you find
‘any settlement has been made, you
find for defendant. Retire and
make up your verdict.”
The law aoes ot require a justice
of the peace to charge the jury at
all; his ignorance of the law,as well
a 8 propriety would seem to demand
that he should not, butlf he under
takes to instruct the jury, he must
do it correctly and in accordance
with law. A justice of the peace
is generally a man of consequence in
his neighborhood ; he writes the
wills, draws the deeds and pulls
the teethof the peopic 1 also he per
forms divers surgical operation on
the animals of his neighbors. The
justice has played his part on the
busy stage of lite from the time of
Mr. Justicd Shallow down tothe
time of Mr. Justice Higgens. Who
has not seen the gaping, listenirg
crowd assembled around his hovor,
the justice, on tiptoe to catch the
words of wisdom as they fell from
his venerated lips?
. --*‘Aad still they gazed,
And still the wonder grew,
That one small head,
Could carry all he knew.”
Consolation for Widowers,
Dr. Johnson says: “Were not a
man to marry a second time, it
might be concluded that his first
wi'e had given him a disgust to
marriage; but by taking a second
wife he pays the highest complis
went to the first, by showing that
she made him so happy . as a mar
ried man that he wishes to be so a
second time.

JUSTICE !
~ Itis in one of our great cities
; that two criminals are arraigned be
fore a police court. Owne of
them is a yoang woman, whe has
been arrested on a charge of stroll
ing about the public thoroughfares
and enticing the young men from
the paths of rectitude,
Notwithstanding she pleads that
she was forced to leave home on
‘account of the brutal treatment of
"dissip:-ted futher of brother and
seek employment in the crowded
!city; votwithstanding she tells the
Honorable Court, with tears in her
eyes, that starvation was staring her
in the face, and slie could get no
employment, His Honor tells.her
that the eyes of the people areups
on him and the rizor of the law
must be inforced - she is sent up
for six months. Well done, right
Honorable Court,
N.xt appears 3 well-dressed
young man, with his eye glass and
walking cane—one of the modern
young men who spend their feeble
lives in smoothing the rumpled rose
leaves on the couch of pleasure.~
| He is one of the young, blaods, who
walk “about the park and public
places making mashes on you g
girls, and was arrested for this eflens
ce.
What bad he done “bat & polices
man should bring him up betore
the court? Nothing, and there
fore wos dismissed.
Nothing, your Honor, theugh
he should spurn the sacred cross of
Christ; nothing, though female
sirtue should lie like a trampled
Jily beneathhis feet ; nothing,
’tlmugh an innocent girl should be
‘taken from the hi;fi: pinnacle of
honor and diagged like a filthy rag
through a pnoFot eorruption. }
This is according to the times
and customs of the country, but it
seems hard inde d that woman
should be censured and even puns
vished for offences, that man may
perpatrate and walk the earth free
and ivdependent, ““O! Tempora,
U ! mores.”

In presenting this Cotton Planter to
public faver, I would direct attention to
a few adventages they posess over any
other planter in use
Ist. It is short and more compact, hence
more controlable and can be worked up
to stumps, fences, trees or cther obstruc
tions with more satisfaction.
2nd The ground wheel'is large and car
ries all of the weight; the planter being
equally -balanced fore and aft above it se
‘cures constant and unfailing work.
3rd. The seed falls perpendicular and
‘constantly into the groove of the ground
‘wheel and are carried without fail to the
bottom of coulter furrow.
4th. The motive is given to the spur feed
‘wheel by chains or by connecting rods
-as prefered by the purchaser.
oth This planter is not built by contract
but is substantially built of good mate
rial under the direct supervision of Mr.
U M Pewell whose Pat'd. improvement
it embraces,
