Held Meeting Monday
City Council met in regular
session Monday night March 21st,
with Mayor Drew W. Paulk pre¬
siding and the following named
alderman present, D. P. Adams,
Seanor, Dykes, Jolly, Duckworth,
J. M- Adams: absent Ware, White,
Garbutt. Minutes of the last
meeting were read and approved
as corrected.
The Public Building and Grounds
Committee submitted the following
report covering reuairs and im¬
the provements to the City Hall. We,
committee, find that it will
cost in the neighborhood of
$225.00 for the plumbing, that will
be necessary in the City Hall, and
about S500.0Q to build fire-proof

Alderman D. P. Adams moved
that the committee be instructed
to get specifications on Vault and
Plumbing and after getting and carpenter the specifications work,
to secure bids on the work as a

to the heating system installed in
the new school building, request¬
ing that final settlement be made
with them, was read. Aid. Jolly
stated that the matter had been
handled at the last meeting, and
had been referred to the committee
on P. B. & G." Alderman Adams
stated that he had further investi¬
gated the matter and founct that
there had been no improvement in
the service given by the heating-
system and that it was ordered

Justice, and that was a matter

The City Attorney reported Clark on
the application of Frank for

for city taxes, stating that evidence
submitted by Mr. Clark was a
letter from Mr. G. C. Smith,
superintendent of the A.,B. & A.
railroad, stating that the A. B. &

Application of Walter Burges

read, and as there was no vacancy,

A communication was received
from Mr. J. A. J. Henderson,
president and general manager of
the Ocilla Southern Railroad, in¬
viting the mayor, council, and
citizens to visit Ocilla and inspect
the line of road now built and in
operation between Ocilla and
Allapaha, stating that it was his in¬
tention with the co-operation of
the people of Fitzgerald and Ben
Hill county to extend the road
north. Aid. D. P. Adams moved
that the invitation be accepted.
Motion carried.
Aid. Dykes moved that the
Mayor issue invitations to citizens
to accompany the Mayor and
Council on their visit to Ocilla.
Motion carried.
A communication was received
from Little & Philips, contractors,
relative to the condition of the
Girls' Toilet and furnace room at
the new school building, stating
that they thought that the toilet
could be put in proper condition
by the use of drain tile and that
they would arrange to place same
in at once, but as to the condition
of the furnace room, they were
undecided what was best to do.
They stated that they expected
some advice from architects,
They also asked that the balance
of $1,000.00 due them be paid, if
notin full, to let them have at
least $800.00 or $900.00 and the
rest be held until building was in
proper condition. Alderman D.
P. Adams moved that communi-
cation be tiled as read and that
entire amount now due them be
held until the building had been

A communication was received
and read from Mr. W. C. Ward-
law, of the J. H. Hilsman & Co.,
relative to the passage of Ordinance
covering the registration of Bonds,
stating that they would pay the
incidental expenses in connection
with the passage of ordinance,
this expense to include the cost of
advertising same and a book in
which the registered bonds are that to
be kept. Aid. Jolly moved
communication be filed as lead,
Motion carried.
A communication was read from
Edwards and Walters, architects
in reference to the condition of the
furnace rooms and girls toilet at
the new school building, stating
that they had instructed Little &
Philips to give the matter attention.
Aid. Adams moved that the
munication be filed as read. Mo-
tion carried.
Alderman Garbutt moved that
the matter be referred to the com-
mittee on P. B. & G., with in-
structions to see that the matter
received prompt attention and if
necessary , to have work done and
charge to the contractors or archi-
tects. Motion carried.
A communication was received
frorn the- committee on Public
Buildings and Grounds of the
Board of Education, relative to the
condition of the boiler room and
one of the other room of the high
school building, and asked that the
council give the matter immediate
attention. Dr. Osborne, health
officer, advised the council that
the matter referred to by the
Board of Education needed atten-
tion stating that water in the
girls' toilet was over an inch deep used
and that toilet could not be
until something was done. Dr.
Osborne stated that temporary re-
lief could be had by laying some
boards on toilet floor, which would
allow the use of toilet until perma-
nent repairs were made, and sug-
gested that this be done. Aid. D.
P. Adams moved that the matter
be referred to the P. B. & G.
committee with instructions to
purchase the necessary lumber
and have it placed in toilet and to
keep account of the amount ex-
pended and charge same to the
contractors. Motion carried.
Mr. Brewer of the Consolidated
Grocery Company addressed the
Council in reference to the occu¬
pation tax, stating that it was too
high and that he did not think it
was proper to Coy an occupation
tax on account of stock paid carried,
stating further that he more
advalorem taxes to the City than
any other business of ‘same kind,
stating that he was willing to pay
$50.00 the same that he had paid
last year, and stating further that
when returns were made by his
company giving in their property
at $50,000.00, that the Secretary
included in the amount lots 8. 9, 10
and 11, square 7 block 7 and that
he had paid the taxes ol said, lots,
amounting to $25.03 and asked the
Council to refund that amount to
him. Aid. D. P. Adams moved
that the occupation tax covering
wholesale Groceries be reduced to
$50.00. Motion carried.
Aid. Garbutt moved that the
amount of Grocery taxes paid by the con-
solidated Co. on lots 8, 9,
10 and 11,- square 7, block 7, be
refunded and that the Mayor and
Clerk be authorized to dray war-
rant, to cover. Motion carried.
Alderman Garbutt moved that
ordinance No. 295 be amended,
making weolesale the occupation tax on

Council that he had investigated

bonds were never issued and nev-
er offered for sale. Aid. Seanor
moved that the City Attorney be

Alderman Jolly called attention of
Council to the bill board at east
end of park on Central-ave., stat-
ing that it should be moved. The
matter was referred to the Chief
of Police with instrudtions to call
on the Torrence-Story that Shoe Com-
pany and request they re-
move same, and if not removed,
to have it done.
Ald. J. M- Adams called the at-

ing of automobile, stating that the

tration of one hundred and thirty
bonds issued September 15, 1908
by the City of Fitzgerald, said
bonds maturing Sept. 15,1938 and
known as “School,” “Water and
Light” and “Sewer” bonds,had se-
cond reading and passed by Adams, follow-
ing vote, “Ayes” D. P.

Ordinance No. 305.
An ordinance to authorize the
Atlanta, Birmingham and Atlantic
Railroad Company to lower the
grade of the side walk on the
North side of Ocmulgee Street be¬
tween Johnson Street and Lee
Street and build a side track there¬
on. Johnson beginning Street at a point East of
and extending to
Lee Street.
Section 1. Be it ordained by
the Mayor and Council of the City
of Fitzgerald, Georgia, that the
Atlanta, Birmingham and Atlantic
Railroad Company be and are here¬
by authorized to lower the grade
of the side walk on the North side
of Ocmulgee Street between John¬
son Street and Lee Street and con¬
struct thereon a side track begin¬
Street ning at a point East of Johnson
and’ extending East to a
point within ten (L0) feet of the
side walk on the West side of Lee
Street in the City of Fitzgerald.
Section 2. Be it further ordain¬
ed that said Railroad Company be
and is hereby required to erect at
the Eastern extremity of said side
track suitable abutments to pre¬
vent the shoving of cars on of
side track and onto the sidewalk
on West side of Lee Street

Ordinance No. 303
An ordinance granting to the
Atlanta, Birmingham and Atlantic
Railroad Company a right of way
throug hand across certain streets
and alleys in the City of Fitz¬
gerald, Geoigia.
Section 1. Be it ordained by
the Mayor and City Council of the
City of Fitzgerald, Georgia, that
the Atlanta, Birmingham and At¬
lantic Railroad Company be and is
hereby granted the privilege of
grading and constructing and
maintaining a railroad line on
Logan Street in said City from
the alley running east and west
through squares one and two, in
block number eight in the City of
Fitzgerald, record Georgia, as shown by
the plat of said City, north
to the north side of Allapaha
Street in said City.
Section 2. Be it further ordain¬
ed that the aforesaid right of way
be and is hereby granted to the
Atlanta, Birmingham and Atlantic
Railroad Company to be used by
the said company and its successors
for railroad purposes, and so long
as the same shall be kept in good
condition with suitable crossings
for the streets, sidewalks and
al'eys that may be crossed by
said railroad tracks.
Section 3. Be it further or¬
dained that this ordinance shall
take effect from and after its
passage and publication once in
the official paper of the city.
Section 4. All ordinances or
parts of ordinances in conflict with
this ordinance, be and the same is
hereby repealed. second and duly

Messrs. Jno. D. Walker, of
Sparta, andP. F. Clark, of Dallas,
announce that they will be in Fitz¬
gerald within the next two weeks
to open a bank. They have in¬
vestigated the situation and are
convinced that there is room here
for another one. despite the fact
the existeece of the three strong-
banks now doing business here.
Mr. Walker has already organized
many banks in the state, and knows
good town when he sees it. Mr.
will be in active charge of
bank, and will makfi his home
here.
Ordinance No. 304
An ordinance to provide for the
of one hundred and
bonds issued September
Ga., 1908, by the City of Fitzger¬
said bonds maturing Sep¬
15th., 1938, and known as
“water and light” and
bonds.
Section 1. Be it ordained by
City of Fitzgerald that any
of any bond or bonds issued
by the City of Fitzgerold dated
15th, 1908, and known as
“school,” “water and light,” and
“Sewer” bonds, may register the
same with the Treasurer of the
City of Fitzgerald.
Section 2. Be it further ordain¬
ed by said City of Fitzgerald that
any owner of the above described
bonds desiring to register the
same shall present the bonds de¬
sired to be registered to the
Treasurer of the City of Fitzger¬
ald and the Treasurer shall there¬
upon separate from said bond or
bonds all unmatured coupons and
cancel and deliver such coupons to
the Water, Light & Bond Com¬
mission. He shall thereupon en¬
dorse upon the bond itself a certifi¬
cate signed by himself setting out
that the bond has been registered
with him and likewise setting out
the name of the person in whose
name the bond is registered and
the fact that the bona can not be
transferred except by the person
in whose name it is registered,
either in person or by agent or
attorney duly authorized to make
such trensfer.
Section 3. The Treasurer of
the City of Fitzgerald shall pro¬
vide a book in which he shall make
a record of all bonds that are
registered with him as above pro¬
vided setting out the number of
the bond, the name of the person
in which said bond is registered
and the date of registration and
shall pay neither interest or
principal of said bond to any
person other than the person in
whose name the bond is registered
or Section to his legal representative.
4. Be it further or¬
dained by the City of Fitzgerald
that on the first day of March
and September on each and every
year the Water, Light & Bond
Commission shall pay the interest
that has accrued on said registered
bond or bonds by their check,
which shall be delivered or mailed
to the post office address of the
person in whose name the bond is
registered.
Section 5 Be it further ordain-
ed that the person in whose name
any such bond is registered
may transfer the same in person
in writing on the registration book
provided as aforesaid or he may
make such transfer by his duly
appointed legal attorney in fact, or the
representative of the person
in whose name such bond is regis¬
tered may likewise transfer said
bond, when thus transferred shall
have endorsed on it a new certifi¬
