** Cruel Treatment”
Is Defined By
The act of a husband in prepar¬
ing to self all his property with
the view of not preparing for the
support of his wife previous to
leaving her does not constitute
cruel treatment.
This is the ruling of the supreme
court of Georgia in the case of
Stoner vs. Stoner, from the Cor¬
dele circuit. Mrs. Florence P.
Stoner, of Fitzgerald, Ga., sued
for divorce and support. She
alleged non-support and cruelty.
The high court held that some dis¬
plays of petulance, rudeness and
occasional sallies of passion were
shown in the evidence, but no
cruel treatment.
The court cited the case of Ring
vs. Ring, in which it was
that “cruel treatment” is the will¬
ful infliction of pain, bodily or
mental, upon the complaining
party, such as reasonably justifies
an apprehension of danger to life
and limb or health.
The lower court non-suited Mrs.
Stoner’s case, and it was carried
up. the high court affirming the
lower court’s action.

Fitzgerald carried off three
honors last Friday and Saturday
at the ()ratorical Contest of the
()ratorical Association of the
Third Congressional District. Mr.
Dave Paulk, however, was the
only one to receive a medal, which
he won in the 110 yard dash. Mr,
Paulk also won a second honor,
Miss Julia Prentiss, who repre¬
sented the schools in elocution, was
given third honor.
The invitation which
tendarit Smith tendered the Asso¬
ciation to come to Fitzgerald next
year, was accepted, which will be
very gratifying news to many in
this city,
