Ordinance No, 307
Be it enacted by the City Council of
the City of Fitzgerald, Georgia, and is
hereby enacted by the authority of the
same, as follows:
Sec. 1. Tnat the Eowen Telephone
Company, a corporation under the laws
of Georgia, having its principal offioe and
place of business in said City, its succes¬
sors and assigns, be, and are hereby
granted right of way for the erection and
maintainance of poles and wires with the
necessary appurtenances thereto for the
purpose of transacting and operating a
general Telephone business through, up¬
on, and over the Streets, Alleys and Pub¬
lic Grounds of said City for and during a
period of Twenty Years from date of
passage of this ordinance.
Sec. 2. That in full consideration of
the use of the Streets, Alleys and Public
Grounds, as herein provided and granted
the said Company shall permit the top
Cross-Arm on its poles, or so many pins
thereon as may be required, to be used by
the City for the purpose of placing and
maintaining thereon, any fire or Police
alarm, or Telephone wires, which may
be necessary for Police or Fire Depart¬
ment of raid City of Fitzgerald; and in
addition thereto said Company, its succes¬
sors and assigns, shall furnish to the said
City, free of rent, the use of Five Tele¬
phones, to be placed as directed by the
Mayor and Council of said City, that said
Telephone Company shall pay said City
of Fitzgerald for said Franchise the sum
of Two Hundred ($200 00) Dollars per
annum for the first Ten (10; years, and
the sum of Three Hunared ($500.00)
Dollars per annum for second Ten (10)
years of the life of this Franchise, and no
other corporation or license tax shall be
charged.
Sec. 3. That any person who shall
maliciously or wrongfully interfere with,
cut, injure, remove, or destroy, any of
the poles, wires, or fixtures, instruments
or other property of the said The Bowen
Telephone Company within the corporate
limits of the said City of Fitzgerald,
shall hitch horses, mules, or
cattle thereto, shall be deemed guilty of
disorderly conduct, and on conviction
thereof shall be punished as already pro¬
vided by ordinance for the punishment of
persons guilty of disorderly conduct.
Sec. 4. That wherever it is necessary
for the Telephone wires and Electric
Light or Power wires to cross each other.
a space of at least three feet shall be
preserved between the former and the
latter, and if necessary to raise or lower
.
any wires in' order to preserve this dis¬
tance, the expense shall be born by the
party doing the last construction. Pro¬
per “guard wire” shall be maintained by
the strong current party when necessary.
Sec. 5. That no strong current wires,
such as electric light wires, shall be at-
tacned to or supported by the telephone
poles or cross aims belonging to said
Bowen Telephone Company, nor snail any
telephone wires belonging to said Com¬
pany ue attached to or supported by the
poles used b. the City for supporting its
electric light or strong current wires.
Sec. 6. The said Bowen Telephone
Company shall replace and properly re¬
lay any sidewalks or streets that may
be displaced by reason of the erection of
such poles, and upon failure of the Com-
pany so to do, after twenty days notice
in writing shall have been giyen by the
Mayor of the City of Fitzgerald, to said
Company, the said City may repair such
portion of sidewalks or streets that may
have been disturbed by said Company,
and collect the cost so incurred from the
said Company, said costs to be taxed
and collected as provided in the sidewalk
ordinance of said City.
Sec. ?. The poles upon wh;ch said’
telephone wires shall be strung shall be
erected within the curb of the street or
sidewalx line as laid out and established
by said City, of the street and alleys, and
all poles shall be set four (4) inches in¬
side said curb line.
Sec 8. Said Company shall indemni-
fy the City of Fitzgerald against and as-
sume all liabilities for damage which may
arise or accrue to the Uity of Fitzgerald
from any injury to persons or nroperty
from the doing any work hereon authoriz-
ed, or the neglect of said Company, or
any of its employees, to comply with any
ordinance relative to the use of streets of
said City, and the acceptance by the
Company of this ordinance shall be an
agreement by it to pay the City of Fitz¬
gerald any sum of money for which the
City may become liable from or by reason
of such injury.
Sec. 9. That when the Number of
SuPscribers stations connected with the
Telephone Exchange of said Company
shall exceed Three Hundred (300) the
rates to be charged for Fitzgerald Ex¬
change service shall not be in excess of
the following:
For unlimited special line business sta¬
tion, $3 00.
For unlimited duplex business line
station. $2.50.
For unlimited special line residence
station, $2.00.
For unlimited duplex line residence
station, $1.50.
It being herein provided that all stations
shall be provided with Long Distance
Connection without further rental charge.
Sec. 10. That thisordinan.ee shall be¬
come effective and be enforced from and
after its passage and the filing with
the Clerk of the City Council of said City
by said Bowen Telephone Company of
its written acceptance of the terms and
conditions of the same.
Sec. 11. The provisions for the in¬
crease charges for Telephone ser vice as
provided in Section Nine of this ordmance
shall not take effect until the “Common
Battery System" has been installed,
which installation shall take place within
twelve months from the passage of this
ordinance;
All resolutions or franchises in conflict
herewith are hereby repealed.

The American Womans League
meets Tuesday May 10, 3 p. m.

in this grand movement, requested

To repair Pine Level Methodist
Church. The framing is good and
sound, and not to be torn down.
The weather boarding will be re¬
moved, and the house newly
weather boarded and recovered.
Also it is to be ceiled and refloored.
The building is thirty by forty
feet, and height twelve feet from
floor to ceiling. Also a porch is
to be erected, eight by thirty feet.
The building committee will
furnish all the material, it to be
first class, and desires bids from
responsible carpenters on the work.
All bids must be received by May
28th. Work to begin June 1st.
and must be completed in sixty
days. We reserve the right to

Misses Rosa Mae Adams, of
Savannah, and Gussie Henderson,
of Rome, who have been attractive
visitors in the city for several
weeks left this week for their re¬
spective homes. While here Miss
Adarns and Miss Henderson were
recipients of much social attention.
Miss Adams is sister of Dr. J. M.
Adams of this city.

Messrs. Walter Wilkerson, Art
Gripe, Robt. Monroe and Clarence
Miller spent several days of this
week in the Ocmulgee River
swamp fishing.
Mr. H. M. Atkinson, president
of the Atlanta, Birmingham and
Atlantic Railroad, passed through
the city Wednesday in his private
car, the “Atlanta.”
Attorney Jesse Grantham has
been in Douglas this week at the
bed side of his mother, who is
critically ill. It is not thought
that she can recover.

Honor Your Mother
Next Sunday will be Mother’s
Day. and the morning service at
the Christian Cnurch will be
especially in honor of the mothers.
Pastor Everett Hollingvvorth will
speak on “The Blessedness of
Motherhood,” and there will be
good music. Every mother in
the city is invited to attend, and
any who can not walk to the
church will be sent for if word is
sent to the pastor or to Brown’s
studio by Friday night. Convey¬
