Ordinance 310
An ordinance providing for the
construction of sidewalks along
certain streets in the City of Fitz¬
gerald and the kinds of materials
to be used and the manner in
which they may be constructed.
Be it ordained by the Mayor
and Council of the City of Fitz¬
gerald, Georgia:
Sec. 1. That in the exercise of
the power vested in the Mayor
and Council of the City of Fitz¬
gerald, Georgia, the said Mayor
and Council deem it wise, rnd
hereby direct und order that all
of the sidewalks in the City of
Fitzgerald, where constructed none have accord¬ here¬
tofore been in
ance with the plans hereinafter
stated, or where sidewalks have

See. 2. Be it furher ordained
that after the passage of this or-

written notice upon the owner,
agent or occupant of the lots abut¬
ting upon the sidewalks to be con¬
structed.by mailing same in a prop¬
erly addressed envelope,or by noti¬
fying immediately such owner or occupant to
proceed with the
construction of a dirt sidewalk on
and along said streets and abutting
said property, the same to be made

the streets next adjacent to said

Sec. 3. Be it further ordained
that when said notice has been
thus served on the owner or occu¬
pant of the property adjaceut to
said sidewalks, such owner shall
have the right to construct within
thirty days, said sidewalk accord¬
ing to the specifications hereinbe¬
hand, fore provided: the *aid if on the other

Sec. 4. Be it further ordained

the construction of such sidewalks

Sec. 5. Be it further ordained
that when such assessments have
been made of the cost of said, ira-

that any property holder shall fail
to pay to the Clerk of the City of
Fitzgerald his pro rata share of

said assessment as hereinbefore
provided, then the Clerk of the
City of Fitzgerald shall issue an
execution against said delinquent
property holder for the amount
due and unpaid, together with all
shall costs therein, which execution
bind and be a lien upon all
of the property of the said delin¬
quent situated within the City of

to all other liens except taxes

Chief of Police shall proceed to
levy and advertise the property of
the said delinquent property hold¬

intention of this ordinance
that the lien in favor of the City

as aforesaid under this ordinance.
Sec. (>. Be it further ordained
by authority aforesaid that the
City Treasurer shall keep separate
and apart from all other accounts
of the City of Fitzgerald, the ac¬
counts showing provided the cost of the
work herein for.
Sec. 7. Be it further ordained
that when ever executions have
been issued as herein provided for,
the defendent therein shall have
the right to file an affidavit denying
that the whole or any part of the
for which said execution
issued is due and stating what
amount he admits to be due; which
amount admitted to be due, with
all costs, shall be paid and collect¬
ed before the affidavit is received
by the Chief of Police and the
affidavit shall be received for the
balance unpaid, and such affidavit
so received shall be returned to
the Superior Court of Ben Hill
County. Georgia, and there tried,
and the issue determined as in
cases the of illegality, subject to all
of penalties provided in cases
of illegality for delay.
See. S. Be it further ordained
that all ordinances or parts of
ordinances in conflict with this
ordinance be and the same are
hereby repealed.
