License Schedule For 1921

ORDINANCE NO. 450. ‘ ;
An-ordinance to provide for the collection of license
©Or occupation tax, on certain lines of business and oc
cupations within the City of Fitzgerald, and for other
purposes. s
. - SECTION 1.
Be 'lt ordaifled by the Mayor and General Council of
th? Cxty.of Fitzgerald that from and after the passage of
this ordinance every person, firm, or corporation which
‘exercises 0 may exercise within the City of Fitzgerald
any profession, trade, calling, orbusiness of any nature
‘whatever, shall annually register in a book to be kept for
that purpose by the City Clerk of said City, the names,
professions, trades or calling or business, and their
places of business, provided nothing herein contained
shall be construed to require such callings or vocations
which are exempt under the law ‘from license to register
their professions.
SECTION 111.
Be it further ordained that all persons who shall com
‘mence any business of any kind in said City after the first
day of January shall register their names and business as.
.soon as they have cominenced to do business as aforesaid.‘
SECTION 111. |
Be it further ordained that whenever any person, or
persons, firms, or corporations have no fixed place of
business within the City, nevertheless exercise within the
City any business of any nature whatever, such- persons,‘
firms, or corporations, shall be required to register‘
their names and places of business and to pay such li-:
cense fee as are levied by the Mayor and Council and
upon the persons having the like of business and fixed
place of business. |
“ SECTION IV. |
Be it further ordained that upon the failure "of ' any
person. persons, firms, or corporations to register
their names and places of business as aforesaid, the City
Clerk shall from the best information obtainable register
the same, and the chief of the police is hereby required
to report to the Clerk all omissions to register which
may become known to him, and any person failing to
register his name or place of business with the Clerk as
required by the law before commencing said business
shall be summoned before the Mayor and upon conviction
shall be fined not to exceed Two hundred dollars, or im
prisonment on the public works of said City not to-ex
ceed sixty days. ¢
: SECTION V.
Be it further ordained that no person, firm or corpor
ation shall by himself o by his agent carry on any occu
pation, trade or calling enumerated in the schedule and
embraced in this ordinance until he has registered with
the City Clerk at the City Hall and paid his license tax
as herein provided. For a wiolation of this section the
Mayor shall upon conviction impose a fine not to exceed
Two Hundred dollars or imprisonment and labor on the
public works of said City not to exceed sixty days.
SECTION VI.
Be it further ordained that no license obtained under
the provision of this ordinance shall be transferable, ex
cept by the authority and consent of the Mayor and
City Council.
SECTION VII. |
Be it further ordained that in addition to the remedies
of fines and imprisonment herein provided for the collec-|
tion of the occupation tax hereby imposed, the Clerk of
the said City is hereby authorized to issue executions for
the same and the chief of police to lev§®and sell so much
of the property, both real and personal of any defaulter
thereunder, to pay said taxes, under the same laws, rules
and regulations as other taxes are collected in said City.
SECTION VIII.
Be it further ordained that from and after the passage
of this ordinance the following business and occupations
taxes shall be levied and collected within the City of Fitz
gerald upon every abstrace Company, individual firm or
corporation making or keeping books of records pur
poting to be an abstract of records of the Clerk of the
Superior Court of Ben Hill County Georgia, or of Irwin
County Georgia and charging a fee fo the inspection of

The driver of each hack or vehicle while in charge of
the hack or carriage shall wear on his hat or cap a
badge, the number of which shall correspond with the
number of the hack or carrigge or automobile. In all
licensed hacks, carriages or automobiles or any other
vehicle of like kind a list of the rates shall be posted,
and such rates and charges shall be as follows: From all
railroad depots to any part or parts of the City shall not
exceed twenty-five cents, this rate shall apply to trans
iportation to or from the depots. or to and from any
point in the City. ]
‘ For each hour shall not exceed $l.OO per hour, for
hacks and $2.00 per hour for automobiles not to be lim
ited by the number of persons in said vehicles. For
failure to post said rates in said hacks or carriages, or for
exaction of more than the prescribed rates, such driver
shall be fined Five Dollars for each and every violation
or five days on the public works of said’ City. The
charges for said vehicles are not to be limited by num
ber of persons per hour. All hacks, cairiages, automo
biles and other vehicles, of like kind are to be required
and shall have a lamp on each side thereof except the
automobile, which shall have the lamp in the proper
place, and the same shall be lighted when running. at
night under the penalty of Five Dollars or five days on
the public works of said City for the first offense, and
ten dollars or ten days for the repitition of each offense
thereafter. Said lamps on said vehicles shall have 2 plain
glass from the sides of the glass painted black, showing
the number plainly when lighted. And each and every
hack, and vehicle, used in said City of Fitzgerald, for
transportation of passengers shall have a licensed num
ber painted on said lamp. For the violation of said
clause each person so offending shall be punished. not to
}exceed Five Dollars or more than five days on the pub
lic works of said City. All hacks, drays and like vehi
lflcles, shall be subject to the call of the police and fire
department of said City, and a refusal to respond to said
call shall subject the offender to a fine not more than
Five Dollars, or not to exceed five days on the public
works of said City. All automobiles used in said City
for the transportation of passengers shall be subject to
all rules and regulations as hacks, carriages, and other
vehicles. No license shall be issued for a hack carriage
or automobile or any other vehicle for transportation of
passengers in said City unless the applicant presents to
the Clerk of said City a certificate from the Chief of
Police stating that the vehicle to be used by such ap
plicant. is reasonably suitable for such a purpose and
that the driver thereof is twenty one years of age. Pro
vided further than before said license is issued to said
applicant the Mayor and license Committe€ shall pass
upon the moral character of said applicant and the
driver to be in charge of said vehicle and no license
shall be issued to any person who is in the habit of be
coming intoxicated, or who is not possessed of good
moral character. The said Mayor, and committee ex
pressly reserves the right to determine the fitness in ail
respects of any‘applicant for a license and reserves the
right to reject any applicant which may be filed for any
reason deemed satisfactory to said committee in refus
ing the application, no reason need be given therefor,
unless said committee sees fit. All license tags must
be securely fastened and kept in some conspicious place
on all vehicles so licensed. It shall be the duty of all
persons securing a license from the City for running %
hack or carriage or like vehicle for the transportations
of persons and passengers to keep said vehicle and said
horses in good condition, in an up-to-date and hackman
like manner, the said vehicle and mode of conveyances
shall at all times be subject to the inspection of the
Chief‘of Police, whose duty it shall be to report to the
Mayor, any defect of said conveyance, and also the con
dition of said horses, in the event he finds such. not in
a fit condition for the purposes aforesaid, and it shall
be the duty of the Mayor to cancel the license of such
vehicle if upon five days notice, such person does not
remedy’ the cendition of such vehicle to the satisfaction
of the Chief of Police and the Mayor and Council of
said City.

Carnivals and street fairs that shall be held in connec
tiofi with any County or Municipal fair held under the
supervision of any Fair association owned and operated
by any of the people of City of Fitzgerald or Ben Hill
County and under the directions of and within the
groundd”at the time of holding said fairs, the whole
amount of tax for said attraction when so held be twen
ty five ($25.00) dollars per week, or a fractional part
thereof, said sum to be paid by the owners of said fair
and license issued in their name; provided that the above
and foregoing license shall in no way apply to midway
combinations, street fair or street carnivals, showing
without the said fair grounds and not under the super
vision and direction of said county er municipal fair.
SECTION IX
Be it further ordained by the authorities aforesaid,
that all occupation taxes payable under /this ordinance,
shall become due, and be payable on the 15th day of
February each year.,
SECTION X,
Be it further ordained that all other occupations or
business not herein provided shall Jay a license of not
less than $15.00 per annum unless otherwise authorized
by the Mayor and license committee of the City of Fitz
gerald, ;
SECTION XI. i
Be it further ordained by the authorities aforesaid
that any person, firm or corporation, applying for a li
cense after August first of each year, shall pay a license
tax of just one half the amount fixed by this ordinance.

SECTION XII ;
Be it further ordained that all laws and parts of laws
in conflict with this ordinance are hereby repealed.
