AN EXPLANATION.,
The undersigned, who were
appointed by the grand jury at
the March term, 1906, of Irwic
Superior Court, as a Special
Cummittee fo examine the books
and records of the City Court
of Fitzgerald, and who are re
sponsible for so much of the
general presentments of that
body as -referred to said court
or its officers, have discovered
since the adjournment of the
coart that an injustice has been
done t> the Judge and Solicitor
of said City Court, which was
entirely unintentional on our
part, and which we gladly take
this method of correcting.
We now find that ncne of the
criticisms of said officers ap
pearing in said presentments
and denominated as irregulari
tics, are justfied by the facts.
Our examination of these books
was done hurriedly aad, in re
gard to those things which were
reported to the body as irregu
rities, and which were likewise
jpcorporated into the present
mens, we were in error either as
to the facts or as to our opinion
of what the law requires of the
officers of the City Court. lan
one case only, that of the State
against Maud Williams, the min
utes showed that the fine was
$50.00 and the costs, while the
statement submitted to the
Grand Jury showed that the fice
collected, exclusive of costs, wag
only $36 35. This apparant dis
crepancy occured by reason of
the fact that after sentence was
passed and writtenoutthe Judge
at the instance of the Solicitor,
decided to change the seatence
and make the fiae $69.00 to in
clude the costs, and neglected to
make the proper change in the
sentence as originally written
out.
E The Soliciter ciuliccted the
$9O 00 and applied $49 15 of it to
the payment of the ccsts, leaving
a balance of $39 85 to go into the
iasolvent fund, while the sen
tence as originally made went on
the miautes withoat correctiory
tbus making the discrepancy.
We cheerfully make this state
ment in order that the facts may
be known and that no wrong or
i justice may be doene, and be
lieving it to be right and proper
under the circumstances that we
should do so.
