An Act to provide for the call of a Convention to re
duce tlie number of the General Assembly of the I
State of Georgia, and for other purpuses therein j
named.
Sec. 1. Be it enacted hy the Senate and House of Re
presentatives of the State ret Georgia in General Assem
bly met, ind it ts hereby enacted by Ihe authority of the
same. That the first .Monday in April, eyhteen hun
dred and thirty-nine, be, and the same is kereby drsig- j
l naled and set apart as the day on w hich me citizens of |
Georgia, qualified to vote for members of the Legisla- i
: lure, shall, at the several places prescribed by law for j
holding such elections, vote for delegates to represent j
them in Convention, in number equal to their repre- j
sentntion in both branches of the Genera', Assembly,
according to the Inst census ; such election to be con- ]
ducted, managed and certitleJ under the same laiys as
are of force in respect to elections ot ijigiubetsof the
Genera l Assembly.
Sire t> And be it further enacted, That it shall be the '
duly of such managers to transmit to his Excellency i
the Governor, the result of said elections under the laws
now of force, conducting, managing and certifying elec
tions of members of the General Assembly, as afore
said. w ithin ten days after such election : whereupon it j
is made the duty of his excellency, the Governor, to is- !
sue his Proclamation, declaring liie result of such elet
'ion, by notifying the individuals severally elected to re
present the good people of Georgia in Convention, ag
contemplated by this Act.
Sec. 3 And be it further enacted, That every citizen
I of the United States shall be eligible to a seat in said; i
Convention, who has attained tlie age of twenty-five
years, ant! been an inhabitant of this state three years
immediately preceding the day of election, and who j
! shall have resided one year in the county for which he !
shall be elected.
I Sec. 4. And t.c it further enacted, That each member I
returned as duly elected, shall, previous to taking his
seat iu said Convention, take the following oath or af- j
i Urination, viz: I do solemnly swear that Twill not at
i tempt to add to or take from the Constitution, or attempt
to change or alter any other section, clause, or article
of tin' Constitution of the State of Georgia, other than
those touching the representation in the General As
sembly thereof, and that I have been a citizen of this
■ S ate for the last three years, so help me God. And
any person elected to a seat in said Convention, who
shall refuse to take the Oath aforesaid, shall not be al
lowed to take his seat in said Convention.
Sec. 5. And be it further enacted, That the members
of said Convention shall assemble on tlie first Monday
i in May, after their election, at Milledgeviile, in the Re
presentative Chamber of the State House, for the
purpose of entering upon and consummating the great
objects of their convention, to wit: a reduction and
equalization of die General Assembly; shall have
l power to prescribe their own rules and forms of business,
land to determine on the qualifications of tlieir own
members; elect necessary officers, and make all orders
w hich they may deem conducive to the furtherance of j
\ the object for which such Convention shall assemble, j
j Sec. ( i. And be it further enacted, That it shall be the
,lutv of his Excellency the Governor to give publicity
to the alterations and amendments made in tlie Consti
tution in reference to the reduction of the number of j
members composing the General Assembly; and the
first Monday in October next, after the rising of said
Convention, he shall fix on for the ratification, by the ;
people, of such amendments, alterations, or new arti
cles, as they may make for the objects of reduction and
'equalization of me General Assembly onlv : and if rati
fied by a majority of tlie voters who vote on the ques
tion of “Ratification" or “ No Ratification,’’ then, ami
j in that event, the alterations so hy them made anil rati
fied shall be binding on tlie people of this State, and
I not otherwise.
Sec. 7. And be it further enacted. That it shall he a
fundamental article in the to mation or amendments of
the Convention, that each county of the state, now or
ganized or laid out, or which may herealter be crea ed
tty law, shall he entitled to at least one representative
in the Representative branch of the General Assembly.
: The Senate shall be composed of forty-six members
only, from for y Senatorial Districis, composed ot two
i corittgiuous C umties; and, in the event of the creation
of any new County, it shall be added t ■ some conti
guous Senatorial District; and that the said Conven
tion shall not disturb the Federal basis, in apportioning
i the representation in the General Assembly of the State
of Georgia.
i See. 8. And Iw it further enacted. That so soon as this
Act shall have passed, his Excellence the Governor
he, and he is hereby required to cause it to be publish
ed in the Gazettes of this State once a week, until the
day fixed on hy this net for the election of Delegates to
| said Convention ; as well as the number to which each
' Coun’y shall he entitled in said Convention, according
i to the apportionment of members of the General As
sembly, to he made under the late Census, taken and
. relumed during the present year.
Sec. 9. And be it further enacted. That the Delegates
o said Convention lie paid at and af er the same rates
hat the members of the General Assembly now receive;
rid that his Excellency the Governor he requested to
raw his warrant on die Treasurer for the same out of
ny money not otherwise appropriated; and all laws
nd parts of laws militating against this act be, and tho
ante are hereby repealed.
