J.—The plaintiff* Drought an action againat tho defendant for tho num of $1,875 1*2 on an account stated for cross-ties furnished it. It appears that the defendant elected to submit tho facts and the law of tho case to the presiding Judge, by not finding an issuable plea under oath, whereupon the court appointed an auditor to ascertain the facta and re port tho same to the court under the pro visions of the 3,072 section of the Code. The parties appeared before the auditor, and introduced evidence, without objec tion, so far as the record shows. The de fendant offered in evidence a written con tract signed by the parties for the deliv ery of the croAs-tiea containing the follow ing stipulation: “The decision of the chief engineer of the company shall lx? final and ooncloaive in any dispute which may arise betwen the parties to this agreement relative to or touching the same, and each and every of said parties do hereby waive any rights of action, suit, or suits, or any other remedy in law or otherwise by virtue of said covenants, so that the decision of tho Chief Engi neer shall, in the nature of an award, be final and conclusive on the rights and claims of said parties/* The Chief En gineer derided against the plaintiffs claim. On tho trial before the Auditor, the evidence showed that tho Chief En gineer had made a clear mistake in his award as to the numl>er of crosstics which tho plaintiffs had delivered and been re ceived l»y defendant; and the auditor ao| reported. Tho evidence before the Audi tor also showed that the Chief Engineer was a stockholder in tho defendant’s com pany, and was, therefore, not a disinter ested arbitrator, which fact ws* not known to the plaintiffs at tho time of the execution of tho contract, and so the your readers to tell of the number of pounds he writhed ; suffice it to say that the arm-chair built for his accommoda tion was large enough for a small tea party. When Fiske waddled out of office C. W. Bradley, of New Haven, waddled in, and now, contrary to the laws of the constitution, is enjoying a third term. He has inaugurated Cjcsarisra, and will un doubtedly be president for years to unless b'- w choked by a clam. He is too fat to move out of office, and so he sticks. Comparatively few know what a clam- tjake is. In ancient times the art of clam baking was known to the natives of Coney I*bind and to a small, privileged class of New Yorkers. In Manhattan it is reck oned among the lost arts. The way they did it to-day was in this manner: A bed of stone, sixteen by ten feet, wafl raised on the pebbly beach. Top of it was placed three cords of hard wood. The wood was ston fire, and for two hours it burned and burned, until the stones were heated to the very core, and nothing but ashes remained of the fuel. The ashes were raked away, and then a broom fin ished the process of preparing the snr- faco of tho stones for the reception of the clams. Thesn; were brought palpitating from the sea-l>eat sands and tumbled from bushel baskets down upon the heated bed. When this was covered over w.th many layers of clams—when the foundation, bo to speak, was laid—blue- fish, wcakfish, eels, lobsters, canned and cooked chickens, woodchuck, green corn, sweet and common potatoes, crabs and lobsters were thrown promiscuously on top, and on top of them was placed so as to completely envelop the bed, a canvfcs coverlet. 'This was tucked in all round so as to make the clams as com fortable as possible and keep them from catching cold. Over the coverlet was placed a great mass of wet rock weed to supplement tho canvas in keeping the steam from escaping. It was no use, however; tho steam insisted on escaping, and the appearance of the clambake was precisely like a dung-hill smoking on a frosty morning. It was fun to the fat men, but dpath to the clams. That was all. Tho next thing had nothing to do with Die bake, but it had everything to do with tho main purpose of the day, and that was the dinner, bo many dollars and .t half I- r h**ad. The following is a list of the megathe rium of the collection of fat men weigh- 300 pounds and over: C. N. The Court affirmed the report of tho Auditor by its judg ment, to which tho defendant excepted. Thcro wuh no point made before this court as to the tacts, bnt the only point made hero was as to the legal effort of the written contract not to resort to the courts for redress on tho statement of facts disclosed in the record, tho defen dant insisting that tho award of the Chief Engineer was conclusive as to tho rights of the parties. Tho Constitution of this State declares that the right of the people to appeal to the courts shall never rxj im paired. Ordinarily, this contract to abide the award of the chief engineer os arbitrator, would be as binding on the parties, as nny other agreement of parties to abide the award of arbitrators, and no more. Whatever would be sufficient grounds to aet aside an award in a court of equity would be sufficient to set aside this award. If the award of the chief engi neer wna the result of mistakes or fraud, or if ho was an interested party, his award may be attacked and set aside, as well os anv other award, and tho plain tiffs had the clear constitutional right to resort to the courts for that purpose, on tho statement of facts contained in the record. In this State, parties may obtain the name relief against an award in a court of law, ns in a court of equity. An award of a chief engineer of a railroad, which is the result of accident, fraud or in intake, or illegal for tiny other cause, is not so sacred and potunt that it cannot l»o set aside by an appeal to tho courts. Th« agreement of the parties to nhido the award of the chief engineer, should be construed to moan that they would abide a legal award, and not an illegal award. It tho General Assembly could not pass n law impairing tho right-* of portion to appeal to tho courts to get rid of on ille gal award submitted to arbitrators by their agreement, tho Chief Engineer of a railroad company cannot, by his award, under this contract* impair tho right of tho plaintiffs to do so; it would bo con trary to the public policy of the Stab) ns declared In Its fmwisentel law. This Cdurt will not reverse the judg ment of tho jadft of tho Superior Court refusing a new trial in a criminal case when there have been two verdicts of guilty, and tho cost? turns wholly on the credibility of tho witnesses. 2. When a motion was made in the Superior Court for a new trial, which vras ref us o*l by tho court ar.d a bill of excep tion to his judgment was tendered, signed, served and filed in tho Clerk’s office, and after this, during tho same term.a motion was made to rehear and set aside the judgment refusing tho new trial, on the ground that the movant had discovered now and important evidence which ought to control tho verdict, and tho judge foiled to pass upon this latter motion, pro or con, but by an order directed the clerk to send it with tho other papers to this court under tho bill of exceptions Held, That os the judge has not passed upon this latter motion, it is still pending in the Superior Court, and cannot bo con sidered here until it is passed upon by tho court l»elow. Tho act of 13th October, requiring proof of the payment of taxes on contracts rnidc prior to June 1,1863 is unconstitutional and void. 2. The general rule is. that statutes of limitation do not apply to bank bills, be cause they are by the consent of mankind and course of business, considered at money, and that their date is no evidence of the time when they were issued, as they are being continually returned to and reissued by the hank. Bnt, if the bills have ceased to circulate ms currency, and have evasod to bo token in and re issued by the banks, they no longer have that distinctive character from other con tracts, which excepts them from the op eration of the statute of limitation. 3. If the bills of the Bank of Fulton luid thus lost this distinctive character prior to the first of Juno, 1S65, they come within the provisions of the Act of 16th JLtreh. ISflfc entitled “an Act in relation to the statute of limitation and for other purposes/* 4. It is necessary in a plea of the statute of limitations by a bank when sued on its bills, to aver the facts which take them out of the ordinary rule, to-wit: That the statute does not apply to such con tracts. 5. When a defendant sots up by plea th.it tho contract is void under the Con stitution, berauae it was made for the pu rpose of aiding and encouraging "the late rcbcUi+m,” it is necessary that the facts should he s tated in such plea, going to show how and in what way the con tract was intended to give such aid and encouragement. 6. When aBMMt other defences, such pleas have been filed and stricken by the court on demurrer, and such decision ex cept.h! to and the exception certified and entered on the minutes, it is competent for the defendant to amend the pleas on a new trial, which has been granted to the plaintiff.
