Held 1. That the verdict is not suffi
ciently certain and definite to fix the
quantity and identity of the land intended
to bo conveyed ao an to authorize a full,
definite and final decree thereon.
2. On tho trial of such a case, the com
plainant Payne is a competent witneus
«.n the issue of a mistake in his deed to
defendant, Willingham, although tho a>-
dcfciidont Elvea, the vendee of Willing
ham had died since the filing of the bill,
and his representative is made a party.
3. The portion of the answer of tho
witness Payne to tho second interrogato
ry which was read to the jury, was not
an answer to that port of the interroga-
toiy which was objected to as leading,
and was properly admitted. The third
interrogatory was not leading—nor does
tho fact, that a previous interrogatory
wus illegal because it was leading—make
the Imlanco of the witness' answer to
other interrogatories incompetent.
4. Tho afflrmanoo of tho judgment of
tho Court below, granting a new trial, i&
limited to the first ground specified in
this syllabus. This Court being of the
opinion that his evidence was sufficient
to authorize a decree to reform the deed
to Willingham, and that tho verdict as
to notice to Elyea was not bo contrary to
tho evidence os to demand that it should
be set aside on that ground.

first day Of January, 1870, dismissed the
action against one of the defendants, and
obtained a judgment against the other,
there being no plea filed by the latter,
such dismissal was not a di»charge of the
defendant against whom tho judgment
wns rendered. Jf the party against
whom judgment was obtained w :is a sure
ty and the other was principal, the rule
would be different.

About midnight Friday night a 1

their faces, and were otherwise disguis
ed. As near as he could judge from their ]
voices, none of the party were above
twenty-one or twenty-two y**ars of age.

his boy Samuel, a lad of eleven, have
been keeping house since. He sat up too
astonished to speak until the fellows f
helped themselves to chairs, when he

to reach toward the ceiling.

dictment for the offense of shooting at
another, the defendant proposed to prove
that a short time after the shooting there
was, at a grocery near by, to which both
defendant and prosecutor hail gone just
after the shooting hod occurred, a con
siderable number of negroes who were
excited and were threatening to mob the
defendant. There w;is no evidence, non
was it offend to l»o proved that any such
threat was made UftBV the shooting, and
in fact it Ap]noring that the excitement
must have lxvn enused by tho shotting
and wounding of tho prosecutor:

have illustrated the issue as to tho guilt

A Californian who has recently re
turned from a viait to New York is anx
ious to have steps token to introduce tho
English sparrow on this coast. He says
tho bird there has proved ajrreat bless
ing, especially in the city. Tne trees in
the porks ore in a more flourishing con
dition in consequence. The sparrow
lives on insects; it delights in cater
pillars ; it searches after the early worm,
and when found makes a meal of him.
Tho result is a pit improvement in tho
folingo within tho city. Three years ago
Trinity Church graveyard was a desolate
looking place. Scarcely a leaf was to be
seen on tho tn^es; tlie worms held high
carnival, and had it all their own way.
They built nests in the trees and dropped
down on tho necks of the ladies. They
were especially partial to green things,
but when the foliage gavo out they
crawled on tho walks, into tho church, up
tho shiny boots of the church-goers, in
search of whatever they could devour.
Tho sparrows came and gobbled them
up; tho lent os got u chance to grow; the
trees took a fresh start, and now all is
changed.
Tho trees actually vio with their coun
try cousins in beauty of foliage. The
* narrows did it; they ore tho most won
derful insect destroyers of the feathered
tribe. They are also one of tho tamest
birds in the world. They will run along
tho sidewalks a few feet in front of a per
son, ns if delighting in human compan
ionship. Boys forget to throw stones at
them, and hoodlums are abashed in their
presence. Such confidence they display
in tlie kindness of man is not to be re
turned with cruelty.
