When Informed they would proceed to tiy him for tho felony, with provoking tomnfroui ho demandod their warrant, well knowing that from want of civil or ganization thorn <*>uld bo none. Having no leade* with supreme authority, like Joshua of old, they formed themselves into a Lynch law court, and, after a fair trial* found him guilty of the larceny, and sentenced him with forty stripes tire one, according to Hebrew law, and that he mak- th*- restitution of tho stolen Hour to' its owner. Smith now dared them to inllict so ignominious a punish- nlcnt without authority of the law. They procured a stout cord with each end "of which they tied his thumbs and then carrying the lino over a heavy thombushf proceeded to execute the sen tence of their own court with u good will, w h of tho thirteen giving him three stri|»-s with a hickory withe. With this degrading punishment nil boldaees and daring forsook him. He repaired to hie cabin, but was nov.*r afterwards aeen in the settlement. It was supposed he found 1.is way to the Falls of tho Ohio and there .-nli-ded ft) tho United States Army. This statement is made on the authority of ono of tho most respectable members of that primitive conrt, the late Judge Foster. It ban been revised by the venerable Major Daniel Gono, a nn- Uve of the very place where it ooourr.*d, now in his *-ightieth year.—America a His- toriral lUeord. ^ ^ A liny at flic Woodpile* I n .»th** builntqr News.] 'There w.t* a l»oy in n Nelson street yard cutting wood yesterday, and he worked at it in a strikingly natural manner. First he set the stick on one end and pre pared to strike it, \vlvn it tnmbh d down. 'Th. a i.«- -t 1 it up .in I put :i - .. r un der the weak side to sustain it, and lifted the axe for the blow, when it tumbled again. As ho had got the axe tip quite a ways this time, and was fairly quivering with exp*- tali on. Ute reaction was not pleasant. It nm>ear**d to weaken him, and Mon' another trial he leaned on the iue and look«*d around on the scenery. At the third trial ho put several slivers under tho stick, and was some five min ute* doing it. Then ho raised the axe carefully, delil>enitely took aim, and brought tho blade down with terrible force, and within al***ut an inch and a half over. Ttiw surprised him. He lookeJ nt th** axe, then ah the stick, and then around at tho house* toseoif anylnxly was looking. He was ten minutes propping the >liek up the fourth time. "NVhen he got it so it would stud without being heM he took up the axe, and after several mock motions so as to get the right aim he -snug tho implement down again.' Tho blade struck tho stick with terrible force within about a sixteenth of an inch from the edge, and took oil a slip about tive inches long. We don’t suppose there is any thing quite so aggravating ns this. Splitting your shin open to the bone is a pant!inc in comparison. The Nelson street l*oy stood that »*tick up again with out any ceremony, and with the least dis play in the >'<‘rl*l swung tho oxo over his head and brought it spitefully down. The blade t$ii.« time clipped off a half-inch chip, and swung around with such mo- tnentum as to throw the bey off his f**vt, mid drive him headlong over a pile of other sticks, every one of which he struck with hi* knee* or*face. We don't think we ever saw any boy get on his feet a* quick us t!u.t boy did. And we were not iii th** least surprised to seo him snatch up that axe, and, with screams and sobs, bout that stick until ho was exhausted. With this unpl* asant duty performed, he Hung the axe in among the tomato vines, and went in tho house for a piece of cake. Fall of mi Aerolite. » hL id to , , and pib- I the treaty b*hng signed. The country is i.*v ii i"ht immensety rich, ard with capital to de- precious metals. Mr. Cree and party spent seven days in the saddle, crossing three main ranges of the Uncoinpaigne and San Juan mountains, crossing at al titudes of 12,500 to 13,000 feet in the oj«*n air.riding through rain and snow over -t*--p traiaL and t!in»ugh fall**n timls-r, swamps and rocks. They report the country the grandest in the world for mountain scenery. At one point they mw a hundred peaks 14,000 to ^ 16,000 feet high. Th** mining region is sur rounded by as good a chain of mountains as are in the country. The country ac quired contains four million acres of most valuable mineral land. Tho proceedings were in the shape of an article of agreement, and it does not come under the head of a treaty, which is forbidden by law. This trrut A Tragedy Indeed* Im Crosse (Wia) Democrat.] One of tho most heart-rending stories of the y**ar comes from Fond dq Lac. young lady was passing through a piece of ground adjoining a farm hoase with her lover when the girl was attacked by a savage dog. Before her escort could protect her the dog had seized her by the breast and torn tho breast from her body. When the young man saw the dog shaking a portion of the body of his intended he fainted away. The young lady, however, did not faint. She was so mortified that she -eized a fence rail and she went for that dog, and she ponnded him until he laid still. When her lover recovered the young woman was trying to hide one of the wire screens that people put over plates to keep the flies off. It seems that the dog didn't draw blood, owing to the fashions at Fond du Lac, which is need less to describe. However, there is great excitement at Fonddu Lac, andtheyounp; man has broken off his engagement anc L has bought that dog—what there is left of him, and he is going to set him again. A correspondent of tho Bucks County Intelligencer, from Falls, lays tho flatter ing unction to his son], if he possesses one. and we hope he does, that the editor of the Democrat, after deprecating the nomination of Butler for Governor^ of Massachusetts, will, since his defeat, im mediately “turn about and whirl about and jump iim crow,” and endeavor to prove him the worst abused man in the Republican party. Not a bit of it. Tho editor of the Dem ocrat never changes his opinion of great rascals. Butler has not been half as much abased as he deserves, and while ii• • i- r--a!ly n.» \v*»r>** than many other " kioht is hki.x am> ki i.t. leaders in the Republican party, he ap pears to be ho because he is bolder in his villainies.—Doyleston Democrat.
