In the United Staites circuit court
yesterday morning Judge Speer passed
a very Important order affecting the
rlgnta of persona in the southern dis
trict Of Georgia holding claims against
tsbe Bast Tennessee, Vdrginda end Geor
gia Bailway Company.
The order was passed on a bill died
by Mr. Marlon Erwin, attorney for W.
n. Jordan. The plaintiff, Jordan, was
u conductor on a construotion^traln on
the Hist Tennesee road which was
wrecked below Macon through the care-
le»oness of other officials of the road
and by which the plaintiff was horribly
mangled and rendered a cripple for life.
Jordan placed his case In the hands of
Mr. Hoke Smith of Atlanta, who
brought suit against the company.
Shortly afterward Mr. Smith was ele
vated to President Cleveland's cabi
net and turned the case over to Mr.
MariOn Erwin of this city. . In the
meantime the road was placed In the
hands of a receiver by Uie circuit court
of tile United States at Knoxville, Tenn.,
and bondholders commenced the fore
closure of .mortgages on it and unoiilary:
bills were flldd in the n'outhem- district
of GeotraCn and other districts, but no
such trill was filed in the southern dis
trict' of Georgia.
Mr. Erwin succeeded In obtaining a
verdict and judgment for Jordan in thd
federal court here in March last for
>7,500. but after obtaining Judgment
WU3 confronted with the insolvent con
dition of the road and the fact that the
properties were In the hands of receiv
ers appointed by courts in another state
and that there was no bill filed in the
fedeml court in this district In which
his client could file an Intervention for
the protection of his rights. The road
was to be sold by the court in Tennes
see on yesterday and while the court
there had provided in its decree for the
protection of interventions pending up
there. It had no provision for the pro
tection of claims pending In the nu
merous state courts and federal court
for the nonthern district of Georgia.
In tih'is situation Mr. Erwin filed a
creditors bill for W. R. Jordan in the
federal court on yesterday, together
with a copy of the bill filed in Tennes
see .by the bondholders, and asked on
bf/xlZ of Jordan and all other persona

extended to the properties In the souitti*
ern district under the orders Of the
court here for the protection of Jordan
and other claimants who might have
similar unprotected claims.
Judge Speer, after consideration of
the ( blit and evidence .submitted, passed
on order exit ending the receivership as
prayed and directing that the teoree of
mie Tennessee court should be modified
eo far as to provide that the purchasers
of the property should take so much of
it as is situated *x\ -this district upon
condition that they should pay the
claim of Jordan and all other persons
intervening in this district if the co irt
decides them to be superior In llu or
equity to the claims of the bondholders
foreclosed In Tennessee.
It 1s said that there are quite a large
number of claims pending in the state
courts In tills district where persons
hive been Injured and damaged by the
railroad, and the timely order made by
Judge Speer will enable them to sue in
thblr hdrne court without having to go
to Tennessee and will .prevent thetfr
rights from being cut off by the sale
which took place yesterday. It Is un
derstood that the raid was bought in
under a reorganisation plan. It is
claimed Jn the Jordan bill that the
stockholding and bondhakilng Interest
of the East Tennessee company is in
the same control and that the road Is
eo operated as to pay out the earnings
In big Interest on the bonds and big
dividends on the stock for five or six
years, and to accumulate a large flout
ing debt In Its dealings wjth the public
and that in order to get rid of the
floating debt the stock management
oauBes default to be made In the pay
ment of the interest of the bonds,which
ore then foreclosed and the .-oad bought
in for the, bondholders and stockhold
ers under a reorganization plan, and
then goes tiwough another period of six
or-^seven years and repeats the same
prompt of shedding Its floating Indebt-

Affects Him.
Each day the results of the great
railroad strike arc felt more aud more,
even in places as far removed from
the West as Macon.
Yesterday the Telegraph told of how
the supply of meat and provisions had
btvti cut off, and now the public Is
greeted with the unumnicement that
beer cannot be shipped here from the
large breweries la orheir states.
This (s a serious detriment to beer
drinkers In Mueon, aa the Cook Brew
ing Company's agency In this city bus
for a long number of years done an
extensive local business, selling more
than one-half the entire amount of
beer consumed in the city.
Hearing that Mr. Tom Draw, |ho
popular manager of the local agency,

him yesterday to ascertain If such was
really the case.
